VitaminWater

A class action settlement has been reached in the Vitaminwater deceptive marketing class action lawsuit and resolves the claims brought against the product’s manufacturer, Coca-Cola Co. Coca-Cola and its partner Energy Brand deny the allegations, but have agreed to the Vitaminwater class action settlement in order to avoid further legal expense and the uncertainty of ongoing litigation.

During the 2010 year, a slew of Vitaminwater deceptive marketing class action lawsuits were filed by a number of U.S. consumers alleging the Coke product is labeled and marketed as a healthy drink containing nutrients and fails to adequately inform consumers of the amount of sugar in Vitaminwater.

According to the Vitaminwater class action lawsuit, the plaintiffs claim that Coca-Cola and its partner Energy Brand overstated the nutritional content of the Vitaminwater product, with marketing and label statements such as: “vitamins + water = what’s in your hand,” “this combination of zinc and fortifying vitamins can … keep you healthy as a horse,” and “vitamins + water = all you need.” The plaintiffs further allege that the companies mislead consumers into believing they were purchasing a healthy product, when in fact, Vitaminwater allegedly contains almost as much sugar as brand name Coke.

The presiding Ohio judge granted preliminary approval to this Vitaminwater class action settlement in late September. While this deceptive marketing class action settlement does not provide Class Members with monetary relief, it will ensure that the misleading phrases on the Vitaminwater labels and marketing will be removed and that the Coco-Cola and Energy Brand products will state the amount of calories per Vitaminwater bottle.

Who’s Eligible

According to the Vitaminwater class action settlement website,  Class Members of the Vitaminwater deceptive marketing class action settlement include:

“All residents of the States of Florida, Ohio, Illinois, and Missouri, and the U.S. Virgin Islands who purchased the Product in those jurisdictions from January 1, 2003 up to and including September 25, 2014, except Defendants’ officers, directors, employees, and agents.”

Potential Benefits

The Vitaminwater settlement does not provide Class Members with monetary relief. However, this class action settlement will provide injunctive relief, which will prevent Coca Cola and Energy Brand from making misleading product statements on the labels, packaging, and marketing of Vitaminwater.

Specifically, the companies “will state the amount of calories per bottle of the Product on the front label of the Product; will place in bold type the reference ‘see nutrition facts for more detail’ on the front label of the Product; and will refrain from making certain statements on the Product’s labeling and marketing regarding the Product and the effect of the Product on the structure and function of the body.” This injunctive relief will provide equal benefits to all Class Members.

I never cease to be amazed at the ignorance and stupidity of people. How do they even find their way to a class action settlement web page? UGH!

  2. Sonnie says:

Drank this while i was pregnant, I have epilepsy which is triggered by artificial flavors and sweeteners for two months i drank this to keep myself hydrated. I couldn’t figure out why i had started having repetitive seizures. I finally started reading labels on everything i ate, in doing so i found that Vitamin Water zero calorie was made with an artificial sweetener (Splenda) which is not an all natural sweetener its artificial and was the cause for the seizures, when my son was born his sugar levels would not stabalize which resulted in him being placed in NICU for two weeks. Worst time of my life, not fully understanding whats going on with my son and having to leave him in the hospital after I’d been released. I called the company, all the rep said was she was sorry and didnt even know splenda is an artificial sweetener. No one ever followed up or contacted me after that call.

    1. Chris Richardson says:

Overweight?…..Most babies born with blood sugar problems have an obese parent who let their weight go, and had gestational diabetes. Did you have gestational diabetes? Its not the vitamin water, its you. That would explain it…..and besides, pregnant women (at least according my doctor, wifes doctor, mothers doctor, etc etc) should NOT ingest ANY kind of artificial sweetener while pregnant as this causes pancreas issues, kidney problems later in their life, and is linked to ADHD, Asbergers, and now Autism……….+Good luck.

      1. Sonja Buntman says:

Hi Chris, Its spelled Asperger’s if you please. Asperger’s and Autism are both Spectrum Disorders (ASDs)

    2. Chris Richardson says:

By the way, its been over a year—how is your son? Developmental problems? Signs of diabetes? Everything fine and he outgrew it? I was wondering——————–

      1. carrie says:

        1. MINTA THOMSON says:

          :) agreed!

    3. Tess says:

Go see attorney, yourself and sue based on medical and your son.

    4. Amanda says:

No offense but unless a product is labeled as ALL NATURAL or ORGANIC what the world did you think would be in it? Sure wasn’t full of butterflies and unicorns. I guess the says stupid is as stupid does kind of applies here. For you to turn around and whine to a manufacturer about the fact that they didn’t personally walk you through reading the ingredients shows me that perhaps you need to re-educate yourself about how to properly read labels on a products before you consume them and perhaps since you were pregnant at the time I would think any person who is remotely interested in their pregnancy would be a bit more conscience about what they are ingesting. Can’t blame a manufacturer for your own stupidity. I’m not blaming Jewp for my speeding ticket because they didn’t inform me that the harder I push the pedal the faster I will go. It’s common sense.

  3. DANA says:

  5. Bobby Smith says:

    1. B says:

Sometimes its not about the money. Its about the principality of the matter for the future. For our children reading products’ labels and being mislead. These lawyers work very hard to bring this info to you on this website and deserve to get paid for the work they do. <3 thank you Top class actions . com !

  6. jasmine ortiz says:

    1. sabrina says:

  9. Steven Leaird says:

When on vacation to Florida I drink a lot of Vitamin Water. Unfortunately I live in North Carolina but the purchase was made in Florida. Would I still be eligible for a claim? If so where do I find the claim page.

    1. alan says:

Steven, North Carolina is a bit embarrassed by you today. The settlement provides ZERO $ for consumers. Did you read the lawsuit or my comment above. Please do. Again thats $1,200,000 for the lawyers and zero fo Steven, OK

      1. Ashley Dempsey says:

“Steven, North Carolina is a bit embarrassed by you today.”

        :D

      2. Maya Walls says:

        “…and zero for Steven” ?

  10. alan says:

“The Vitaminwater settlement does not provide Class Members with monetary relief.” I’m guessing if the consumer doesn’t get paid neither do the lawyers. Oh wait, I;m wrong, they still get their millions. Surprising that a few consumers lie on these forms. The lawyers should split their fees for such a lousy job,
    $1,200,000.00 to $0 nice job!!!!!

    1. bigfoot says:

To big to prosecute? BS. Boycott all coca cola products.

    2. Audra says:

Agreed. And I cannot tell you how many bottles of Vitamin Water Ive purchased. I drank one or two of these per DAY. Irritated.
