Two Honda drivers sued the automaker alleging some 2022-2023 Honda Civics have a dangerous defect.

Plaintiff Omar Gonzalez and Johnathan Nesbitt filed the class action lawsuit against American Honda Motor Co. on April 24 in a California federal court, alleging violations of state and federal consumer laws.

They look to represent anyone who purchased or leased a 2022-2023 Honda Civic equipped with electric power steering (EPS).

According to the lawsuit, the vehicles all have identical EPS systems designed to help drivers steer the vehicle by reducing the effort needed to turn the wheel. However, the vehicles’ EPS systems were allegedly plagued by problems from the outset, the lawsuit states.

“They have the propensity to ‘stick,’ which requires a momentary increase in steering effort that can result in steering overcorrections that could lead to collisions,” the Honda class action says.

Honda knows or should have known about the defect, plaintiffs say

The National Highway Traffic Safety Administration received scores of complaints and Early Warning Reporting Field Reports about the risk, the lawsuit states.

“Honda has long known or should have known of the EPS problems from pre-release vehicle testing, consumer complaints, and other sources,” according to the Honda defect class action. “Yet Honda failed to disclose and actively concealed information about the dangerous EPS problems from the public; continues to manufacture, distribute and sell the class vehicles without such disclosure; and refuses to fix the problem.”

The plaintiffs sued for violations of state consumer protection acts and breach of implied warranties. They seek certification of the class action, damages, fees, costs and a jury trial.

Honda also recently issued a recall of 330,318 vehicle side-view mirrors, with an estimated 1% defective, due to an issue with the adhesive on the mirrors’ heating pad.

The plaintiffs are represented by Christopher R. Pitoun, Steve W. Berman and Sean R. Matt of Hagens Berman Sobol Shapiro LLP.

The American Honda Motor Co. class action lawsuit is Omar Gonzalez et al. v. American Honda Motor Co., Case No. 2:23-cv-03082, in the U.S. District Court for the Central District of California.

Bought the Honda this year, only has 35,000 miles and steering started sticking. Hard to stay within the lane as it pulls hard to the left and right. Brought to the dealership and told it is a known issue and they have ordered parts that wont be available until “at least” October 3rd but advised that I could drive the car anyway. I dont feel this is safe and it is putting my life at risk but dont have another vehicle to depend on.
