Verizon Wireless class action lawsuit

UPDATE 3:

  • Verizon Wireless customers have reported to TCA that they recently have received checks in the mail for as much as $52.28 as of early June 2021.

A settlement has been reached in a class action lawsuit alleging that Verizon Wireless improperly billed some of its Family SharePlan customers. If you subscribed to a Verizon Wireless Family SharePlan (FSP) between May 11, 2002 and May 10, 2006, you could be eligible for benefits from the class action settlement.

The Verizon class action lawsuit alleged Verizon improperly billed Family SharePlan customers whose plans provided for different per-minute rates for “after-allowance” minutes used by different phone lines and charged Family SharePlan customers for “In-Network” or “In-Family” calling when these calls should have been free under the customers’ plans. According to the class action lawsuit, Verizon improperly billed customers for different per-minute rates for “after-allowance” minutes used by different phone lines, in violation of its customer contracts and in violation of state and federal law

Verizon denies the allegations but agreed to settle the class action lawsuit to resolve the litigation. The Verizon Family SharePlan class action settlement received preliminary approval on Nov. 19, 2014.

Who’s Eligible

You are a Class Member of the Verizon class action settlement if you are a member of the FSP Settlement Class and/or the In-Network Settlement Class (defined below).

FSP Settlement Class: Includes all U.S. residents who were Verizon Wireless customers and who, between May 11, 2002 and May 10, 2006, were subscribed to a Family SharePlan covering two or more persons with different per-minute rates for minutes used after the shared plan allowance was exhausted (“after-allowance minutes”) and who were assessed charges for after-allowance minutes at a rate higher than the rate associated with the phone used to make or receive the calls after the allowance minutes were exhausted, calculated on a real-time basis.

In-Network Settlement Class: Includes all U.S. residents who were Verizon Wireless customers and who, between May 11, 2002 and May 10, 2006, were subscribed to a Family SharePlan that offered free “In-Network” or “In-Family” calling, and who were charged for “In-Network” or “In-Family” calling.

Potential Award

Members of the FSP Settlement Class and In-Network Settlement Class are entitled to receive an equal portion of the $36.7 million settlement fund that remains after the administrative fees and other settlement costs are deducted. Class Members who are Verizon customers on the date the payments are distributed will receive a bill credit, while former Verizon customers will receive a check.

In addition, Verizon will provide In-Network Settlement Class Members with personal identification numbers (PINs) that will each contain 600 calling units (one calling unit is equal to one minute for a domestic call). These PINs can be used to make domestic or international calls (the number of calling units needed per minute for an international call will depend on the country called).

NOTE: Class Members who received a notice by mail or email, and who do not exclude themselves from the class action settlement, will automatically receive benefits from the Verizon Family SharePlan settlement. If you did not receive a notice but believe you are a Class Member, you must complete and submit a Claim Form.

    Well Im hoping Verizon sees this comment. I’d advice everyone to 1st file your complaints, yes I have multiple complaints regarding thr hidden fees and over charges that their automated system doesnt tell you nor did they inform me of a $10 fee to recieve a paper bill per month. Thats not no where near how crooked they have become since my contract expired April 2017. Since then a a free upgrade to my sons ph and I was offered a free upgrade on my tablet as well. Im alsways hesitate of that word, “Free”,. I just filled with the FCC to stop these extreme overages since only my $10 a month free tablet upgrade which I agreed to but without signing any agreement papers for the free upgrade. My sons free ph upgrade with us on the shared data plan and my ph arent under contract only the free tablet which I have all of my receipts and realized their more hidden charges then appear, like double charging taxes paid up frt also gor devices I didnt get. The had a fee of $20 as a setup fee as well but it wasn’t a complete setup, if you call setting up wizard only for $20 at a Verizon dealer, well I call it BS!! I didnt have my old tablet with to get the sims card and google account on that device im still using. The new one as of april is still in its box and bag I brought it home in. Thats how they trick us inyo taking these free upgrades making us believe its a 2 yr contract and mine is only $10 a month since I took them up on the special offer to get gor trading in my old out dated LG. I got the table free at the discounted rate of $10 a month which applied to the free future upgrads. The agreement/contract Im no longer under other than the keeping it gor 2 yrs @ $10 a mo. I dont think a free upgrade like with my sons device is any different than my tablet that isnt Actually under contract.. When its a free upgrade just as my son’s ph there is no contract other than agreement he signed to pay off the amount of his ph. Once he pays off his device im asking that they unlock our devices through sm claims court and also get all the overcharge’s and hidden fees they aren’t honest about. They are charging me near $30 every month and for what Is the ?!! Its why I filled the complaint with the FCC, long hrs on the ph getting swapped back and forth between hands with the failure to communicate what the unknown waved charges credited to my account, to be told they cant see my receipts so back to customer they send me. 5 + hrs on the ph Sat 2/24/18 still within the 10 day grace period since thats when the next month’s is ready yo to be viewed. These jerks turned off my service without any warning and within that grace period. How can they submit the payment due in the same mo they have your bill ready 30 or 31 days ready to view 1 or 2 days past the payment grace period. They are robbing us folks. Pay attention to your billing cycles and I wouldn’t think you’d owe more when they have your charges ready to view every mo in advance of the the current month’s charges when due. Example, Feb 18th due date and the view date bill for payment for March is ready Feb 28th. Thats pre- calculated amount we owe due March 18th.. 10 days later the cycle repeats itself, pay current fees due and view next month’s bill. So if your late they can & do nail us for charges that arent even due yet. Thats how they get away these hidden charges and overages..
