A $9 million class action settlement was reached with Van’s Food International, Inc. to resolve allegations that the company mislabeled products as “all natural” when they contained artificial or synthetic ingredients. If you purchased any Van’s frozen breakfast products after Jan. 1, 2009, you might qualify for benefits from this class action settlement.
Plaintiff Diana Jill Miloro filed the all natural class action lawsuit against Van’s on April 29. She claimed that Van’s “packaging was false and deceptive in that it led purchasers to believe that” Van’s products were “‘all natural,’ when in fact it included one or more synthetic ingredients.”
This class action settlement applies to Van’s frozen breakfast products such as Van’s frozen waffles, frozen pancakes, frozen french toast sticks, frozen waffle sticks, frozen english muffins or frozen muffin crowns and include the phrases “Van’s Natural Foods,” “Totally Natural,” “Naturally Delicious,” “All Natural,” or another similar phrase.
Under the terms of the all natural class action settlement, Van’s has agreed to remove any “all natural” or “natural” phrases from its products packaging 60 days after the settlement is granted final approval.
Miller’s charges against Van’s included breach of express warranty, breach of implied warranty, and unjust enrichment allegations. Van’s does not admit to any wrongdoing, but agreed to this class action settlement “to avoid the costs, disruption and distraction of further litigation.” A Missouri state judge granted preliminary approval to this class action settlement on June 16, 2015.

Who’s Eligible
This class action settlement is for anyone who purchased Van’s Frozen Breakfast Products from Jan. 1, 2009 until June 16, 2015.

Potential Award
Up to $18 per household.
The amount each claimant will receive from the Van’s class action settlement depends on which of the following 3 tiers the Class Member elects:
Tier 1: Class Members who fill out the Claim Form and who do not have valid proof of purchase may recover up to a maximum of $4.99 per household. This covers about 1.5 Van’s products.
Tier 2: Class Members who fill out the Claim Form and who do not have valid proof of purchase may recover $3.33 per unit up to a maximum of $9.99 per household (the cost of about 3 Van’s products), if they provide additional information about their purchases. Class Members who file a Tier 2 Claim must provide the following information:
- The store(s) at which the Van’s product(s) were purchased;
- The location (city and state) of purchase;
- Approximate date (month and year) of purchase;
- Type of Van’s product(s) purchased;
- Approximate number of units purchased; and
- The reason(s) the Class Member chose to purchase the product(s).
Tier 3: Class Members who fill out the claim form and who provide valid proof of purchase may recover the amount for which a valid proof of purchase has been provided, up to $18 per household.
Proof of Purchase
Proof of purchase is not necessary, but Class Members who provide a proof of purchase will be eligible to receive a greater benefit.
