Sprint retail employees may be eligible for compensation thanks to a $7.6 million class action settlement.
The Class includes any individual who worked as a non-exempt employee at Sprint retail stores during the following periods:
- At any time from Feb. 28, 2018, to Dec. 31, 2020, in Arizona
- At any time from Feb. 28, 2016, to Dec. 31, 2020, in Colorado, Ohio, or Washington
- At any time from Feb. 28, 2013, to Dec. 31, 2020, in New York
Those who filed an Opt-In Consent Form to assert federal Fair Labor Standards Act (FLSA) claims in the class action lawsuit by Jan. 8, 2021, also will be eligible for compensation.
Sprint, now part of T-Mobile, is one of the nation’s largest mobile carriers.Â
Plaintiffs in a class action lawsuit had alleged Sprint did not compensate non-exempt employees for all hours worked, arguing employees had worked off the clock to perform opening and closing procedures, attend mandatory conference calls, and perform other tasks.
Sprint has denied the accusations put forth in the class action lawsuit, but both the defendant and plaintiff have agreed to a settlement in order to avoid the ongoing cost and risk of continuing with litigation.
Seventy percent of the net settlement amount will be allocated for the Class Net Settlement Amount, while the remaining 30 percent will be allocated for the FLSA Net Settlement Amount. The money will be distributed as follows:
- 6.6 percent to Class Members in the Putative Arizona Class
- 8.4 percent to Class Members in the Putative Colorado Class
- 58.8 percent to Class Members in the Putative New York Class
- 10.3 percent to Class Members in the Putative Ohio Class
- 15.9 percent to Class Members in the Putative Washington Class
These Class Members will receive a proportionate share of their Class’ allotment, based on their number of workweeks in their respective state.
Those who filed an opt-in form will receive a proportionate share of the FLSA Net Settlement Amount, based on their respective number of workweeks as compared to the total number of workweeks of all opt-in plaintiffs during the Settlement Period.
Some individuals will be eligible for both types of payment; separate checks may be issued.
A final approval hearing will be held July 7, 2021.
The deadline to request to be excluded from or to object to the settlement is May 26, 2021.
The deadline to file a workweek dispute is also May 26, 2021.
