A settlement has been reached in a class action lawsuit alleging WEN hair products caused some users to suffer hair loss, hair damage or scalp irritation.

If you purchased and/or used WEN hair care products, you may be entitled to compensation from the class action settlement.

Hundreds of plaintiffs have filed class action lawsuits against the manufacturers of WEN after they allegedly suffered hair loss and/or scalp injuries after using the hair care products.

One of the first WEN class action lawsuits was filed by plaintiff Amy Friedman of Florida. She says that she purchased a WEN Cleansing Conditioner product and began losing significant amounts of hair within two weeks of using the product.

Friedman says she relied on claims suggesting that “WEN is gentle enough to use every day” and that “WEN isn’t like an ordinary shampoo so you want to use more of it, not less.”

According to the WEN class action lawsuit, the defendants knew that the products suffered from a serious design defect but failed to warn consumers that WEN hair care products could cause significant hair loss.

In July 2016, the U.S. Food and Drug Administration launched an investigation into the WEN hair care products after it received a number of reports from consumers about the products.

In December 2015, the parties began mediation in order to resolve the WEN class action lawsuits.

Defendants Guthy-Renker LLC and WEN by Chaz Dean Inc. deny the allegations but have agreed to a class action settlement in order to avoid the cost and risk of trial. They have agreed to pay more than $26 million to settle the WEN hair care class action lawsuit.

The WEN class action settlement was preliminarily approved on Oct. 28, 2016.

If you would like to opt out of or object to the WEN class action settlement, you must do so no later than Feb. 10, 2017.

Who’s Eligible

Class Members of the WEN hair care settlement include consumers who purchased for personal or home use at least one of the following WEN products between Nov. 1, 2007 and Sept. 19, 2016:
• Cleansing Conditioner
• Re-Moist Mask
• Treatment Mist Duo
• Treatment Oil
• SIXTHIRTEEN Ultra Nourishing Cleansing Treatment
• Re-Moist Intenstive Hair Treatment
• Styling Crème
• Anti-Frizz Styling Crème
• Nourishing Mousse
• Volumizing Treatment Spray
• Replenishing Treatment Mist
• Defining Paste
• Straightening Smoothing Gloss
• Smoothing Glossing Serum
• Glossing Shine Serum
• Finishing Treatment Crème
• Volumizing Root Lift
• Texturizing Spray
• Detangling Treatment Spray
• Men Control Texture
• Men Hair and Body Oil
• Bath Body and Hair Oil
• Texture Balm

Potential Award

Up to $20,000.

Tier 1: Class Members can file a claim for a one-time payment of $25 for claims of personal injury after using WEN or alleged false statements regarding WEN.

Tier 2: Class Members with Documented Adverse Reaction Claims for personal injuries such as hair loss, hair damage, scalp irritation and emotional distress may submit a claim for up to $20,000.

NOTE: Payments may be reduced on a pro rata basis depending on the total number of valid claims filed.

Proof of Purchase

Class Members who submit a Tier 2 claim must provide evidence supporting their damage to hair and/or scalp; duration of physical injury; emotional damage; out-of-pocket expenses and/or medical history. The following forms of evidence will be accepted by the Settlement Administrator in support of a Tier 2 claim:

• Before and after photographs showing damage to your hair and/or scalp
• Video testimony by the Class Member describing the claimed injury
• Medical records, doctors’ notes, test results and/or a statement from a licensed medical professional about the hair loss or scalp damage
• Written or video statement from the Class Member’s hair stylist about the amount of hair loss suffered
• Written or video statements from other witnesses who can testify about the damage to the Class Member’s hair and/or scalp and the effect it had on the Class Member.

  • Proof of purchase is not required to submit a Tier 1 claim. However, Class Members must declare under the penalty of perjury that all the information provided in the Claim Form is true and correct.

UPDATE 4: As of December 29, 2017, all appeals to the Wen class action settlement have been dismissed.  It is not known at this time how quickly claims will be paid.  Top Class Actions will continue to provide updates as we learn more.

