Class action rebates from four settlements are now in the mail, with settlement checks ranging from around $5 to over $200.

Top Class Actions readers have reported receiving class action rebates worth $247.83 in the mail in connection with a Western Union TCPA class action settlement deal.

Class action rebates were sent to individuals who received one or more unsolicited text messages sent by or on behalf of Western Union between March 12, 2010, and Nov. 10, 2015.

Plaintiffs in the Western Union class action lawsuit claimed the money transfer service sent unsolicited text messages to thousands of consumers. According to the complaint, these texts were sent without recipient consent and therefore violated the Telephone Consumer Protection Act (TCPA).

TCPA is a federal law that prohibits businesses from sending automated texts, calls or faxes for telemarketing purposes without a recipient’s express prior written consent. Violations of the law could result in statutory damages of up to $1,500 per violation.

Western Union did not admit to violating TCPA or any other law but agreed to pay $8.5 million to resolve the claims against it. This settlement fund was estimated to provide cash payments of around $250 to Class Members who filed a valid claim form by Nov. 25, 2018. Actual class action rebates ended up slightly less than estimated, at $247.83.

The Western Union TCPA Class Action Lawsuit is Douglas v. The Western Union Co., Case No. 1:14-cv-01741, in the U.S. District Court for the Northern District of Illinois.

Mass. Navient Solutions Settlement Checks

Our readers have also reported receiving checks worth $100.13 as part of a Massachusetts Navient Solutions class action settlement.

This settlement benefited Massachusetts customers of Navient Solutions who received more than two calls or texts within a seven-day period between March 7, 2013, and Feb. 6, 2020.

The Navient Solutions class action lawsuit challenged phone calls made by the student loan servicer. Allegedly, the company placed frequent calls in an attempt to collect on outstanding debts — actions which the plaintiffs contend violated both their privacy and Massachusetts law. Specifically, these actions reportedly violated the Massachusetts Consumer Protection Act and Massachusetts Debt Collection Regulations.

Navient did not admit to any wrongdoing in the case, but agreed to resolve the claims in a $4.5 million class action settlement deal. The deal was set to provide pro rata or proportional payments based on the net settlement fund and the amount of claims filed. Actual class action rebates came out to $100.13.

In order to benefit from the deal, Class Members had to file a valid claim form by June 26, 2020.

The Navient Solutions Class Action Lawsuit is Andrew Horton v. Navient Solutions Inc., Case No. 1773CV002, in the Superior Court of the Commonwealth of Massachusetts for the County of Bristol.

Class action rebates of $262.62 have reportedly been sent to our readers and other Class Members as part of a Wells Fargo class action settlement deal.

Payments were sent to individuals who had an unauthorized account opened, an unauthorized application submitted, or who received identity protection services through Wells Fargo between May 1, 2002, and April 20, 2017.

The Wells Fargo class action lawsuit centered on a well-known scandal in which the bank’s employees allegedly opened false accounts on behalf of consumers in order to meet unattainable sales goals. The 2015 complaint claimed Wells Fargo intentionally created an unhealthy environment in which its employees were forced to open unauthorized accounts in order to keep their jobs. These actions allegedly led to financial harm for the plaintiffs and other consumers.

Wells Fargo has not admitted any wrongdoing. However, the company agreed to a massive $142 million settlement to resolve the claims against it.

Class action rebates from the settlement vary depending on the fees Class Members were charged and if they sustained injury to their credit report. Our readers have reported receiving checks of $262.62 from this settlement.

Class action rebates were only available to Class Members who filed a valid claim form by July 7, 2018.

The Wells Fargo Class Action Lawsuit is Jabbari, et al. v. Wells Fargo & Co., et al., Case No. 3:15-cv-02159, in the U.S. District Court for the Northern District of California.

N.Y. Charmin Freshmates Settlement Checks

Settlement checks worth $4.20 have been reported by our readers in connection with a New York Charmin Freshmates class action settlement.

The settlement benefits New York consumers who purchased Charmin wipes with the word “flushable” on their packaging between May 23, 2011, and March 6, 2020.

According to several class action lawsuits against Procter & Gamble, Charmin Freshmates wipes were falsely advertised as flushable. In reality, these products can allegedly clog plumbing and septic systems — causing financial harm to consumers in the form of costly repairs.

Charmin maintains its products perform as advertised but agreed to establish a settlement fund to resolve the claims against it. If Class Members filed a valid claim form by June 25, 2020, they could receive class action rebates of up to $50.20. Exact payments depend on the number of products purchased and whether consumers have proof of purchase. Our readers have reported settlement checks of $4.20.
