Santander Bank agreed to pay $800,000 to resolve claims it charged unlawful convenience fees when consumers paid their car loans over the phone or online.

The settlement benefits individuals who had a car loan with Santander in Texas and paid a convenience fee when making a car payment over the phone, internet or through interactive voice response since Jan. 13, 2016. 

Santander Bank, formerly known as Sovereign Bank, is a Pennsylvania-based bank that has expanded into nine other states. The bank boasts 149 million customers across the world, $67.1 billion in U.S. deposits and $89.5 billion in U.S. assets.

According to a class action lawsuit, Santander violated the Texas Debt Collection Act (TDCA) by charging convenience fees to consumers making loan payments online or over the phone. These fees allegedly added up to $10.95 to payment amounts.

Plaintiffs in the class action lawsuit claim Santander’s “pay-to-pay” fees violate the TDCA, which prohibits collecting interest or additional fees on debts unless those fees are “expressly authorized” or “legally chargeable.” The fees charged by Santander are allegedly neither expressly authorized by account agreements or legally chargeable under Texas law.

The class action lawsuit also challenges Santander’s representation of these fees. Santander allegedly represents the pay-to-pay fees as a payment to a third party payment processing company. In reality, Santander pockets “nearly the entire amount” of the fees, the class action lawsuit contends.

Santander Bank hasn’t admitted any wrongdoing but agreed to pay $800,000 to resolve these allegations.

Under the terms of the settlement, class members can receive a cash payment. 

Payments will vary depending on the amount each class member paid in convenience fees. Class members who paid a higher amount in convenience fees will receive a larger share of the settlement fund. No payment estimates are available.

If the settlement is approved and no appeals are filed, payments are estimated to be sent around Dec. 26, 2022.

The settlement also provides credit repair benefits. Santander will request that credit bureaus delete related information from credit reports within 60 days of the settlement effective date.

If funds remain after the distribution of settlement payments, the money will be donated to Arkansas Jump$tart Coalition — a nonprofit organization which aims to improve financial literacy amongst young Arkansans. 

The deadline for exclusion and objection is Aug. 29, 2022. 

The final approval hearing is scheduled for Oct. 13, 2022.

No claim form is required to benefit from the settlement.

    Well I also have a loan with them and they are definitely a rip off overcharged they repo my car paid to get it back but it seems like it’s never ending, well I decided to go over all my payments and transactions and I can see how they kept charging interest after the repo and take majority of the money for interest, so as I’m reading everyone post the conclusion I’ve came too is it’s time for all of us to contact media and make them aware and try to get legal help that’s the only way we are going to get results that’s how these class action suits come into play, without the help of an attorney we will get no justice. Santander knows exactly what their doing and that people trust and sometimes never look into it like me I’ve been paying breaking me to keep this car yet I’m still paying they add extra fees it’s totally ridiculous how they are getting over.

    I am currently involved with a car loan from Santander and I have had such a headache with them and as well been charged all kinds of extra fees. They repossessed my vehicle in July and had it less than 24 hours I paid the owed balance with extra fees and then had to pay to western union it to them and got my vehicle back and they still listed it as a repo and refuse to take it off my credit and the amount they have listed as the amount owed is incorrect and way more than it really is. I as well would like added to this suit as I’m still coming out of pocket for these fees

    I’m making a car payment of 366.00 a month and 42 is going to the principal! I hate this company and the car dealership who got me involved with these people!!!

      They cost me so much PREDATORY LOAN I barley made it from the dealership to the car repair shop across town! LEMON 🍋 they knew it too! You will never get your auto paid off with them, my Mom went through them as well decided to return the car, contacted them had to force them to come get the car and they are still trying to bill her for the car!!

        I recently got a check for a whopping $4.62. Had my loan from December 2016 – August 2021. Paid $10 fees every month and $4.62 is my share of the class action. Keep ya eye out for that big old check. Can’t even buy a carton of eggs with it!

      I paid almost $10 a month for 4.5 years to pay my car payment via debit card by phone and got a massive $4.62 check. Don’t hold your breath on class actions!!!

    Not sure if this should be addressed but I sold the car that had the Santander loan and the company that bought the car was suppose to of paid off the Santander Loan. I now find out that Santander has a $29 charge that was not paid and it is on my credit. They should have been paid off and I should not have a balance. How can they do this when they were suppose to of been paid off and they removed the lien on the title.?????

    This has been a terrible experience and also completely screwed my credit and my husband’s up it’s ridiculous how they even get away with this..

      We had a car for 5 years never was able to 0ay it off they talk us into getting another one with lower Apr and bla blah blah well 3700 dollars later we fixed a control arm on the vehicle then it still drives messed up we tried to call and get out of loan but noone would help us now we have completely screwed our credit up and no vehicle
