Toyota Rav 4 Class Action Settlement

The Toyota RAV4 class action settlement will resolve a class action lawsuit, entitled Milligan v. Toyota Motor Sales, USA, Inc., that alleges some 2001-2003 RAV4s equipped with automatic transmissions have experienced a “harsh shift condition.” When this occurs, the vehicle may suddenly not shift smoothly and/or it may exhibit harshness in shifting operations during driving. The “harsh shift condition” may be attributed to a malfunctioning Electronic Control Module (ECM).

Toyota denies wrongdoing but has agreed to establish a class action lawsuit settlement to resolve the litigation.

Who’s Eligible

Class Members of the Toyota RAV4 class action lawsuit settlement include all persons in the United States, including the commonwealth of Puerto Rico, who currently own or lease or formerly owned or leased a model year 2001 through 2003 Toyota RAV4 equipped with an automatic transmission. (Toyota previously mailed a notice regarding this issue to current owners as part of a separate Customer Support Program. However, this class action settlement expands that Customer Service Support Program to include prior owners and lessees.)

Potential Award

Class Members can receive the following benefits under the Toyota RAV4 settlement:

(1) Warranty Enhancement. Toyota will continue to provide a warranty enhancement to any Class Member, for a period of 10 years or 150,000 miles from the Class Vehicle’s in-service date, whichever occurs first, for a harsh shift condition and/or illumination of the check engine light with the following codes: P0750, P0753, P0755, P0758, and/or P1760.

(2) Reimbursement Under the Existing Customer Support Program. Toyota will continue to offer reimbursement to current owners pursuant to the existing Customer Support Program. The class action settlement will extend this reimbursement to prior owners.

(3) Reimbursement for Repair Costs. Class Members who paid for a repair or replacement of the ECM and/or automatic transmission for the specific condition covered by this settlement during the enhanced-warranty period will be reimbursed.

To submit a claim form for reimbursement, you must download a claim form at www.RAV4ECMSettlement.com and mail it, along with the required documentation, through December 31, 2014.

Class Members who fail to submit valid reimbursement claims during the Reimbursement Period will not receive a payment from the RAV4 ECM settlement.

Proof of Purchase

Repair receipts are required for reimbursement.

    I had the same issue just this month I sent my ECU to a gay on ebay he rebuilt the ECU and updated to the newest Software also cost $85.00 total my Rav4 2003 runs and shifts great again I stopped driving as soon as the trans started to shift weird so no trans damage was done

    I have a 2002 Rav4 with 113,000 miles on it. I just took it into the shop for harsh shifting and found out that I have a faulty ECM that has ruined my transmission. Toyota is refusing to pay for anything. Im having to pay $4,000-7,000 for a mistake that is not mine. How is this ok?! I also had a faulty check engine light a couple years back that they refused to pay for, another $1,000 out the window. Glad that some people got their money back but this is really unfortunate for those who are in my boat and have missed the deadlines. Something should be done here.

      I have a 2003 RAV4 with less then 92.000 miles on it and are having issue with the harsh shift. My mechanic said it is the computer that control the transmission which will cost me $2,000 to $3,000. I have never received any letter regarding the ECM issue and am the original owner to the vechicle. I called the Customer Experience Center at 800-33-4331 and was told that I missed the boat. The warranty was only good until December 2013. :-(

    I have a 2003 Rav 4, Got the recall letter. have 53,800 miles on it. transmission is harsh shifting. I guess I’m out of luck.

    We bought a 2001 Rav 4 Toyota in Feb of 2014. We have 145,000 miles on it. Did not know of any class action lawsuits on this. Are we eligible to be reimbursed for the module repairs we are having done right now? Thanks

    Im in the same boat as above. My 2003 Rav4 needs a new transmission at 130,000 miles. Mechanic says it will cost $4,000 to repair. Am I too late? Was December 2014 the cut off date for reimbursment? Help!

    I just purchased a 2003 Toyota Rav4 with 92,000 miles on it at the end of March 2015. It felt completely unsafe to drive, but after new tires, new struts, new oil and fuel filters, two new wheel bearings, a new transmission, a new ECM…it still needed new fuel, evap, and pipe assemblies and lines…maybe it will be ok now?!?! I was able to track the last owner through the title and she had paid for a new drive shaft, a new propeller shaft, cooling system flush, a new transfer case seal, a heat shield repair, and a clamp on the catalytic converter. I feel completely ripped off. I used to like Toyota and Im hoping they will do the right thing. Also, I feel that the dealerships should be advocating to Toyota for their customers, but they probably get paid less for recalls so they pretend recalls dnt even exist. This disappoints me,. Safety, ethics, and trust all thrown out the window (if the electric controls still work) for a few more dollars. Woe is me.

    My car had over 150,000 miles when I found out about the Settlement. I have had the Computer rebuilt 3 times at my expense. This does not seem fair. I still do not know if the problem is with the transmission or the computer. Cannot sell it as is so guess I will drive it til it drops.

    I own a 2003 RAV4 that has problems with the transmission now. I never heard about this class action lawsuit until yesterday. Anyone know what we can do? I am extremely upset we had until Dec 2014 to do anything about this. I had never heard about it until yesterday, which was June 24, 2015. Grrrrrr. Can you help me?

    Todays date is June 11 2015. I bought a 2002 Toyota Rav4 back in 2010 with no knowledge of this settlement. I just received my car back from the Toyota dealership service informing me I will need to replace the transmission and ECU today. It has 138,670 miles on it. Who do I contact about this? I called Toyota and they said they weren’t going to be able to help me.

      Hello. I also have a 2002 Rav 4 that also needs the ECU and transmission replaced. There was a extended warranty for this issue. The related statements about this have been negative. Have you had any luck finding out the reason Toyota will not fix this recall? Thanks
