Residents of North Carolina who paid water and sewer impact fees to the Greenville Utilities Commission may be eligible for compensation in the form of a payment as a result of a nearly $1.6 million utility fees class action settlement — no proof required.
Settlement Class Members include North Carolina residents who paid the Greenville Utilities Commission to receive water or sewer service and incurred impact fees between Aug. 24, 2015, and June 30, 2018.
Plaintiffs allege the Greenville Utilities Commission collected water and sewer service capacity fees during the Class Period. These actions, per the class action lawsuit, were in violation of North Carolina law.
While the Greenville Utilities Commission denies its actions were unlawful or wrong, it has agreed to the proposed settlement.Â
The Court did not make a ruling regarding this matter, so it was never determined whether the Greenville Utilities Commission was in violation of the law. It also remains unclear whether the capacity fees were fairly levied for the utility system’s expansion.
The Greenville Utilities Commission serves 165,000 customers, according to its website.
As part of this class action settlement, the commission has agreed to establish an overall settlement fund of $1.557 million.Â
First, the attorneys’ fees, settlement administrators’ fees, and other lawsuit costs will be paid out. From there, the remainder of the fund will be distributed to Class Members who submit a claim.
Class Members are eligible to receive 100 percent of the paid impact fee but no more than 100 percent of the total capacity fees they paid between Aug. 24, 2015, and June 30, 2018.Â
If more Class Members than expected submit valid claims, this percentage may be reduced.
Eligible Class Members who want to get their rightful payment must submit a timely claim. Class Members do not need to include supporting evidence or proof of payment with the claim form.Â
Class Members who fail to submit a claim will not be eligible to get a payment and won’t be able to seek out a future claim regarding this specific situation.
The Court granted final approval in the Greenville Utilities Commission fees settlement at a Nov. 15, 2021, hearing.
The deadline for Class Members to exclude themselves has passed.
The deadline to file a claim in the utility fees settlement is Feb. 12, 2022.
