The manufacturer Stevia In The Raw has agreed to pay more than $1.5 million in order to settle a class action lawsuit that alleges the company deceptively labeled its product as “all natural.”

If you purchased at least one Stevia in the Raw brand Consumer Product containing the phrases “natural,” “all natural” or “100% natural” in the United States between Oct. 9, 2009 and July 1, 2014, you may be eligible for a cash payment.

Lead plaintiff Leslie Frohberg of New York accused Stevia In The Raw maker Cumberland Packing Corp. of misleading customers by the “natural” claims listed on sweetener packages.

According to the Stevia class action lawsuit, the label prominently states that Stevia In The Raw is a “100% Natural Zero Calorie Sweetener” and Frohberg says she paid more because she believed it to be natural.

However, the Stevia In The Raw class action lawsuit states that Cumberland conceals from customers that ingredients dextrose and maltodextrin are derived from highly processed GMO corn, in part by stating that they are “natural carbohydrate[s].”

Frohberg alleges that by labeling the sugar substitute as “natural,” “all natural” or “100% natural,” Stevia In The Raw manufacturer has “profited enormously.” She claims that there were less expensive sweeteners available to customers but Class Members were willing to pay extra for a “natural” product.

In addition to the Settlement Fund, Cumberland has also agreed to stop using the phrases “100% natural” or “all natural” on packages or labels of its Stevia In The Raw products.

Cumberland denies that its advertising and labeling of Stevia In The Raw is deceptive but has agreed to the terms of the Stevia In The Raw class action lawsuit settlement in order to avoid the cost of further litigation.

A federal judge preliminarily approved the Stevia class action settlement on Dec. 16, 2015.

UPDATE: On Apr. 6, 2016, the Stevia In The Raw settlement was granted final approval.

UPDATE 2: On Aug. 31, 2016, the settlement agreement states that payments to approved claimants will be made within 120 calendar days of the claim deadline.

UPDATE 3: On Sept. 10, 2016, Top Class Actions readers who submitted timely and valid claims for the Stevia In The Raw class action settlement started receiving checks in the mail worth as much as $16!

Who’s Eligible

Stevia class action settlement Class Members include all U.S. residents who purchased Stevia In The Raw product for personal use between Oct. 9, 2009, and July 1, 2014. The Stevia In the Raw package must have contained the terms “natural,” “all natural” or “100% natural.”

Potential Award

$2-$16

Class Members may receive $2 for each package of Stevia In The Raw containing the terms “natural,” “all natural” or “100% natural” that was purchased between Oct. 9, 2009 and July 1, 2014, up to a maximum of 8 packages.

N/A

No proof of purchase is required but in order to receive payment, Class Members must file a Claim Form. Only one Claim Form is permitted for each household.

    I had NO idea this product had GMOs in it! I am beyond upset! I have a big box recent purchased from Costco. I have been using this sweetener since it came out! How on earth will I ever figure out how much I used? This is so upsetting, because I am so anti-GMO, Thanks, Stevia in the Raw for misleading me. I have purchased my last three boxes at Costco. I have also bought it in stores before Costco membership.

    I used Stevia and received a free trial offer also,ni used the date when I had surgery and the doctor took me off SUGAR and switched me to the sweetener, that’s how I remember

    I see in comments mentions of not having receipts, I estimated to the best of my knowledge the dates of purchase as asked. Nobody can actually recall the exact dates purchased. Be honest as to which product you use(ed), the approximate date you began using and go from there. You know how often you go through a box of the packets and where you purchase them. This is what is required of you as basically stated in the directions.

    I always got the stevia product and I know when I did my shopping cause I shop for the month. Same time every month unless it’s for odds and ends.

    I am beyond disgusted!! This company should be driven out of business. GMOs NEED TO BE BANNED but Monsanto has their hands in the politicians pockets! And Hillary does not see a problem with GMOs or why they should be labelled? As a former attorney for Monsanto, of COURSE she will say GMOs are fine to consume. DISGUSTED! THE FDA FAILED US AGAIN!

    I started using this product exclusively a few years ago. I tried the Walmart generic brand a few months ago and found it bitter. Now I find this lawsuit. I’m so disappointed! And I just read agave isn’t that great a sugar substitute, either.

    I purchased this a number of times. The claim for is asking for month/day/year, there is no way I can recall those exact dates, What do I do? I want to be honest, but don’t have that kind of memory, also shopped at at least 4 different stores in town.

      The demand for details of date is a sleazy trick used to deter legitimate claims. Who keeps receipts for such trivial purchases? Take your best guess.
