Toyota Motor Sales USA Inc. has agreed to settle a class action lawsuit alleging the frames in some of its popular trucks were prone to rust, requiring repairs and/or replacement.

If you own or lease (or if you previously owned or leased) a Toyota Tacoma, Tundra or Sequoia, you may be eligible for benefits from the Toyota class action settlement.

The Toyota class action lawsuit, which was initially filed in October 2014 by plaintiff Ryan Burns, asserts that the frames of certain Toyota Tacoma, Tundra and Sequoia vehicles do not have adequate rust protection. As a result, the frames allegedly rust or corrode prematurely.

Burns alleges that excessively corroded truck frames pose a safety hazard and affect the vehicle’s ability to withstand or minimize damage in the event of a car accident. The Toyota class action lawsuit asserts that the rusty truck frame defect renders the vehicles “unstable and unsafe.”

Toyota denies that it engaged in any wrongdoing and maintains that there is no rust protection defect in the trucks. However, the motor company has agreed to settle the rusty truck frame class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

The proposed Toyota class action settlement will provide a free Frame Inspection and Replacement Program to determine whether a Class Member’s vehicle frame should be replaced.

If replacement is necessary in order to meet the Rust Perforation Standard, the frame will be replaced at no cost. Toyota has also agreed to reimburse Class Members who paid for frame replacement due to rust perforation and whose costs were incurred prior to Jan. 3, 2017.

Class Members who would like to exclude themselves from or object to the Toyota truck settlement must do so no later than Mar. 27, 2017.

Who’s Eligible

Class Members of the Toyota rusty truck frame settlement include anyone who owns or leases (or who previously owned or leased) one of the following Toyota truck models:

  • 2005-2010 Toyota Tacoma
  • 2007-2008 Toyota Tundra
  • 2005-2008 Toyota Sequoia

The type of benefits each Class Member is eligible to receive depends on several factors. Class Members who currently own or lease their vehicles will be able to take part in a Frame Inspection and Replacement Program to determine whether the truck’s frame should be replaced. NOTE: The Frame Inspection and Replacement Program will begin after the settlement becomes finalized.

If a Class Member’s vehicle must remain at a Toyota Dealership overnight (or longer), Toyota has agreed to provide a loaner vehicle (with proof of adequate insurance) for up to seven days while the frame is being replaced.

Proof of Purchase

Class Members must submit a Claim Form and supporting documentation, if available, to be considered for reimbursement for a prior frame replacement.

UPDATE: The Toyota Rust-Prone Truck Frame class action settlement was granted final approval on May 21, 2017.  However, appeals to the settlement have been filed.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience.     Have a 02 Tacoma that I found out ( after the facts) had a recall for frame corrosion. Was hauling a 67 VW on a car trailer. Went to stop and the rear of the frame gave way dropping the trailer. Clearly see where the corrosion was through the frame and were it gave way. Toyota says they are not fixing it.

    I have a 2007 Sequoia which had the frame corrosion recall and I responded well within the time frame necessary for the corrosion resistant compound warranty period on May 16 2018 they then called me and told me my vehicle was finished and ready for pickup they gave me my receipt saying that the work was done. And I went on my way THINKING that Toyota had done what they said they did it just so happen that on May 3rd 2019 less the a year later I had to look under my truck because I heard a clanking sound whenever i hit a bump so I was checking my shocks and while checking my shocks I noticed that I had a large hole in the frame of my truck I then called Toyota and brought the situation up to them they told me to bring my vehicle into them immediately they took the truck in the back and took pictures and said that they would reach out to Toyota headquarters but because it’s out of the warranty. I may have to get rid of my truck I then stated it may be out of the warranty period now but not when I brought it in for the recall service on May 16 2018 it was well within the warranty period so they got back to me just to say there is nothing they can do BECAUSE IT’S OUT OF THE WARRANTY PERIOD and I’m definitely looking for a lawyer that handles situations like this.

      Did you find a lawyer to handle your case? I have a Tacoma that I took to the dealer in 2010 for the same problem and was told at the time that the frame was still ok but that I would have to bring it back in the future for the work at a later date ( stated right on my receipt)to be done now they are telling me the same thing that it’s out of the warranty period and they will not do anything about it.

    I have a 2007 Tacoma that I had inspected at a local dealership in January and was told the frame looked ok. They set up an appointment in March (their first available appointment) to have the frame sprayed and was told that when they descale it sometimes they find perforations. If that were to happen they would stop and send the pictures to Toyota so they could go ahead and replace the frame. Fast forward to that appointment March 11th and sure enough they found perforations. They contact Toyota and Toyota says it’s outside of the recall time frame so they won’t replace it. The dealership says they should t have told me they would replace it because it was ultimately Toyota decision. I would have gone to a different dealership in January that had more open availability if I didn’t trust that the dealership knew the process and would take care of it. They tell me to contact Toyota. After more the 2 months of Toyota “looking into it” they denied it because it was outside of the time frame.

    I own a 1989 pickup V6 3.0 part of the 6th generation which the 1995 Tacoma is part of no fix for the 1989, a 4 inch high 30 inch long hole rusted all the way thru the frame big enough to put your arm thru just ahead of the rear axle on driver’s side, 85,000 actual miles never own another from this company.Buy American!!

    I have an 04 Tundra that will not pass inspection due to frame rust. Toyota chooses not to stand behind their product because the deadline has passed on the “Limited Service Campaign.” No recall, never received notice of the campaign. Now they tell me sorry but we’re not responsible for what happens in the mail. We’re a big corporation, we don’t care because we don’t have to. Yes, I am very angry about this.

    I have a 2004 Toyota Tundra with frame issues, I had taken to a dealer and the mechanic said the frame is rotted and going to give away / May 4th 2019. I am still making truck payments the truck will not pass inspection.

      The fox guarding the hen house! The dealer checked my frame and said it was fine. Now my mechanic tells me it is dangerous for me to drive my truck 3 short years later. Toyota says now it’s to late and it’s not their fault, they can only go by what the dealer says. It is a Toyota dealer, so who is Toyota? I got screwed by putting my faith in Toyota. Perhaps I should take the dealer to court.
