Toyota Motor Sales USA Inc. has agreed to settle a class action lawsuit alleging the frames in some of its popular trucks were prone to rust, requiring repairs and/or replacement.

If you own or lease (or if you previously owned or leased) a Toyota Tacoma, Tundra or Sequoia, you may be eligible for benefits from the Toyota class action settlement.

The Toyota class action lawsuit, which was initially filed in October 2014 by plaintiff Ryan Burns, asserts that the frames of certain Toyota Tacoma, Tundra and Sequoia vehicles do not have adequate rust protection. As a result, the frames allegedly rust or corrode prematurely.

Burns alleges that excessively corroded truck frames pose a safety hazard and affect the vehicle’s ability to withstand or minimize damage in the event of a car accident. The Toyota class action lawsuit asserts that the rusty truck frame defect renders the vehicles “unstable and unsafe.”

Toyota denies that it engaged in any wrongdoing and maintains that there is no rust protection defect in the trucks. However, the motor company has agreed to settle the rusty truck frame class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

The proposed Toyota class action settlement will provide a free Frame Inspection and Replacement Program to determine whether a Class Member’s vehicle frame should be replaced.

If replacement is necessary in order to meet the Rust Perforation Standard, the frame will be replaced at no cost. Toyota has also agreed to reimburse Class Members who paid for frame replacement due to rust perforation and whose costs were incurred prior to Jan. 3, 2017.

Class Members who would like to exclude themselves from or object to the Toyota truck settlement must do so no later than Mar. 27, 2017.

Who’s Eligible

Class Members of the Toyota rusty truck frame settlement include anyone who owns or leases (or who previously owned or leased) one of the following Toyota truck models:

  • 2005-2010 Toyota Tacoma
  • 2007-2008 Toyota Tundra
  • 2005-2008 Toyota Sequoia

The type of benefits each Class Member is eligible to receive depends on several factors. Class Members who currently own or lease their vehicles will be able to take part in a Frame Inspection and Replacement Program to determine whether the truck’s frame should be replaced. NOTE: The Frame Inspection and Replacement Program will begin after the settlement becomes finalized.

If a Class Member’s vehicle must remain at a Toyota Dealership overnight (or longer), Toyota has agreed to provide a loaner vehicle (with proof of adequate insurance) for up to seven days while the frame is being replaced.

Proof of Purchase

Class Members must submit a Claim Form and supporting documentation, if available, to be considered for reimbursement for a prior frame replacement.

UPDATE: The Toyota Rust-Prone Truck Frame class action settlement was granted final approval on May 21, 2017.  However, appeals to the settlement have been filed.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience.     I am the second owner of a well maintained, always garaged, 2007 Taco, and have very similar problems and same run around by the dealership and Toyota customer service. My truck was in a dealership April of 2017 for the leaf spring recall and dealership said frame had no issues, now has rusting and cracking on the frame 3 short years later. Very disappointed with Toyotas lack of willingness to resolve a problem they are aware of. I will be seeking legal action and probably never buying a Toyota again. So much for high resale value of used Toyotas.

    Went to local Toyota business and they inspected and spray it with undercoating. Now frame is cracked out on both sides body of truck hitting cab of truck. Called the dealership and all they do is tell me that time has expired for frame to be replace on my 2007 Toyota Tacoma. 13 year old truck should not have a bad frame and their fix was a joke. Called Toyota themselves and they give me link that shows me the settlement.

    My question is what good does that do me or anyone else?

    Do we get any reparations from this settlement?

    Who do we contact if so?

    Concerned Veteran of Maine that took vehicle in for inspection and so called fix that didn’t last.

    If possible give myself and others that have commented information to help us soon as possible. It is not right we are down a vehicle for known defects. I see off to the side a box that says start a class action suit.

    Is that what we do to get the ball rolling? Does it cost any money out of our pockets to do this?

    Has anyone contacted any lawyers yet? I also wasn’t notified when I bought my 2005 tacoma a couple years back and just missed the deadline when they replaced my leaf springs last year. Isn’t right that they didn’t notify all who bought the trucks. This is my 4th toyota, dad owns previous one, still have my 94, and my 4Runner was totaled last year in an accident. If this is how I get repaid for being a loyal Toyota lover then this will definitely be my last one and I’ll make sure none of my friends invest in them again.

    my toyota tundra 2005 sr5 4×4 4.7 trd extra cab have frame complete rusted with holes everywhere i contacted toyota corp and my local Johnston toyota dealer at middletown ny 10940 but i all got was a denial response with not help at all i allways garaged and under coated and car washed my truck since new but that did not prevent from this unfair know recall to happen to my truck now i have $37,000 dollar invested plus another 7 thousand on repairs on my driveway that is worth zero.thanks to toyota

    I’ve never been disappointed by customer service like Toyota did to me. After years of being a loyal Toyota Customer , the representative just wouldn’t help out with the really bad and corroded frame. They issued a recall because they knew the Tacoma frame was prone to bad rusting which could be dangerous to drive. When I brought my truck to the service center they said it was fine, and they did nothing. Now it is badly corroded and they said they can’t do anything about it. Toyota will not extend any assistance for any repair because their campaign had expired. What a way to take care of customers! I was even told you drive it at your own risk! It’s up to you to sell it knowing it might not be safe to drive but as for the company, they can not offer anything.

    my 2005 tundra doesnt seem to be in the rusted frame replacement campaign window however the frame is flaking severely and one of the crossmembers towards the rearend of the truck looks unsafe to hold the trucks integrity. when i called the dealership they maintained that they could not find find that year/ser.# in thier campaign ! is there any additional information regarding this year& model tundra that i may research in hopes of finding resolution of this issue? thanks in advance for any direction or possibilities you may assist me in this matter.       i have that same issue with my tundra 2005 in middletown ny i hope they can do something but my 2 attempts i was mistreated and denied responsibility because is not included on their bs campaign by local dealer who sold me truck new long ago and by toyota corp

    Hello, We hope that you can help us with our 2004 Toyota 4Runner with severe rusting that has made the car unsafe to drive as of Aug 2019 with mileage at 119,00. We took it to a mechanic to do a brake job and had to leave the car at the repair shop because the mechanic said the frame rotted out to the point where it is unsafe to drive. We previously reported to the condition of this car numerous times to the Keene, NH dealership who offered no recourse in terms of fixing the problem. We filed the problem with NHTSA on 08/01/13, confirmation #1063247 with mileage of 95,153.
    We need your help. Please respond to us as noted below.

      I had the same problem with my 2000 Tacoma. When I called Toyota they told me I missed the program they offered by a few months and they weren’t willing to help at all. I told them I never received anything and they would say is they sent something to my house!!! I know they didn’t and don’t know what to do about it, my vehicle is not part of the settlement.

    2007 access cab tacoma TRD… just found a lot of very bad rust holes in my truck. Called toyota – said it was outside of the coverage window. I had not seen / heard anything before this. Has anyone found out what can be done? Do we have any recourse other than just scrapping these trucks? I ive in VA – we do get some winter here – but not that much… salt is not the problem.

    I’m just finding out about this rust issue, I was never notified by Toyota. I went to a dealer to purchase a car and they told me my 2005 Toyota Tacoma frame was shot and the truck was worthless! I called Toyota’s corporate office and was told the case was settled and closed. Im reading many people weren’t notified like myself what can be done? This is my second Tacoma and probably my last.

      I had the same problem but a little different my truck was undercoated and they keep undercoating it and they did it three times and now it’s off the frame replacement and I think they did it just to extend the frame life to get it past the date and now I don’t know what to do if anybody could contact me I’d more then appreciate it
