Toyota Motor Sales USA Inc. has agreed to settle a class action lawsuit alleging the frames in some of its popular trucks were prone to rust, requiring repairs and/or replacement.

If you own or lease (or if you previously owned or leased) a Toyota Tacoma, Tundra or Sequoia, you may be eligible for benefits from the Toyota class action settlement.

The Toyota class action lawsuit, which was initially filed in October 2014 by plaintiff Ryan Burns, asserts that the frames of certain Toyota Tacoma, Tundra and Sequoia vehicles do not have adequate rust protection. As a result, the frames allegedly rust or corrode prematurely.

Burns alleges that excessively corroded truck frames pose a safety hazard and affect the vehicle’s ability to withstand or minimize damage in the event of a car accident. The Toyota class action lawsuit asserts that the rusty truck frame defect renders the vehicles “unstable and unsafe.”

Toyota denies that it engaged in any wrongdoing and maintains that there is no rust protection defect in the trucks. However, the motor company has agreed to settle the rusty truck frame class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

The proposed Toyota class action settlement will provide a free Frame Inspection and Replacement Program to determine whether a Class Member’s vehicle frame should be replaced.

If replacement is necessary in order to meet the Rust Perforation Standard, the frame will be replaced at no cost. Toyota has also agreed to reimburse Class Members who paid for frame replacement due to rust perforation and whose costs were incurred prior to Jan. 3, 2017.

Class Members who would like to exclude themselves from or object to the Toyota truck settlement must do so no later than Mar. 27, 2017.

Who’s Eligible

Class Members of the Toyota rusty truck frame settlement include anyone who owns or leases (or who previously owned or leased) one of the following Toyota truck models:

  • 2005-2010 Toyota Tacoma
  • 2007-2008 Toyota Tundra
  • 2005-2008 Toyota Sequoia

The type of benefits each Class Member is eligible to receive depends on several factors. Class Members who currently own or lease their vehicles will be able to take part in a Frame Inspection and Replacement Program to determine whether the truck’s frame should be replaced. NOTE: The Frame Inspection and Replacement Program will begin after the settlement becomes finalized.

If a Class Member’s vehicle must remain at a Toyota Dealership overnight (or longer), Toyota has agreed to provide a loaner vehicle (with proof of adequate insurance) for up to seven days while the frame is being replaced.

Proof of Purchase

Class Members must submit a Claim Form and supporting documentation, if available, to be considered for reimbursement for a prior frame replacement.

UPDATE: The Toyota Rust-Prone Truck Frame class action settlement was granted final approval on May 21, 2017.  However, appeals to the settlement have been filed.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience.     I hope they let you trade it in like last recall.. i would rather update then just have frame replaced….
    had my truck inspected by my mechanic and there are holes in it …Come on Toyota !! lets get this right !!

    When can we begin to have our vehicles inspected and fixed? Do we have to wait for the final hearing or will toyota inspect and replace frames now?

    I have a 2002 Toyota Tacoma and I have rust in the bed of my truck. I feel this year should also be included in the lawsuit. How do we get this included? I only have 63,000 miles on my truck and have rust in the bed. I would like to have the bed replaced to match the rest of the truck that is in pristine condition. How do we get 2002 included in this lawsuit?

      Reading the other comments, I am more concerned than ever. I’m seeing rust in the bed, I don’t know about the frame. I can’t get under there to take a look. And my year is not included. Who decided the years? If we have older trucks and they have rust, the years should be adjusted to include them.

        just dont go under and look at the frame… will not be pretty. (most are rusting from the inside out so what ever rust you see on the outside its hundred times worse on the inside) mine just broke in half!!

        these frames were criminal. they are very dangerous and should not even be allowed on our roads. someone is going to get killed. a number of these trucks have almost killed machanics when they folded in half while being up on a lift for repairs!

        were is our government agencies on this??? how many have to be hurt or killled?

    I have a 2004 Toyota 4Runner and it has extensive Rust on the frame too! Why is it not included in this?

    I have a 1999 4Runner with frame issues that make the truck worthless since it would cost more to repair than the truck is worth. I wish they would include the 4runners in this too. I also own a 2005 Tundra that was repaired in the earlier frame recall and now my 2005 Sequoia will have to be inspected for this when I take it in for all the air bag recalls. I used to love Toyotas but I also have the problem with the vsc trac system and Toyota refuses to repair it.

    Wish someone would help out those of is who own Ford Escapes and have found them turning into a dangerous pile of rust with shock towers that break loose. Ford acknowledges that there is a problem but don’t do anything.

    MY 2000 TOYOTA LIMITED 4 RUNNER HAD 80,000 MILES ON IT WHEN I BROUGHT INTO DEALERSHIP TO CHECK OUT BEFORE TAKING ATRUP TO MICHIGAN AND WAS TOLD FRAME WAS SO RUSTED IT WAS DANGEROUS TO DRIVE!!!!!!!!!! I COULD NOT GET BACK INTO THE SUV AGAIN IT COST ME 43,000! AND LOOKED BRAND NEW! EXCEPT FOR THE FRAME!

    My mother and I have a 2006 Toyota Rav 4 and a 2007 Toyota Sienna. Both cars have extreme rust under the car on frames. Does this class action cover these models? Obviously it is a continual problem with Toyota vehicles.

    I have had a similar isue with my 2008 buick enclave. GM avoids responsibility for many issues wiht this model. i have had the engine replaced within 5 years and the transmission year 6 or 7. i wish there were a class action for this vehicle as there shouyld be

    I own a Toyota Tundra 2005 with rusted out frame I called Toyota corporation yerterday and told them my truck have rust holes and please include my truck on this campaign cuz tacomas and sequoia share same frame manufacturer and years but they refuse to help me now I am hopeless with a truck I can’t inspect on ny state anymore cuz those frame holes make my truck un safe no welder wanna repair it cuz they say is not safe for me and I wonder why Toyota only will fix some model and not other and my answer and because they tease us on 2014 with a under coated recall my truck was painted with the paint but at 2016 I have big rust holes and Toyota claimed they all ready did help me under coated recall for me this is not right Toyota is not a company you can trust anymore never a Toyota again for me

      You had the undercoating done and it rusted anyway? That’s not cool. You should contact the dealer who did the undercoating and see if they warranty their repair.

        let me explain this ONE MORE TIME…..

        the rusting out of the frames on toyota’s from WITHIN because of CRAPPY STEEL. the steel is sub par and the contaminates rot it FROM THE INSIDE OUT!

        coating the steel will NOT help as many have learned. (like putting a bandaid on a broken leg)

        the frame MUST BE REPLACED (or the car junked.)

        replacement on a frame is aprox 17,000 dollars.

        even if toyota replaces your frame, its a very extencive job and they can do much much more harm then good with such a task. and seeings its not even the factory that is doing the repairs its even more problematic.

        who covers the isuses that come from the new frame swap? toyota will just blame it on the shop that did the swap, the shop will blame it on toyota.

        see how this is going to go???

      yes, there are way many more vihicles that have rotted rusted frames (shocking in some cases as new as the cars or trucks are) the only reason some are covered is because of someone filing a lawsuit. (thats why some are not)

      i think toyota could go bankrupt if they were forced to pay for all these LEMON cars.

      i agree, (i was a big fan of the old toyotas) but i will never buy another one unless they can prove to me they have fixed the frame corrosion issues. (and i think millions of other toyota owners feel the same)

      we may see toyota go under over this issue.
