Wells Fargo has agreed to pay $2 million to end claims it did not properly pay its home mortgage consultants and other employees.
According to lead plaintiff Rich Hallman’s class action lawsuit, Wells Fargo paid him and Class Members based on sales commission, failing to pay them for all their rest breaks and minimum wage, as well as overtime and vacation pay.
Wells Fargo allegedly paid Hallman and others advances on commissions at about $12 per hour. However, the company then allegedly “clawed back the hourly advances” from employees’ commissions.
Hallman says he worked for Wells Fargo from about October 2015 to November 2017 in Everett, Washington.
Hallman claimed he and Class Members were not compensated for non-sales time such as meetings, customer surveys, open houses, and working certain nights and weekends, among other things.
These failures amounted to a violation of Washington law, the class action lawsuit argued.
Hallman alleged Wells Fargo’s conduct caused himself and Class Members damages, including loss of wages.
Hallman also alleged he and the Class Members did not knowingly submit to Wells Fargo’s wage violations.
According to Hallman, under Washington law, employers violating the state’s minimum wage laws under the circumstances alleged in his class action lawsuit are liable for twice the amount of wages that were improperly withheld.
Anyone who worked for Wells Fargo in Washington as a Home Mortgage Consultant, Home
Mortgage Consultant, Jr., Private Mortgage Banker, or Private Mortgage Banker Jr. at any point between Aug. 14, 2015, and the date of the preliminary approval of the settlement.
The $2 million settlement includes about $667,000 for attorneys’ fees, as well as $50,000 in litigation costs, and $10,000 as a representative service award for Hallman.
