Although Whirlpool recently recalled their glass cooktops due to a defect, a class action claims that the company should provide consumers with monetary compensation as well.

In August 2019, Whirlpool recalled several of their glass cooktops sold under Whirlpool, Kitchen Aid, and Jenn-Air brands.

According to Whirlpool, the defective cooktops are capable of turning on by themselves which can pose a fire hazard and risk burning consumers.

The company has reportedly received 133 reports of the cooktops turning on by themselves, 14 of which allegedly resulted in “heat damage to nearby items and four reports of items catching on fire.” One report involved property damage and two reports involved burn injuries.

If consumers had purchased a defective cooktop, they were directed to contact Whirlpool for a free installation of a replacement cooktop. While waiting for the replacement, consumers were instructed to turn off the unit circuit breaker.

More than 26,000 units were recalled in the United States, in addition to 2,800 units in Canada and 128 units in Mexico. With each cooktop costing around $2,500, there is reportedly $65,750,000 worth of recalled cooktops in the U.S. alone.

Although the company initiated a recall of their products, the Whirlpool class action filed by plaintiff James Rosenbaum claims that the company has not done enough to remedy the issue.

“Whirlpool has noticeably failed to account for the fact that purchasers of Whirlpool’s Defective Cooktops are at grave risk of personal injury and property damage, including, but not limited to, the destruction of their homes,” the Whirlpool class action claims.

Rosenbaum has allegedly contacted Whirlpool multiple times for a replacement but the company has yet to replace the appliance or address his concerns about fire hazards.

“Whirlpool is fully aware of the fire risk presented by the Defective Cooktops but has failed to adequately address that risk,” Rosenbaum’s class action claims.

The Whirlpool class action states that Rosenbaum and other consumers would not have purchased the cooktops, or would have paid significantly less for them, if they were aware of the fire hazards and risk for personal injury.

Rosenbaum seeks to represent a Class of consumers who purchased a “glass cooking surface, radiant and downdraft radiant models sold under the Whirlpool, KitchenAid, and Jenn-Air[] brands.”

    I have a whirlpool glass top and had the main control burner burst I to flames while cooking a couple years ago. Thank God I was there to contain it, or my home could have erupted in flames.

    How can I find out more information about the suit and how up join it? Have talked to KitchenAid several times and not happy with replacement options or cash buy out. We had work done to our granite counter top so the unit would fit plus installation charges that they don’t seem to want to cover. I know they’re coming out with a new model similar to ours but it’s not offered as a replacement. All they want me to do is sign a waiver as I continue to wait them out.

    I thought I was going crazy and I think my husband was seriously considering having me committed because our KitchenAid cooktop kept coming on but I thought I must be leaving it on. Then the last time, I got up to make us some popcorn and noticed it was on but I hadn’t used it that night, so I turned it off, the next morning a different burner was on and I KNEW it wasn’t me at this point because I still hadn’t used it. I called KitchenAid/Whirlpool and they said they would send someone to repair it next week but to turn off the breaker until then. I assured them I had already turned the breaker off because it scared me and I didn’t want to take any chances. There had been lots of other incidents and sometimes it was on when we came home from being away for a couple of weeks or several days. I called the day the repairman was supposed to come and they said they had no record of a service call being set up so I had wasted a day to meet a repairman who would never show. They did say that my unit was under recall and that they needed to schedule someone to come pick it up and replace it with the model with knobs or refund my purchase price. We finally reached an agreement and it was recently replaced with an upgraded model instead. I was afraid to turn the breaker back on so I had to do without a cooktop until it was finally replaced. I’ve had it for a few weeks now and am happy to say it has not turned itself on and my sanity is no longer in question. I’m just thankful my husband didn’t have me committed for leaving the burners on so darn many times that he thought I was losing my mind and maybe couldn’t be trusted. I sure would have liked to have known a bit sooner so my sanity didn’t come into question!

      I have a Whirlpool glass top stove that cracked from excessive heat caused by a burner that would go to the high setting no matter where I put the dial. For instance, i set it on low, but the ekement was red and extremely hot. I had an extended warranty that they will not honor. I had a certified repairman look at it, and he agreed it was cracked because,of extreme heat. Please,add me to this lawsuit.
