A proposed settlement has been reached in a class action lawsuit alleging Westlake Services LLC d/b/a Westlake Financial Services used an automatic telephone dialing system and/or a prerecorded or artificial voice to call cell phones without the prior express consent of the person called, in violation of the Telephone Consumer Protection Act (TCPA).
If you received a call on your cell phone from Westlake or on behalf of Westlake that used an automatic telephone dialing system or prerecorded voice between Jan. 11, 2012 and Nov. 7, 2013, you may be entitled to compensation from the class action settlement.
Westlake has agreed to create a $10 million settlement fund to resolve the TCPA class action lawsuit, to be distributed on a pro rata basis to eligible claimants.
If approved, this Westlake Financial class action settlement will resolve allegations that Westlake violated the TCPA by making calls to consumers’ cell phones using an automatic telephone dialing system, prerecorded or artificial voice without the consumers’ prior express consent. Westlake denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty associated with ongoing litigation.
Class Members who wish to exclude themselves from or object to the Westlake TCPA settlement must do so no later than June 21, 2016.

Who’s Eligible
Class Members of the Westlake TCPA settlement include: “All persons to whom Westlake, its agents and/or its independent contractors between January 11, 2012, and November 7, 2013 placed a telephone call using an automatic telephone dialing system or an artificial or prerecorded voice to the person’s cellular telephone in connection with the confirmation of a loan applicant’s references.”
Potential Award
Up to $150.
The $10 million Settlement Fund will be distributed to claimants on a pro rata basis. The actual amount each Class Member receives will depend on the total number of claims filed. However, the maximum amount a claimant can receive from the TCPA class action settlement is $150.

I received a check today for $48.61. Which is not enough for all they put you through. I told them that the car was broke down in my driveway come get it, they still called all of my references hounding them. Asking if they knew the address where I was hiding the car!
I got one too, Did you cash it?
My experience was not good. Westlake called me sometimes 4x a day during the course of my loan. I had contractually finished paying off the car, BUT owed some old interest/late fees. Made arrangements to pay them on a Friday. They came like a thief in the night and repossessed my car on a Wednesday. When I called to discuss and pay the fees as previously agreed to, they wanted to charge me $800 more than what was owed. No, I didn’t have it. So they took my car and sold it at auction, BUT ended up owing me money back. Personally, I would not recommend them to finance a car. However, sometimes we have to do what we have to do.
The exact thing happened to me. This is as if I were telling this story!!!!

When can we expect our checks and the amount??
The pro rata share of the Net
Settlement Fund for each of the 117,821 claims is $49.789138 (cont.), slightly more than the
$49.78 each member will receive. It is not economical to disperse this remainder to the class.
Combined, the remainders are expected to equal $1,076.66.
The second is any uncashed checks, a hypothetical amount. The intention and
expectation is for the entire Settlement Fund to be dispersed to Settlement Class Members who
have submitted claims
I’m not sure why I recieved a letter from them t participate in the law suit. I had a prepaid phone that was not connected to my address or name at that time. And I’m sure most people do not remember if an automated number called them then. I am Just wondering if they sent these out like spam to see how many they could get to respond.
They thrented to sue me many times
They once sensed me a bill for $20,000. It was for a $10 items plus $19990 for interest and pernaties.
