A Wayfair customer has filed a class action lawsuit against the online home goods store saying the company’s headboards are infested with bed bugs.
Lekisha Nicholas says she purchased a headboard from Wayfair in May 2016.
The Wayfair class action claims the headboard was infested with bed bugs when Nicholas received it, but she was unaware of the infestation.
Nicholas says she was bitten by the bugs on her hands, thighs, legs, and feet, and her hand even swelled up.
The Wayfair class action states that Nicholas continued to be bitten until she observed many small insects “scurrying about [her] headboard and property around it.” Allegedly these bugs were later identified as bed bugs.
According to Nicholas, she hired a bed bug exterminator who confirmed that the source of the bed bugs was the headboard, and then treated the bed.
Nicholas says that in an attempt to get rid of the bed bugs, she had to wash everything she owned that was washable, and had to throw away some of her belongings.
The Wayfair bed bugs class action lawsuit states that Nicholas immediately notified Wayfair that they had sent her a headboard infested with bed bugs.
Allegedly, Wayfair failed to compensate Nicholas for the damages she suffered from exterminating the bed bugs, the damage done to her surrounding property, damage and loss to surrounding property and real estate, and the time and effort she put into eradicating the bed bugs.
Nicholas states that the time spent dealing with bed bugs is upwards of 80 hours.
According to the Wayfair bed bug class action lawsuit, many customers have experienced similar problems.
Nicholas cites numerous online complaints saying that Wayfair sold consumers products infested with bed bugs.
Allegedly, the problem began around 2016, and Wayfair knew of the problem, but continued to sell the infested products despite their knowledge.
Nicholas argues that Wayfair fails to compensate customers for the physical injuries of bed bug bites and the “emotional distress that comes with learning that there are bed bugs in ones living space.”
The Wayfair class action lawsuit says that in their interactions with customers, although Wayfair sounds “as though they will stand by their products and make things as right as can be” they leave customers, including Nicholas, with significant losses from the bed bug problem that they do not compensate them for.
Nicholas says that had she known the headboard was infested with bed bugs, she would not have purchased it, and claims that she relied on Wayfair’s representations of the product to make her purchase.
This is not the first time that Wayfair has come under fire for an alleged bed bug infestation. In January 2019, they faced a separate bed bug class action lawsuit filed by a consumer in Illinois federal court.
Nicholas is represented by Scott A. Bursor and Joshua D. Arishon of Bursor & Fisher PA, Katrina Carrol of Lite DePalma Greenberg, and Tiffany M. Yiatras of Consumer Protection Legal LLC.
The Wayfair Bed Bug Infestation Class Action Lawsuit is Lekisha Nicholas v. Wayfair Inc., et al., Case No. 1:19-cv-01974, in the U.S. District Court for the Eastern District of New York.

Please add me. I bought two headboards from Wayfair. We moved into our brand new house. I started getting bit but couldn’t find anything. I started sleeping in another room in a different bed. The bites stopped. One morning my husband saw two bugs crawling in the bed so we started taking the bed apart and the headboard was full of these bugs. We bombed the house and have had an exterminator come in. We have cleaned and cleaned, washed bedding. I have doctor bills from treating the bites and trying to figure out what they are. This has been very frustrating and embarrassing. I am full of scars from these bites
Call Wayfair and tell them. We just did and they agreed to pay our exterminator fees and refund the headboard. They may agree to pay for hospital bill.
We also had that happen. It cost us over 3000 to get rid of them.
How do I become apart of lawsuit? We are currently going through this with Wayfair. Purchased a headboard in May 2019 that was infested with bedbugs.
please add me as my headboard was infested as well!
I have experienced a bed bug issue with a Wayfair as well. I have documented every photo, scars from scratching like a crazy person in my sleep. I’ve screen shot many reviews of the same product with the same problem..please help!
We have also had a huge issue with bed bugs after purchasing 2 headboards and frames from Wayfair. Everything is new in our condo…total gut and renovation, all new furniture. We first noticed a beetle like bug. I squished it and it had blood…not good but that was it until a few days later my husband found the same thing. So we stripped everything down. The primary location of the bugs was in the zipper area of the padded head board. Literally hundreds of them. We zapped them first with rubbing alcohol then with commercial spray. We ripped off the headboard backing after treating it and threw it out. Washed EVERYTHING! I have been stripping beds and washing constantly. spraying morning and night. Freaks me out! I checked the other headboard but it seems to be OK. It has not been used only our headboard. I freaked out about spread and was worried about our new sofa. so far so good. Please add me to the class action suite.
I just discovered the same! I ordered a frame from Wayfair maybe five months ago. Started noticing bites but couldn’t find any bugs on my mattress so I figured it was something else…. till I saw one. It was on the cloth headboard. I then looked all around the frame and found about 6 more hiding in the zippers on the back.
Luckily so far that’s all I’ve seen and began trying to bug profs my apt.
I had to throw away a frame and foam top I also got from them.
Seemed so legit and was a good frame till this issue popped up.
Please add me
My house is riddled with bed bugs after buying a bed in may. Any help on wher to go from here? Got exterminators coming in the am and they already confirmed it’s coming from the bed. My gf has been destroyed by these things and swelled up all over from a allergic reaction and has been to the dermatologist and treated. I have been going through all my stuff for 2 days and washing drying as well as killing everyone by hand that I see. They seem to be absolutely everywhere and now I see tiny ones starting to crawl on the ground and I’m freaking out. Please help somebody please help
I have same issue with bed bugs, I started experiencing bug bites in the last view weeks, having purchased the Etelvina upholstered platform bed in March of last year through Way Fair. I recently called Wayfair to let them know of the issue and they would only issue me a store credit.
For the last year I’ve been seeing a dermatologist/Allergist trying to figure why Im having AAllergic reactions they put me prednisone, Famotidine Allergra, testing me for Autoimmune disorders.
I don’t know if I am applicable I am in Canada. Hiwever I purchased a bed frame and headboard in January and the past 3 months I have been being bitten. Tonight I finally found them…OMG disgusting. What do I do?
Same thing here purchased a headboard and now I have to have my entire house treated, :-(
