Westlake TCPA settlement

A proposed settlement has been reached in a class action lawsuit alleging Westlake Services LLC d/b/a Westlake Financial Services used an automatic telephone dialing system and/or a prerecorded or artificial voice to call cell phones without the prior express consent of the person called, in violation of the Telephone Consumer Protection Act (TCPA).

If you received a call on your cell phone from Westlake or on behalf of Westlake that used an automatic telephone dialing system or prerecorded voice between Jan. 11, 2012 and Nov. 7, 2013, you may be entitled to compensation from the class action settlement.

Westlake has agreed to create a $10 million settlement fund to resolve the TCPA class action lawsuit, to be distributed on a pro rata basis to eligible claimants.

If approved, this Westlake Financial class action settlement will resolve allegations that Westlake violated the TCPA by making calls to consumers’ cell phones using an automatic telephone dialing system, prerecorded or artificial voice without the consumers’ prior express consent. Westlake denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty associated with ongoing litigation.

Class Members who wish to exclude themselves from or object to the Westlake TCPA settlement must do so no later than June 21, 2016.

Who’s Eligible

Class Members of the Westlake TCPA settlement include: “All persons to whom Westlake, its agents and/or its independent contractors between January 11, 2012, and November 7, 2013 placed a telephone call using an automatic telephone dialing system or an artificial or prerecorded voice to the person’s cellular telephone in connection with the confirmation of a loan applicant’s references.”

Potential Award

Up to $150.

The $10 million Settlement Fund will be distributed to claimants on a pro rata basis. The actual amount each Class Member receives will depend on the total number of claims filed. However, the maximum amount a claimant can receive from the TCPA class action settlement is $150.

    Hey guys the checks are legit and a blessing. When a large entity such as Westlake QSF violate your rights we have even larger entity such as Duchene who will and has fought for smaller people’s on our behalf. Lets be thankful and cash your checks. To God be the GLORY!

    People are receiving and cashing the check. Try cashing instead of deposit. Or go inside the bank. They are legitimate checks! Read in the comment section for further info. I was Leary as well. I received the “postcard check”, my first time seeing one ever. I went to a local store and they were Leary, but a check is a check.

    This check looks extremely questionable. It also says, security document in flourescent ink. I can’t see it. How the hell are we supposed to cash them, legitimately, if it doesn’t have the watermark on it? I’ve never seen a check like this.

      I received a check but there is no where to sign the check. I need to call cuz this is a problem so not sure whether it is real. I didn’t see the security document info either as it states tbus a red flag

    I recvd. A $48.61 check yesterday, but my mobile deposit didn’t take it…is it even a real check? I want to take it into my bank, where would i even sign in the back? It is like a postcard…. Anyone else know if this pstcard type check it legit, did anyone’s bank cash it? Thank you
