Update: 

  • A New York judge gave final approval to a settlement that ends class action claims that Toyota made cars with a fuel pump defect that it failed to disclose or cover in warranty.
  • In an order filed Dec. 20 in a New York federal court, U.S. Magistrate Judge James R. Cho approved the settlement, which requires Toyota and the fuel pump manufacturer to extend new parts warranties to certain customers and establish new programs that provide prospective warranty coverage for repairs, including parts and labor.
  • The order certifies a settlement class of all people in the United States, Puerto Rico and other territories who owned or leased one of the class vehicles with the defective engines.
  • The 33 class representatives will each receive a service award of $2,500. The deal also reimburses customers for certain out-of-pocket expenses.

A New York woman says that she and other vehicle owners and lessees were put in jeopardy by a fuel pump defect that the car maker failed to disclosed in a newly filed Toyota class action lawsuit.  

Lead plaintiff Sharon Cheng alleges in her class action lawsuit that approximately 700,000 Toyota and Lexus vehicles were recalled because of a safety defect; however, many more vehicles are allegedly affected.  

The Toyota recall reportedly affects the following vehicles: 2018-2019 Toyota 4Runner, 2019 Toyota Avalon, 2018-2019 Toyota Camry, 2019 Toyota Corolla, 2018-2019 Toyota Highlander, 2018-2019 Toyota Land Cruiser, and 2018-2019 Toyota Sequoia manufactured between Aug. 1, 2018 and Jan. 31, 2019.

However, the plaintiff says the “same dangerous condition is present in all 2018-2019 Toyota manufactured vehicles equipped with low-pressure fuel pumps with part number prefix 23220- or 23221-.”

According to the complaint, the defect is a low-pressure Denso fuel pump that could result in failure. As a result, vehicles can reportedly stall or even shut down.  

The Fuel Pump Defect in the Class Vehicles exposes occupants and others to extreme danger, or even death,” states the complaint.” A vehicle that stalls or suffers engine shutdown is at heightened risk for collision. A vehicle that stalls or suffers engine shutdown causes drivers to react to remove themselves from danger, typically by exiting the road. Drivers stranded on the side of the road experience a heightened risk of danger, whether it is from other vehicles or weather elements. 

According to the Toyota class action lawsuit, the design defect stems from a plastic impeller that becomes unstable under normal driving conditions. The plaintiff says there are no warnings when the vehicle is about to experience problems with the pump.  

Cheng claims that the car maker knew of the fuel pump defect for a long period of time. According to the Toyota class action, the car manufacturer issued a Defect Information Report noting that had received warranty requests numbering in the thousands over the fuel pump defect. 

Despite knowing of the defect, Toyota has not provided a remedy, alleges the complaint.  

“Toyota stat[ed] it will not even notify owners and lessees of the Class Vehicles of the Fuel Pump Defect, despite its attendant risk of bodily harm or death, until March 13, 2020,” the Toyota class action lawsuit claims. “Thus, owners and lessees of the Class Vehicles are unknowingly driving on roads and highways in potentially ticking time bombs while Toyota knowingly exposes its customers, from whom it made at least $20 million from the sale of just the Recalled Vehicles, to the risk of grave physical harm and even death.” 

The plaintiff alleges that Toyota has also not told consumers to stop driving vehicles affected by the defective fuel pump. The complaint contends that Toyota should have fixed the problem and offered owners and lessees free loaner vehicles.  

According to the Toyota class action lawsuitthe plaintiff and other owners and lessees suffered a loss of value in their vehicles because of the defect. The plaintiff says that Toyota’s marketing touts its vehicles’ safety system and that she and other customers used this advertising when deciding to purchase their vehicles.  

The Toyota class action lawsuit seeks to represent all current and former owners and lessees of vehicles affected by the defect.

    I have a 2019 Toyota Tacoma with 17K miles on it.
    It stalled on me before xmas. Has been setting at the Toyota dealer since then.
    Error Code is the fuel pump associated with the recall.
    I bought this as a work truck and was given a Chevrolet Malibu as a rental.
    I’m losing money every week as my boss lowered my pay because I can not perform the work I use to with my truck.
    I was advised to wait for the recall or sell my truck.
    I was not told about the recall when I purchased the truck, even though it was known.
    I am told it will be March before my vehicle can receive the required recall part and service.

    Notified in late October 2020 that my 2019 Highlander had a safety recall due to fuel pump problem. It is now January 24th and I have been told the “remedy” would not be available until late February. Not willing to risk my life driving this car, so it sits in the garage. Unbelievable that Toyota has not offered us new cars instead of months waiting to have a “remedy”. I drove my great grandbaby to Florida and back not knowing the car was so unsafe. Shame on Toyota.

    My 2019 toyota has a slight hesitation when starting up. I makes a static noise so i let run a few minutes before driving. I keep up with all check ups and no mention of a problem.

    I Have a 2019 Toyota Tacoma same thing defective fuel pump the truck is very sluggish. I work for Enterprise car rental I was told to pull the Toyota’s with the recall out of the fleet back in February the vin numbers were provided by Toyota. I received my recall notice in December of last year now from February to December it took them 10 months really. Seems Toyota has a history of not notifying the public there was a 180 million dollar settlement just last week 1/14/21 there vehicles had emissions problems which was polluting the atmosphere for over ten years. Keep in mind there is an air bag recall from Toyota I heard something about yesterday. So for all that have this fuel pump recall do your self a favor don’t drive on an expressway in front of an 18 wheeler. If there is a on going lawsuit out there for this recall I would like to be involved.

    After a long trip to California, we stopped at a store 1 Mile from home, My 2019 Tacoma with 8000 miles started to stall and sputter and would only go about 10 miles and hour. Very dangerous in traffic. I did not get a recall notice, if i knew of this problem i would have taken my other car on this trip… I had it towed to the dealership this morning, and they ask if i had a recall notice, which i replied NO.. I also imputed the VIN number to see if a recall was issued none listed… I was just bragging about having reliable cars, now after researching this issue on line, it seams i was kept in the dark about Toyotas and their reliability

    2019 Toyota Camry and always noticed their was a hesitation but they always blamed it on their new transmission software. When the heat started going up here in Arizona the car got worse. Finally, after two attempts of having the car nearly stale and die they replaced it in July. This worries me that I was driving a car back and forth to Texas and toyota failed to address this until a year after owning it. This is one of many other service bulletins and recalls that I have had. I’ve had my Camry in the shop almost half the time that I have owned it. So frustrated that I own a car that has had more repairs, recalls, and service bulletins but stuck with it!

    I have tried all day to get some answers from Toyota; my dealership and their headquarters. No one will even tell me how many 2018 Tacomas have stopped running because of the fuel pump. I am planning a long trip north, crossing a lot of empty desert miles, and would like to have some cogent idea of what my risk is that the truck will breakdown. I asked for a loaner for a short period of the trip. The headquarters gave me a case number and after several more calls I was told to go to my dealer and request a loaner. I did. My dealer does not have loaners. I then called headquarters and offered to rent a car for the trip if Toyota would reimburse me. I was told no. I planned the trip with old fishing friends long before the recall and I intend to make it in my Tacoma hoping the risk is low. If I don’t make it please put my heirs in the class action suit.

      They should have advised you not to drive it at all. Because it will literally put you in a ditch. Go to Toyota’s site and read the recall info. They should be offering you a rental. As part of your contract.

    My car was always running weird I knew something was not right but I always thought it was because it was a eco I never had a car like it so my instincts were right but just found out 2yrs after not good for people risking there life and there families life very disappointed
