Green field of soybeans against blue skyAn Alabama man has filed a Roundup cancer lawsuit against the agrochemical company Monsanto, alleging that their glyphosate-based herbicide Roundup caused him to develop peripheral T cell lymphoma cancer, a type of non-Hodgkin’s lymphoma.

Roundup Cancer Lawsuits

According to Fortune, months after a San Francisco court ordered Monsanto to pay $289 million in damages to a plaintiff claiming that the chemicals in the herbicide Roundup had caused him to develop cancer, the agricultural company is facing yet another lawsuit. The San Francisco trial is the first Roundup cancer lawsuitof what are expected to be thousands of claims against the corporation. Plaintiff Hardy P. of Birmingham, Ala. filed his
lawsuit on Jan. 16, 2019. Hardy claims in the lawsuit that he was exposed to Roundup from 2003 or 2004 until 2017, when he was diagnosed with peripheral T cell lymphoma.

Hardy claims to have used Roundup for performing lawn maintenance as part of his lawn care business. For 4 to 6 weeks in the summer every year, Hardy claimed that he sprayed Roundup five days a week. He would mix the solution himself, and wore neoprene gloves, goggles and a paper mask while spraying.

However, according to his Roundup lawsuit, these items did not fully protect his skin from the chemicals and often the wind would carry the spray back into his face.

Is Roundup Safe?

Hardy claims that he did not know that exposure to Roundup or the herbicide’s active ingredient, glyphosate, was linked to cancer until November 2018, months after his diagnosis of cancer in January 2017. His Roundup cancer
lawsuit claims that Monsanto “knowingly, affirmatively, and actively concealed safety information concerning Roundup.”

According to Monsanto’s webpage regarding Roundup, “When it comes to safety assessments, no other pesticide has been more extensively tested than glyphosate. In evaluations spanning four decades, the overwhelming conclusion of experts worldwide, including the EPA, has been that glyphosate can be used safely according to label instructions.”

However, in early 2015 the International Agency for Research on Cancer (IARC), part of the World Health Organization, released an evaluation of the safety of glyphosate. According to IARC studies, glyphosate can cause damage to human cells on a chromosomal level.

The IARC classified glyphosate as “probably carcinogenic to humans.” The most common cancers associated with Roundup and glyphosate include non-Hodgkin’s lymphoma, lymphocytic lymphoma, lymphocytic leukemia and multiple myeloma.

Who is at Risk?

Monsanto has been marketing glyphosate-based Roundup as a safe herbicide since 1974. Beginning in 2001, glyphosate was the most common pesticide in the United States, and as of 2013, glyphosate was the most-used pesticide ingredient in the world. Roundup is often used by farmers and lawn care professionals, as well as hobby gardeners. Hardy’s Roundup Lawsuit is Case No. 2:19-cv-00093-JEO, in the U.S. District Court for the Northern District of Alabama, Southern Division.
