Muscle Feast LLC falsely advertises that its 8-Hour Energy Pre-Workout dietary supplement is free of artificial flavors and preservatives, a new class action lawsuit alleges.
Plaintiff Jacob Scheibe claims Muscle Feast misbrands its 8-Hour Energy Pre-Workout product as “All-Natural” since the dietary supplement allegedly contains the synthetic ingredient DL malic acid.
Scheibe argues Muscle Feast misleads consumers by designating DL malic acid on the 8-Hour Energy Pre-Workout product’s ingredient list as “malic acid,” its generic name.
The presence of DL malic acid in the 8-Hour Energy Pre-Workout was confirmed through testing conducted by an independent third-party laboratory, according to the Muscle Feast class action.
“This type of malic acid is manufactured in petrochemical plants from benzene or butane … through a series of chemical reactions, some of which involve highly toxic chemical precursors and byproducts,” the Muscle Feast class action states.
Scheibe wants to represent a nationwide class and California subclass of consumers who purchased the 8-Hour Energy Pre-Workout within the last four years.
Muscle FEast uses DL malic acid to simulate ‘sweet and tart taste’ in 8-Hour Energy Pre-Workout product
Muscle Feast uses the DL malic acid to “create, simulate, and/or reinforce” the “sweet and tart taste” that consumers associate with the kind of fruit flavors on the 8-Hour Energy Pre-Workout product’s labels, the Muscle Feast class action alleges.
“Defendant uses the petrochemical-derived DL malic acid in its Products to create a sweet and tart flavor but pretends otherwise, conflating natural and artificial flavorings, misbranding the Products and deceiving consumers,” the Muscle Feast class action states.
Scheibe claims Muscle Feast is guilty of breach of express warranty and unjust enrichment, and of violating the Ohio Consumer Sales Practice Act and California’s Consumers Legal Remedies Act, among other things.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual damages for himself and all class members.
In another case involving an energy product, a class action lawsuit was filed against Monster Energy in November 2020 by a consumer arguing the company’s Java 300 line of beverages don’t taste like french vanilla, as advertised.
