Toyota Rav 4 Class Action Settlement

The Toyota RAV4 class action settlement will resolve a class action lawsuit, entitled Milligan v. Toyota Motor Sales, USA, Inc., that alleges some 2001-2003 RAV4s equipped with automatic transmissions have experienced a “harsh shift condition.” When this occurs, the vehicle may suddenly not shift smoothly and/or it may exhibit harshness in shifting operations during driving. The “harsh shift condition” may be attributed to a malfunctioning Electronic Control Module (ECM).

Toyota denies wrongdoing but has agreed to establish a class action lawsuit settlement to resolve the litigation.

Who’s Eligible

Class Members of the Toyota RAV4 class action lawsuit settlement include all persons in the United States, including the commonwealth of Puerto Rico, who currently own or lease or formerly owned or leased a model year 2001 through 2003 Toyota RAV4 equipped with an automatic transmission. (Toyota previously mailed a notice regarding this issue to current owners as part of a separate Customer Support Program. However, this class action settlement expands that Customer Service Support Program to include prior owners and lessees.)

Potential Award

Class Members can receive the following benefits under the Toyota RAV4 settlement:

(1) Warranty Enhancement. Toyota will continue to provide a warranty enhancement to any Class Member, for a period of 10 years or 150,000 miles from the Class Vehicle’s in-service date, whichever occurs first, for a harsh shift condition and/or illumination of the check engine light with the following codes: P0750, P0753, P0755, P0758, and/or P1760.

(2) Reimbursement Under the Existing Customer Support Program. Toyota will continue to offer reimbursement to current owners pursuant to the existing Customer Support Program. The class action settlement will extend this reimbursement to prior owners.

(3) Reimbursement for Repair Costs. Class Members who paid for a repair or replacement of the ECM and/or automatic transmission for the specific condition covered by this settlement during the enhanced-warranty period will be reimbursed.

To submit a claim form for reimbursement, you must download a claim form at www.RAV4ECMSettlement.com and mail it, along with the required documentation, through December 31, 2014.

Class Members who fail to submit valid reimbursement claims during the Reimbursement Period will not receive a payment from the RAV4 ECM settlement.

Proof of Purchase

Repair receipts are required for reimbursement.

    I just bought a 2002 for my daughter and at 151,000 the ECM failed. Toyota states our vin showed ok\ and there were no issues with the ECM however, I am skepical. May I add she is 7 months pregnant when this happened and the shifting was very violent. Do I have any recourse?

    I have Toyota Rav4 2003. I have a hell of time to deal with Toyota any dealers.They are programmed to sell a “junk” for thousands of dollars,then program the car until 150,000 milage is done, and deny it.
    I did submitted claim and never recover money.
    Everyone!!!!!
    should not buy a Toyota.
    Claim is a big scam.!!!!!!

    I have a 2002 Rav4 and transmission started messing up. Now it’s costing me $ 4400.00 to rebuild it. I talked to company and they said they aren’t going to fix it. Even though they have a recall on my car about the same thing. What should I do

    I purchased a 2002 Toyota RAV4 from the original owner July 2013. 14 months later, transmission gone. Per diagnostics at service center, both transmission and ECM faulty. Do I qualify for settlement?

    Are there any class action lawsuits for the 2008 Rav4? I have taken my car in for service every 5K miles and just had it in for the 70K service. Now 2K miles later they tell me the transmission fluid was burned and I need a new transmission. In all 5K services they are to check transmission fluid and condition. Wouldn’t they have noticed the “condition” of the fluid at that time? I purchased the services at the time I bought the car (5 years or 100K miles) and my 5 years were up in June, 3-1/2 months ago. I only have 74K miles on the car.

    My RAV4 is a 2002, I’ve owned for 12 years and it now has 95,455 miles on it.
    Low miles but just this week the transmission started acting up. Slow to go into gears, then major hesitation and harsh shifting. Followed up with first notice in
    2009 ECM module and had authorized Toyota dealership look at it. Have records,
    that say everything OK. Now problems but according to all the data I have read I am way past the date to file a claim (Dec. 2011). What can I do? I’m extremely hesitant to drive this car and feel it is not safe.

    I just bought my friend’s 2002 Rav4 3 mos ago with 45,525 original miles on it. She normally drove surface streets in a 20 mile area and had all servicing performed at the Toyota Dealership where she bought it. Now I have transmission problems with harsh shifting. Can I get the transmission rebuilt under this lawsuit?
    What records do I need?

    I own a 2001 Rav4 and it has been shifting weird or harshly for a while and I am just about to take it in to see what’s what. Would I qualify for reimbursement?
