Top Class Actions viewers are starting to receive checks in the mail from the Younique Moodstruck Fiber Lashes class action settlement and from the Washington Motel 6 ICE class action settlement.
Younique Moodstruck Fiber Lashes Class Action Rebates
Younique Moodstruck settlement Class Members who filed a valid claim are beginning to receive payouts ranging between $33 and $136.
Class Members included California, Ohio, Florida, Michigan, Minnesota, Missouri, New Jersey, Pennsylvania, Tennessee, Texas, and Washington consumers who purchased Younique Moodstruck 3D Fiber Lashes between October 2012 and July 2015.
The $3.25 million class action rebates resolves claims that Moodstruck mascara was falsely advertised as being made with “100% Natural Green Tea Fibers.” The plaintiffs say that despite marketing to the contrary, the mascara was actually made of shredded nylon fibers.
According to the Schmitt vs. Younique class action settlement, the plaintiffs and Class Members would not have purchased the Moodstruck 3D Fiber Lashes if they had known the truth about the marketing claims.
Younique did not admit any wrongdoing in the case and agreed to pay the $3.25 million to settle the Schmitt vs. Younique class action lawsuit claims against them.
The deadline to file a claim for the Younique Moodstruck Fiber Lashes class action rebates passed on Jan. 21, 2020. The settlement was granted final approval on April 8, 2020.

The Younique Moodstruck Fiber Lashes Class Action Settlement is Schmitt vs. Younique LLC, Case No. 8:17-cv-01397, in the U.S. District Court for the Central District of California.
Washington Motel 6 ICE Class Action Settlement
Washington Motel 6 guests who had their information sent to U.S. Immigration and Customs Enforcement agents are starting to get payouts from a $12 million class action settlement.
According to a class action lawsuit, Motel 6 had a company policy of providing ICE with information related to guests with Latino-sounding names.
This information was provided without the ICE agents establishing probable cause or giving Motel 6 employees any kind of warrant.
Class Members who had their information shared with immigration were able to claim $50 per person; Class Members who were then questioned by ICE agents could claim $1,000; and those who experienced removal proceedings could claim $7,500.
In addition, the Motel 6 class action settlement requires the company to be in compliance of Washington’s anti-discrimination laws.
The deadline to file a claim for the Motel 6 ICE class action settlement passed on Dec. 31, 2019.
The plaintiffs were represented by Mitchell Riese and Andrea Brenneke of the Washington Attorney General’s Office Civil Rights Division.
