The money transfer service Western Union has agreed to pay $8.5 million in order to settle a class action lawsuit that alleged the company violated the Telephone Consumer Protection Act (TCPA).
Lead plaintiff Jason Douglas filed the Western Union class action lawsuit after claiming to receive an unsolicited text message he believes was sent to thousands of wireless telephone numbers. According to the Western Union TCPA class action lawsuit, Douglas received the following text spam in 2014:

The Western Union class action lawsuit states that Douglas never gave prior express written consent to receive text messages from the company which is required under the TCPA.
The Telephone Consumer Protection Act is a federal law that restricts companies from making robocalls with prerecorded messages, unsolicited cell phone calls, unsolicited text messages, and unsolicited advertising faxes.
Western Union denies every allegation of wrongdoing but agreed to the terms of the TCPA class action settlement in order to avoid the cost of further litigation.
Who’s Eligible
The Western Union TCPA class action lawsuit settlement includes all Class Members in the United States who received one or more unsolicited text messages sent by or on behalf of Western Union between March 12, 2010 and Nov. 10, 2015.
Potential Award
$250 (estimate)
Western Union has agreed to give each Class Member a portion of the $8.5 million Settlement Fund. The TCPA class action settlement estimates this to average about $250 for each valid claim; however, depending on the number of claimants, the cash payout could be more or less.
For example, if 1 percent of Class Members submit valid claims, each would receive approximately $706. However, if 5 percent of Class Members submit claims, each would receive about $140.
Proof of Purchase
N/A.
While the Western Union settlement does not require a proof of purchase, in order to receive a cash award Class Members must submit a valid Claim Form no later than Feb. 22, 2016. Only one Claim Form per Class Member may be submitted.

An appeal was filed on May 3. According to PACER and the court docket, one non-plaintiff thought she should be included in the class settlement (despite being a Western Union member, and therefore never receiving “unsolicited” texts). Her demand for special dispensation was denied.
She has now filed an appeal of this denial. So, presumably we’re in for another round of litigation before any checks are mailed.
Seriously? Wow.
Please tell me that this appeal has been denied.

The latest, straight from the Court docket:
– Status hearing was set for Jan. 9. But the judge struck the hearing and re-set it for Jan. 15.
– Status hearing set for Jan. 15 was stricken by the judge and re-set for Feb. 26.
– Status hearing set for Feb. 26 was stricken and re-set for Apr. 8.
Over the course of this litigation, a scheduled status or motions hearing has been stricken from the schedule and pushed back to a later date 18 separate times.
So when will we get paid?! They extended the date, ok .. that was 3 months ago. Still nothing? What’s the holdup?!
Lawyers shouldnt get any until the last check is cashed. Or maybe pay a penalty. 3 years is ridiculous
