Google and staffing agency Vaco Technology Services have agreed to pay $1.5 million to resolve claims they failed to properly pay certain workers.

Plaintiff Christiana Bush filed a class action lawsuit in 2017, accusing Google, Vaco, and other defendants failing to provide Class Members with meal and rest periods, failing to pay overtime and double time wages at the correct rate, failing to reimburse for all necessary business expenses, failing to provide accurate written wage statements, and failing to pay final wages in a timely fashion after separation of employment.

The proposed settlement establishes two Classes: a California Class and a Fair Labor Standards Act (FLSA) Class.

The California Class would be made up of anyone employed by Vaco in California who was assigned to work for Google as an order audit operation specialist, content bug technician, expedition associate, and/or expedition team lead at any point between Aug. 12, 2013, and  the date the settlement receives preliminary approval.

The FLSA Class would consist of anyone employed by Vaco in the United States, but outside California, as expedition associate and/or expedition team lead at any point between Aug. 12, 2014, and the date the settlement receives preliminary approval.

California Class Members will not need to file a claim form in order to benefit from the settlement; they will automatically receive checks by mail.

Members of the FLSA Class will need to opt in to the settlement.

At the time the settlement agreement was reached, Vaco estimated there are 217 Class Members, 110 in the California Class and 107 in the FLSA Class.

These employees worked an estimated 10,061 workweeks — 1,752 exempt employee workweeks and 8,309 non-exempt employee workweeks — during the Class Periods.

After attorneys’ fees and other expenses are paid from the settlement fund, Class Members will receive payments.

Each Class Member is expected to receive an estimated payment of $4,356, assuming none of the Claifornia Class Members opt out and all FLSA Class Members opt in to the settlement.
