BMW logo on a vehicleA recent class action lawsuit claims that certain BMW engines are plagued with an oil burning defect, similar to older models.

The defect allegedly affects N63 model engines and causes the vehicles to consume excess amounts of engine oil with regular use.

This means that consumers are reportedly forced to regularly refill the oil in their vehicles in addition to taking the cars in for regular oil changes.

According to the BMW class action, the defect is found in several iterations of the N63 engine including the N63TU.

“BMW has known about this for many years, and in fact faced a prior class action concerning earlier model cars equipped with N63 engines, which is the predecessor of the N63TU. BMW never fixed the defect, which continues to plague the class vehicles at issue in this action,” the BMW class action lawsuit claims.

Plaintiff Thomas Isley allegedly experienced the issue with his 2015 BMW X5 xDrive50i. The vehicle was originally equipped with the defective N63TU engine, but BMW replaced this engine with the N63 after the vehicle continually burned through oil.

Despite paying for the engine replacement out-of-pocket, Isley allegedly continues to suffer from the oil burning defect – meaning he needs to routinely add six to eight quarts of engine oil in between oil changes.

Isley claims that BMW knew that the oil burning defect plagued the N63 engines, but concealed the issue from consumers.

The original N63 was released in 2008, but a May 2013 technical bulletin released to technicians reportedly showed that BMW was aware of the oil consumption complaints. Since then, each new version of the N63 engine allegedly experiences the oil burning defect.

“BMW has attempted to mask the oil consumption defect until the expiration of the new vehicle limited warranty by characterizing the excessive oil consumption as ‘normal’ and further instructing service representatives and owners to overfill the class vehicles with engine oil,” Isley argues.

Isley seeks to represent a Class of consumers who purchased, leased, or own a 2012 to present BMW automobile equipped with any variant of the N63TU engine, including certain model years of the BMW 5 Series, 6 Series, 7 Series, X5, and X6.

If the court chooses not to certify the nationwide Class, Isley proposes to represent three statewide Classes of the same consumers from certain states.

The first multi-state Class would include consumers from California, Florida, Illinois, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, New York, and Washington. The other two Classes would include consumers from New Jersey and Tennessee, respectively.

The BMW oil class action lawsuit seeks declaratory relief, injunctive relief, restitution, disgorgement, punitive damages, treble damages, exemplary damages, compensatory damages, statutory and civil penalties, court costs, and attorneys’ fees.

Isley and the proposed Class are represented by Frederick J. Klorczyk III and Joel D. Smith of Bursor & Fisher PA.

    I have a 2013 x3. That I have to have my engine rebuilt. At only 95,000 miles. I bought a bmw because they are suppose to be such great cars run forever. I can’t believe this. My drive train is ruined. I change my oil regularly. Anyone have a suggestion on what I can do about this?

    I have a 2011 550i my engine failed the test and was told i was able to get a new engine under the terms of the lawsuit. My car has 90,000 miles on it, but to my surprise my engine was already replaced by Bmw for the previous owner. So the engine only has 40,000 miles on it. Bmw states that because the odometer reads 90,000 they are only paying 40% of the cost $18,xxx minus 40% leaves me with a $11,000 bill. Are they nuts ??

    I have a 2012 750li that will not go 1000 miles after an oil change without adding a quart. So between oil changes I have added 5 additional quarts of synthetic oil.

      I also have a 2012 BMW 750 Li xdrive. I am experiencing the same problems and have had the rings replaced and the problems continue. Now BMW wants to charge me more money to replace the engine. WHY are we asked to pay for a defect that the company has known about from the beginning. I want to know how and what to do to get BMW to fix this and more problems that I and most BMW owners have experienced. Need answers please!!!

    Hello i have a 2013 bmw 750li x drive and it burning a lot of oil every 300 to 400 miles putting in oil between oil change .
    If bmw is aware of this problem why haven’t they fix the problem its unfair that not only myself but others who own a bmw are having the same problems with there cars

    I have a 2012 bmw 550xi and was denied coverage due to the mileage on my car. I explained cars are meant to be drive so the mileage should not matter. The fact is you have a faulty engine that should be acknowledged.

    I have a 2013 550i and took it in today because of the excessive oil use, blue smoke while sitting idle and the check engine light came on. The serve advisor told me about the lawsuit and advised that my repair could be covers at no cost and that they could/would be fixing the problem by replacing the valve stems and gaskets. Looking forward to this being resolved.

    My 550i BMW is burning excessively oil I brought the car to the dealer shop to get fix and after the kept the car for a complete week and said that the fixed the engine still burning oil, I had been waiting for month to be contacted by BMW and that never happens I’m not able to use the car for a long trip because I don’t feel safe, my family is in Michigan and Chicago and I live south, I need a reliable car and I’m paying for a car that I’m not able to use, for this engine defect, BMW customer service line is prepotent and not willing to help, they just give you excuses. The worse car I ever owned

    I have mentioned mentioned multiple times that I thought my car burns alot of oil. Again, was told, that’s normal. Now it calls for oil at every 400 miles. Took it to the the local BMW under the lawsuit to be fixed and they are saying that its not covered because my car is over 120,000 miles. They want to $9000 to fix my car. What are my options?

    Have a 2012 BMW 650i and the engine seized. I complained more than once that it was burning way too much oil and was told this was normal and that was no cause for concern. Was never told about the class action. Now they are trying to say it is because I didn’t put oil in it which is ridiculous. I carried oil in my trunk because I had to put more in so often. They spent $5,000 just to tell me that it “could” have been due to lack of oil so extended Warrenty won’t cover it. Now they say it will be $15,000 to replace.
