LG washing machine defect

UPDATE:

  • On May 7, 2021, the 10th Circuit Court of Appeals affirmed the Samsung top-load washing machine settlement.
  • It is not known at this time how quickly claims will be paid.
  • Top Class Actions will continue to provide updates as we learn more.

A Samsung washing machine class action settlement has been reached, resolving allegations that a defect in certain top-loading models caused the lids to come off, damaging the area around the washer.

If you purchased one of more than 30 models of a Samsung top-loading washing machine, you could get a full refund of the purchase price of the washer and up to $400, along with other benefits, from this class action settlement.

Class Members must be the original owner who purchased the washing machine new. A list of included models is available here.

Samsung was hit with a class action lawsuit alleging their top-loading washing machines contain a defect that caused lids to detach during a wash cycle.

Additionally, the drain pumps on some models allegedly detached or otherwise broke.

According to plaintiffs, the Samsung washing machines presented a safety issue to those who might be around the appliance. They had been known to explode unexpectedly, damaging not only the area they were in, but also potentially injuring those who happened to be around the washing machine.

Samsung issued a recall of the allegedly exploding washing machines in 2016, but consumers complained that the recall was not enough. In addition to not following through, some consumers said that they did not learn of the recall in time to get a refund on their Samsung exploding washing machine.

Lead plaintiffs successfully fought off an attempt by Samsung to dismiss the class action lawsuit. The company argued that the owner’s own insurance should pay for damage caused by the exploding washing machines. A federal judge disagreed and allowed the class action lawsuit to proceed on most of its claims.

There are several tiers of awards under the proposed settlement agreement:

  • The Enhanced Minimum Recall Rebate for Class Members who received a rebate under the recall. These Class Members can receive a percentage of the difference between the rebate amount the estimated purchase price of the washer.
  • The Recall Repair Additional Benefit for Class Members who received a repair under the recall. These Class Member can receive cash rebate ranging from between $25 and $85 toward the purchase of another Samsung appliance.
  • Top Separation Relief is available to Class Members who had the lid of their Samsung washing machine separate. These Class Members may receive a full refund of the purchase price of the washer and up to $400 reimbursement for certain expenses.
  • The Recall Repair Commitment is available to Class Members who opt to have their Samsung washing machine repaired under the recall. These Class Members can receive the repair from a Samsung Authorized Service Provider within 14 days of the request. Alternatively, Class Members can receive a $50 cash-equivalent card if the repair cannot be completed or is not effective.
  • Drain Pump Failure Relief is available to Class Members who experienced a drain pump failure in their Samsung washing machine. These Class Members may be able to receive a repair or reimbursement for their drain pump and up to $400 reimbursement of certain expenses resulting from the drain pump failure.

Class Members will need to submit a Claim Form by Aug. 6, 2019. Samsung washing machine owners may need to provide information about damage or repair expenses.

Those who want to object to the settlement or wish to be excluded from it, have until June 7, 2019 to do so.

I have problems since purchasing my Top Loader washer from Samsung. my clothes come out looking dingy, like they weren’t cleaned, and that’s every load. They did come out to put brackets on, and my clothes were coming out of the washer with rips and holes. The guy said I had to contact Samsung and that he was here just to do brackets. I had contacted Samsung more than once, giving them model # and purchase date. I would get calls back from them stating they were going to reimburse me for the washer. Another time they called and said they were going to send out a check for full refund. I was so happy to hear this, thinking finally they are doing something about this, well never got a check! I don’t understand why they bothered to call if they really weren’t going to do anything!! My clothes at times also didn’t spin out correctly, and bedding, that was a joke, they wanted you to use, I think it’s the waterproof cycle, which was a joke, things came out dripping wet This is the WORST washing machine I have ever owned!! NEVER EVER will I buy a SAMSUNG WASHER!!!! To this day this washer has NEVER cleaned my laundry Correctly! I received a postcard in the mail also about the Washers.

  4. stuart rubin says:

good luck with this class action.I filed for an Electrolux class action regarding mold formation. never received settlement, then they claim no record of my filing but received letter from them asking for further information. It is a shame as we buy the products then get the shaft.

  5. Kathy field says:

I spent over 600 for my top load and it’s the worse machine ever ! It does not drain all the water out so I have to use the spin cycle again . I can only use the quick wash for light clothes but for towels I have to use bedding . Can’t use anything else . Had a repair man come out but it still doesn’t work right . Will never buy a Samsung again !

  6. Rachel says:

I qualify for the enhanced rebate but not drain pump failure, my model isn’t included even though the washer ruptured itself and flooded my house.
What a joke, I will never buy another Samsun product after the absolute lack of customer service I dealt with.

  7. Brandy says:

I am frustrated with Samsung. I purchased my washer on August 15, 2015 making it not even 4 years old. I was never able to run it on the blanket cycle as it was in my laundry room shared with my 4 dogs and I wasn’t taking any chances that the lid would shatter. I put in for the repair within a few weeks of purchase and never heard anything from Samsung until I got a post card in the mail a few weeks ago. I have had non stop issues trying to get it to drain and trying to get it to halfway spin the water out. Finally last week I hit the power button and then start and all I got was a ding. Honestly glad to be rid of it however Madder than a hornet that I wasted $692.98 for this machine and about the same for the replacement. On a stupid washer that never operated correctly. Yet what do we get $156 . No thank you I will never purchase Samsung anything again. Last appliance that went bad was a freezer on the bottom refrigerator. And Samsung wants the original receipt? And the sticker off the back? And a picture of the sticker on the back?
Horrible that they have scammed us all out of a decent appliance.

  8. Arturo villegas says:

My washer is about 3 years old sometimes it doesn’t spin all the way and I have to do it again in spin and sometimes it makes a lot a noise

  9. peggy dragatis says:

It was a poor quality machine and it got moldy. I did have problems with draining and had a repair man twice.

  10. Sherrie says:

When I put my washer in Bulk it don’t spin out all the way
