Quest Diagnostics sign

A $195,000 Quest class action settlement will resolve claims that a 2016 data breach compromised the information of thousands of patients.

The settlement benefits individuals whose information was obtained by an unauthorized third party in the 2016 Quest data breach.

The Quest data breach reportedly took place in November 2016 when unauthorized users gained access to Quest Diagnostics’ MyQuest application.

As a result of the data breach, the information of around 34,000 patients was allegedly compromised. Exposed data reportedly included names, dates of birth, telephone numbers, and even lab results including HIV results.

Plaintiffs in the Quest data breach class action claimed that the company failed to protect consumer information from being compromised. Additionally, the patients claimed that Quest did not provide “timely, accurate and adequate notice” of the data breach.

“Despite the fact that it was storing sensitive Private Information that it knew or should have known was valuable to and vulnerable to cyber attackers, Quest and its fellow Defendants failed to take adequate measures that could have protected user’s information,” the Quest class action lawsuit alleged.

Quest Diagnostics has not admitted any wrongdoing but has agreed to fund $195,000 in settlement payments to affected consumers.

The settlement provides up to $325 in compensation for individuals affected by the Quest data breach. Up to $250 can be collected per patient in compensation for actual monetary losses that resulted from the breach. An additional payment of $75 can be collected by patients who had their HIV test results compromised, regardless if actual monetary losses occurred.

In order to benefit from the settlement, Class Members must file a valid claim form by May 22, 2020. The deadline for exclusion and objection was Jan. 8, 2020. Final approval was granted to the settlement at the fairness hearing on Feb. 25, 2020.

Who’s Eligible

Individuals whose information was obtained by an unauthorized third party in the 2016 Quest data breach.

Potential Award

Up to $325.

Up to $250 is available to compensate actual monetary losses resulting from the Quest data breach. An additional $75 is available for patients who had HIV test results obtained in the Quest data breach.

Class Member ID, sent with notice, is required to submit a claim form online.

    It would have been great if this company had informed its clients that their was a breach. That way we would have the ID # required for file a claim. And now the Class Action Suit is coming to a close and hundreds of thousands of people who used Quest regularly were not even notified. Doesn’t sound right to me.

      It did not affect “hundreds of thousands”. It was 34,000 total. Very limited. It affected me and they sent me a letter and a claim number to file.
