A proposed settlement has been reached in the Wells Fargo inspection fee class action lawsuit, resolving claims that Wells Fargo & Co. and Wells Fargo Bank, N.A. improperly assessed property inspections when a mortgage borrower allegedly fell behind on payments by 45 days or more and charged borrowers for that inspection.

Furthermore, the plaintiffs of the Wells Fargo class action lawsuit claim subsequent inspections of the mortgage property were also allegedly ordered every 25 to 35 days for as long as the borrower remained delinquent in payments.

Finally, the Wells Fargo inspection fee class action lawsuit claims the bank concealed these fees from by consumers by labeling them as “Other Charges” on mortgage statements.

The plaintiffs bring several claims against Wells Fargo in this inspection fee class action lawsuit, including violations of California’s Unfair Competition Law and violations of the Racketeer Influenced and Corrupt Organizations by improperly and illegally assessing and charging property inspection fees.

Wells Fargo denies all liability and wrongdoing in this inspection fee class action lawsuit, but has agreed to settle the case in order to avoid the uncertainty of further litigation and increasing court costs.

Per the terms of the Wells Fargo inspection fee class action settlement, Wells Fargo will pay $27,750,000 to establish a settlement fee to compensate eligible Class Members for damages allegedly incurred by Wells Fargo’s actions.

UPDATE: The Wells Fargo Inspection Fee settlement is currently under appeal.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing  patience. Who’s Eligible

You are a Class Member of the Wells Fargo inspection fee class action lawsuit if you had a mortgage serviced by Wells Fargo and you allegedly owe or paid a bank assessed inspection fee between Aug. 1, 2004, and Dec. 31, 2013.

Potential Award

Varies. Calculations of each Class Member’s portion of the settlement will depend on which settlement category they fall into and how many Class Members choose to participate in the settlement.

Proof of Purchase

Postcard Notices of this Wells Fargo class action settlement will be mailed to eligible Class Members on or before Oct. 17, 2015.

If you are part of the group of Class Members who are part of the “Post Sale” category, then you will need a Claim Number and Control Number in order to submit an online claim form. A complete claim form must be submitted online or mailed in postmarked on or before March 16, 2016.

UPDATE 2 on August 4, 2017: Appeals are resolved and the settlement became final and effective on June 12, 2017.  According to a motion filed with the court on August 1, 2017. the settlement administrator is still working through the claims review and deficiency process.  We appreciate your ongoing patience.     Its a dam shame that the people that get ripped off by big Banks basically get ripped off again by the Big attorneys that are supposedly trying to help the little guy. They should find out who made the call to charge us for the inspection fee and throw him or them the whole board behind bars for steeling from all of us. No settlement unless we can get every cent that we paid for inspections back with 25% interest plus plenty’s. I am sure they have a slush fund with Billions of dollars in it that they can refund us our money back. That will never happen, once again we have a huge corporation that gets away with stealing our money.

    if Jim is correct in there are 2.5 million….27.7 million take a way lawyer fees of 33.3% plus 400 thousand expense fees adds up to 9,640,750 which leaves 18,109,250 to be divided between 2.5 million people that is a total of $7.25 per person….if you round up a penny….if my math is correct

      I was tricked into forclosure status by a promise of Hamp and drown for 7 years and yes I was charged these fee and it was added on to the amount I eventually owed in 2013 when everything was made right. From $150k mortgage to $270k now. I doubt if people who never actually paid the charges ie:short sales, deed in lieu of forclosure, bankruptcy after forclosure, and/or an putstanding balance after forclosure will receive any payments.It sure would be nice to see even a portion of the 84 times I was charged inspection fees….ie some guy coming out to snap photos of my house. I know everyone is saying $8, but I have gotten more than one check for over $500 each from court ordered settlements addressing this Wells Fargo mortgage. This better be the biggest as I was charged over $10k.

        What other settlements were there that you received payouts from? They did the same thing to me! Promised me to put the money we were past due on the end of the loan, and move forward. They never did and would send these people out. They left notes on my door, and talked to my neighbors to see who lives in my house! That was illegal, not supposed to do that, they were hired to just drive by and take a picture. They humiliated me and my family when my husband had brain cancer, they never modified the mortgage and put us into forclosure when we were 3 months past due. We had been 5 months past due 6 months prior, and constintly at 3 months past due and I was trying to send more each month, we were catching up. They came and sis an apprisal and once they found out we owed WAY less then our home was worth that was when they decided to forclose. They knew it would make them money to kick us out. It was horrible! Going through my husband’s cancer and being forclosed on was the worst year ever. They need to pay for their actions. They know if they only gove people 6-8 bucks each then they will probably not cash them too, many people don’t with small checks because they charge you to deposit them at many banks. Including wells fargo banks.

    Yes, I want able to logon into my account. I do see my statements from 2011 until 2013 Other Charges & Property Inspection fees are showing fees being added on my monthly statement.

    The law firm will get around 33% of the claim. The rest will be divided by all of the claimants that can provide information listed on the claim form, when charged, and date etc. You have to file a claim to get any form of payment. The law firm gets paid….the people improperly charged will get little or nothing. Normal class action settlement. This is my opinion, and this is not my first class action settlement concerning mortgage companies.

    This link will answer all your questions. It is a more detailed explanation of the settlement than was on teh card we recieved. In sum, there are three types of class. Two of the three types will not need to submit any documentation. The third will.
