VitaminWater

A class action settlement has been reached in the Vitaminwater deceptive marketing class action lawsuit and resolves the claims brought against the product’s manufacturer, Coca-Cola Co. Coca-Cola and its partner Energy Brand deny the allegations, but have agreed to the Vitaminwater class action settlement in order to avoid further legal expense and the uncertainty of ongoing litigation.

During the 2010 year, a slew of Vitaminwater deceptive marketing class action lawsuits were filed by a number of U.S. consumers alleging the Coke product is labeled and marketed as a healthy drink containing nutrients and fails to adequately inform consumers of the amount of sugar in Vitaminwater.

According to the Vitaminwater class action lawsuit, the plaintiffs claim that Coca-Cola and its partner Energy Brand overstated the nutritional content of the Vitaminwater product, with marketing and label statements such as: “vitamins + water = what’s in your hand,” “this combination of zinc and fortifying vitamins can … keep you healthy as a horse,” and “vitamins + water = all you need.” The plaintiffs further allege that the companies mislead consumers into believing they were purchasing a healthy product, when in fact, Vitaminwater allegedly contains almost as much sugar as brand name Coke.

The presiding Ohio judge granted preliminary approval to this Vitaminwater class action settlement in late September. While this deceptive marketing class action settlement does not provide Class Members with monetary relief, it will ensure that the misleading phrases on the Vitaminwater labels and marketing will be removed and that the Coco-Cola and Energy Brand products will state the amount of calories per Vitaminwater bottle.

Who’s Eligible

According to the Vitaminwater class action settlement website,  Class Members of the Vitaminwater deceptive marketing class action settlement include:

“All residents of the States of Florida, Ohio, Illinois, and Missouri, and the U.S. Virgin Islands who purchased the Product in those jurisdictions from January 1, 2003 up to and including September 25, 2014, except Defendants’ officers, directors, employees, and agents.”

Potential Benefits

The Vitaminwater settlement does not provide Class Members with monetary relief. However, this class action settlement will provide injunctive relief, which will prevent Coca Cola and Energy Brand from making misleading product statements on the labels, packaging, and marketing of Vitaminwater.

Specifically, the companies “will state the amount of calories per bottle of the Product on the front label of the Product; will place in bold type the reference ‘see nutrition facts for more detail’ on the front label of the Product; and will refrain from making certain statements on the Product’s labeling and marketing regarding the Product and the effect of the Product on the structure and function of the body.” This injunctive relief will provide equal benefits to all Class Members.

    dear sir, im claiming the vitamin water class action refund check today. I would like to say that I would like to see more improvement in the vitamin water and I would like to see more of it in the grocery stores too. I shop at giant eagle and the store holds many brands of spring water and Gatorade too. I would like to ask for payment refund check today. asking $500 to $2500. I purchase so much of vitamin water monthly.     Splenda is not really an artificial sweetener, it is made from sugar that has been altered somehow.

    American people have the worse eating habits in the world. We have every diet know to man. Yet, we are the most fatness is people on the planet and we have more health problems, then ever known to man. That because our foods are so filled with chemicals and fillers and others ingredient to make the product last longer. It is not about health and it all about profits. I believe it is time for Americans, to change the way we eat and live and to start cooking more for ourselves and share with each other.

    First place, if people have had medical condition based on Vitamin Water they should seek private attorney. I do not like the crap and trust me and I stay away from all artificial sugars. Read labels. Splenda is not real sugar and made like sugar and it is made from chorine based and into 5 step process. See Dr. Mercola.com. He wrote the book sweet deception. People really need to know everything about sugar. It not only sugars, it our wheat, breads, cereals, corn, meats, dairy and many other chemical products on the market. Like cool whip and the worst thing you can put in your body. It so artificial and it full of chemicals. Fake butter and all the dairy products that have the RBGH or RBST and our factory farm meats. The hidden soy and the book dark side of soy products. Maltodexrin and just makes your want to eat and it also in natural foods as well. It like accent!!! MSG and from GMO. The public needs to know about GMO and the MSG enhances in our foods. That cover it and good luck in research. The bottom line eat more of Palo and more Middle Eastern type of foods. You will be more safe. Also, make you own foods. The wheat belly cook book is very good. Of course the Mediterranean and Palo combine into eating very healthy and also exercise is also very good for all of us.

    Gotta love people. This lawsuit isn’t because of defective products, or poisonous vitamin water. …. The lawsuit is simply coca-cola admitting they lied on the label for advertisement purposes. Jeez Louise, I’m cracking up at the comments where people are trying to blame WATER AND VITAMINS for their health crisis.

    Vitamin water is over rated need to shut coca cola down and nobody is getting 1 penny but the lawyers in this case
