Honest Company class action overview:

  • Who: Two buyers of The Honest Company “plant-based wipes” are suing the company.
  • Why: The plaintiffs say the marketing of the wipes are misleading because some of the wipes’ ingredients are synthetic.
  • Where: The Honest Company class action was filed in a California federal court.

The Honest Company’s “plant-based wipes” are deceptively marketed because they actually contain synthetic and artificial ingredients, a new class action lawsuit alleges.

Plaintiffs Catrice Sida and Kris Yerby filed the class action lawsuit against The Honest Company, Inc. Aug. 10 in a California federal court, alleging violations of state and federal consumer laws.

The plaintiffs allege that, in an effort to increase profits and obtain an unfair advantage over competitors, the company falsely labels some of its Honest-brand wipe products with the claims they are “plant-based wipes.”

Honest Company plant-based wipes contain synthetic ingredients, lawsuit alleges

The lawsuit alleges the claims deliberately lead consumers to “incorrectly believe” that the products are composed of only water and plant-ingredients.

“However, contrary to the labeling, the Products contain numerous ingredients that do not come from plants whatsoever, including artificial or synthetic ingredients,” the lawsuit alleges.

“In addition, the Products contain ingredients that, although they may have been originally derived from raw plant materials, were subjected to substantial processing, such as chemical modification or processing, that materially altered their original plant composition.”

The deception is exacerbated by the fact the claims are printed immediately underneath an image of a plant such as a leaf, aloe plant, or almond, the lawsuit states.

“Most of the products have background imagery covering their packaging that is readily or easily identified as images of plants, like flowers, aloe, and almonds.”

The plaintiffs are looking to represent a nationwide Class of people who bought the wipes, plus a California Subclass.

They are suing for violations of California business and advertising laws, and for breach of warranty and unjust enrichment.

The lawsuit is seeking fees, costs, damages and injunction preventing the company from selling the product with the allegedly misleading marketing, and a jury trial.

Last year, The Honest Company was hit with a class action lawsuit alleging it lied to investors about the prospects of its business during the COVID-19 pandemic, hiding already present threats ahead of its IPO, resulting in tumbling stock prices and investor damages.
