Younique Moodstruck Fiber Lashes Class Action Settlement

Younique recently agreed to pay $3.25 million to resolve claims that they deceptively marketed their Moodstruck 3D Fiber Lashes mascara as consisting of “100% Natural Green Tea Fibers.”

The settlement will benefit consumers who purchased Younique Moodstruck 3D Fiber Lashes between October 2012 and July 2015 while residing in California, Ohio, Florida, Michigan, Minnesota, Missouri, New Jersey, Pennsylvania, Tennessee, Texas, or Washington.

Plaintiff Megan Schmitt filed her Younique class action lawsuit in 2017 and was later joined by other plaintiffs. The plaintiffs claimed that instead of green tea fibers, the Moodstruck mascara is made of shredded nylon fibers. The plaintiffs say they would not have purchased the mascara or paid as much for the product if they were not deceived by the company’s representations.

In August 2019, Younique and the plaintiffs agreed to a settlement under which the makeup company would pay $3.25 million to resolve the claims against them. Younique has not admitted any wrongdoing under the settlement.

Under the settlement, each Class Member will be able to recover an equal share of the net settlement fund after the deduction of attorneys’ fees, court costs, administrative costs, service awards, and other expenses. After these deductions, payments will be determined based on the number of claims filed.

In order to benefit from the settlement, eligible Class Members need to file a valid Claim Form by Jan. 21, 2020. The deadline for exclusion and objection is also Jan. 21, 2020. The final approval hearing is scheduled for April 6, 2020.

Who’s Eligible

Consumers who purchased Younique Moodstruck 3D Fiber Lashes between October 2012 and July 2015 while residing in California, Ohio, Florida, Michigan, Minnesota, Missouri, New Jersey, Pennsylvania, Tennessee, Texas, or Washington.

Potential Award

Each claimant will receive a pro rata portion of the settlement fund after various fees and expenses are deducted.