    I started using Wen about three years ago, i used it off and on when i noticed my head started to itch so i stopped using the product but i wasnt sure if it was the cause of my itch so since i have so much of the stuff and spent so much money i decided to give it another try. Well all of a sudden i started feeling blisters and scabs and an itch so intense i wanted to pull my own hair out and on top of this i started to notice my once healthy shiny full head of hair was breaking and falling out! When i heard about this happening to hundreds of other people i stopped using it, over 7 months ago but it is worse than ever i have never experienced anything like this and i dont know when its going to stop. My hair is still breaking and falling out and to add to the stress im not sure if it will grow back, my hair was my best feature but not anymore.

    I and my wife both used several products of Wen and started losing hair after a while. We changed products and in time the loss stopped. No big problem and we will probably go back to using Wen 3-4 times a month. If you look a little you can find it a little cheaper in different places…..

    i continued to use the Wen product not thinking it was it because the price i paid for it not once did i think it was the Wen product but now i no longer use my head does not itch and my hair is finally starting to grow back, i was so devastated when i heard it to be due to the Wen Care product, but now i no it was for a fact, you just never no now days even the rich do bad just to get more richer, skeeming and scamming selling mess like this that has totally embarrassed me so bad depression, days nights weeks of crying humiliation…
    not wanting to go outside my house, nor to work.

    I have suffered hair loss ad haemorrhage kept my hair short due to loosing so much. I was using the product thinking it was good for me, an d it turned out to be the biggest mistake of my life.

    Yes, I used Wen and suffered hair loss. 3 bald spot, which I had to have injections in my head. My hair has grown back. But I’m a hair stylist so it was very upsetting to me to be seen with bald spots at work, since this is what I do for a living, is hair! So hopefully I will be compensated for this very distressful situation.

    Can a claim be filed for each product you purchased. For example, I purchased the cleansing conditioner as well as the Replenishing Treatment Mist. I have purchased several other products this is just for the sake of an example. I am asking this question for my sister and two of my friends. I will be filing Tier 2 but they will be filing Tier 1 and even have proof of purchase as do.I although I.know it is not necessary for Tier 1. It is time I face the truth after going through extensive medical testibg to eliminate why my hair would be falling out and everything came back perfectly normal for my heath and it is so upsetting because my hair is just not even close to being the same and I stopped using the products a little over 2 years ago. My husband also suffered hair loss and he has a thick head of hair and so does everyone in his family and his hair is also not quite the same but nothing compared to mine as I had hair that was mid back in length and I used a great deal of product each time. I am devastated as my hair was my best asset. I initially went to my family doctor, a neurologist, and an endocrinologist just to name a few and countless tests were run so this is a real issue and not some made up scam as I have heard many people say. I am so confused as to how it works fine for some and not for others. That makes it even more scary to me but I am happy for those that love the product but I still feel it should be banned as I look at myself in the mirror everyday and cry. Worse of all is I started to use this several months before my wedding and the damage was showing immensely by then. So even looking at my wedding pictures causes me pain as my hair looks nothing like the way I had planned and I even had a trial style done of how I wore my hair 6 months before starting WEN and I have pictures and it is night and day as to what my hair actually looked like on my big day and my hair loss only got worse times 10. I don’t understand why this product is allowed to still be sold. I guess it is because it doesn’t impact everyone the same.

    I had to go to a dermatologist to receive injections in the bald spots on my scalp! I’ve never been through anything so traumatic in my whole life! WEN should be required to put warning labels on each bottle or container!They changed the ingredients over the years.

    I can only say good things about Wen it prevented hair loss for me. I’ve used for 2 yrs and love it. I would continue but simply can’t afford it ??. I’m sure there are others that feel as I do. Thanks Chaz

      I do have some hair loss which I do believe is from the Wen Products; however, not severe enough to do anything other than switch to a different product. (FYI: I also wanted to mention to you, the majority of time I purchased the product on eBay & was at least 75% cheaper & I never paid shipping.)

        That probably wasn’t a real Wen product…. 75% cheaper sounds like a knockoff.
