A Wayfair customer has filed a class action lawsuit against the online home goods store saying the company’s headboards are infested with bed bugs.

Lekisha Nicholas says she purchased a headboard from Wayfair in May 2016.

The Wayfair class action claims the headboard was infested with bed bugs when Nicholas received it, but she was unaware of the infestation.

Nicholas says she was bitten by the bugs on her hands, thighs, legs, and feet, and her hand even swelled up.

The Wayfair class action states that Nicholas continued to be bitten until she observed many small insects “scurrying about [her] headboard and property around it.” Allegedly these bugs were later identified as bed bugs.

According to Nicholas, she hired a bed bug exterminator who confirmed that the source of the bed bugs was the headboard, and then treated the bed.

Nicholas says that in an attempt to get rid of the bed bugs, she had to wash everything she owned that was washable, and had to throw away some of her belongings.

The Wayfair bed bugs class action lawsuit states that Nicholas immediately notified Wayfair that they had sent her a headboard infested with bed bugs.

Allegedly, Wayfair failed to compensate Nicholas for the damages she suffered from exterminating the bed bugs, the damage done to her surrounding property, damage and loss to surrounding property and real estate, and the time and effort she put into eradicating the bed bugs.

Nicholas states that the time spent dealing with bed bugs is upwards of 80 hours.

According to the Wayfair bed bug class action lawsuit, many customers have experienced similar problems.

Nicholas cites numerous online complaints saying that Wayfair sold consumers products infested with bed bugs.

Allegedly, the problem began around 2016, and Wayfair knew of the problem, but continued to sell the infested products despite their knowledge.

Nicholas argues that Wayfair fails to compensate customers for the physical injuries of bed bug bites and the “emotional distress that comes with learning that there are bed bugs in ones living space.”

The Wayfair class action lawsuit says that in their interactions with customers, although Wayfair sounds “as though they will stand by their products and make things as right as can be” they leave customers, including Nicholas, with significant losses from the bed bug problem that they do not compensate them for.

Nicholas says that had she known the headboard was infested with bed bugs, she would not have purchased it, and claims that she relied on Wayfair’s representations of the product to make her purchase.

This is not the first time that Wayfair has come under fire for an alleged bed bug infestation. In January 2019, they faced a separate bed bug class action lawsuit filed by a consumer in Illinois federal court.

Nicholas is represented by Scott A. Bursor and Joshua D. Arishon of Bursor & Fisher PA, Katrina Carrol of Lite DePalma Greenberg, and Tiffany M. Yiatras of Consumer Protection Legal LLC.

The Wayfair Bed Bug Infestation Class Action Lawsuit is Lekisha Nicholas v. Wayfair Inc., et al., Case No. 1:19-cv-01974, in the U.S. District Court for the Eastern District of New York.

Yesterday I saw a bed bug & flipped. I was looking everywhere to see where it could be from. All of my furniture is new. So I was really confused. Well I took a look at the headboard and in the fabric crease that’s where they are. I just called Wayfair and told them and let them know that they do have a lot of people saying the same thing. They offered me my money back.

Can you please add me to this as well. I purchased a headboard in 2019, the infestation of bedbugs in the wood must of came out recently, I have sores all over my body from being bitten. 3 months of not sleeping, up every single night, not to mention all the claritin I have been taking because we couldn’t figure out what it was. Two doses of prednisone. And well yeah The ENTIRE headboard in behind is covered in bed bugs. The money im going to lose on all my bedding and my sanity is beyond words.

  3. Donna says:

Please add me for we bought a love seat and it was full of bedbugs. Throw it out and had no idea that it was bedbugs. Bought a new chair from them and the bedbugs came back.

  4. Jamie Anderson says:

Same story here. Purchased a fabric headboard in September 2019 and just recently noticed the spots on my pillowcase. The whole headboard is infested with bedbugs. Trying to treat it asap so they do not spread to other rooms. I don’t want my 10 year old and 9 month old beds to be riddled with them. I feel disgusting and the treatments are expensive. Going to call wayfair tomorrow.

  5. Michael Delage says:

  7. Tatiana Robinson says:

Omg I feel some sort of relief but not really. I brought a Headboard with Queen bed in 2017. I didn’t start getting bit till 2019 when my arms and hands started itching like wild fire. I would scratch myself so bad I thought I had an underlying skin condition until I noticed little bugs crawling at night, 1 at a time. I looked up the bugs and they were bed bugs but I couldn’t figure out where they were coming from I Searched my bed and box spring didn’t see anything but I still would see bugs then one night I saw one on the headboard my flashlight unveiled an infestation in the headboard. I Immediately immediately threw the headboard out. Moved, and realized the infestation moved to my Matterress so I threw that out clean and sprayed and in 2020 I still have a problem with them, and I can’t afford a exterminator. Because add me to they this lawsuit.

    1. Nancy Ross says:

I purchased my headboard in 2018 and went through the same itching. I finally discovered the huge number of bedbugs full of my blood running all over the headboard. I am now in the process of trying to get rid of these vampires that exist only on human blood. I’ve contacted Wayfair and they are saying since I bought the headboard in 2018, they can’t be responsible. I would love to join this class acton suit against this corrupt, irresponsible company whose warehouses must be invested.

  8. Tracey says:

I’ve just experienced the same thing. My daughters headboard is filled with bed bugs

  9. Chris S. says:

How do I get on this lawsuit? My fiance and I (very clean people) bought a headboard fr Wayfair in August 2018. Last week, we both noticed bites on our hands. We checked our bed, didn’t see anything, then checked the headboard. Gobs of bed bug molts covered the headboard. They had migrated to the ceiling and our blackout curtains. After nearly having a panic attack, we retreated to our son’s room. We are calling an exterminator tomorrow. We have pictures and documentation (no doc bills since we haven’t been bit bad enough to require treatment.) Please let us know what we can do to recoup some of our losses.

    1. Chris says:

To everyone reading this, we called Wayfair and told them our situation and they agreed to refund the headboard and pay for extermination fees. I suggest anyone with a problem to call Wayfair customer service

      1. Isaiah says:

Chris, did you throw away the headboard?

      2. James Schlegel says:

Yes, me also infested with bedbugs, purchased queen bed frame upholstery infested in seems, thought I had dry skin, been eating for a year about to have a bon fire, add me to list
