Pella window screen defect

The Pella Corporation has agreed to pay nearly $26 million to resolve allegations that the Pella ProLine brand aluminum clad wood casement, awning and/or transom windows made by the company were defective and leaked.

If you are a current or former owner of structures containing Pella ProLine brand aluminum clad wood casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2009, you may be entitled to cash for actual expenses necessary to fix damages caused by the product.

In 2009, plaintiffs Kent Eubank, Jerry Davis, Ricky Falaschetti, and others, filed a class action lawsuit alleging Pella ProLine windows were defective. The plaintiffs said that defects in the products caused leaking, leading to additional damage, including wood rot in structures.

Pella Corporation initially agreed to a settlement in 2012, but that settlement was shot down because of inequality. The new settlement requires Pella to pay $25.75 million to resolve the class action allegations.

Under the terms of the settlement, Pella Corporation does not admit any liability and has maintained that wood rot can be caused by a number of factors, but Class Members will receive reimbursement for eligible damages as well as other costs related to ProLine products in their homes and other structures.

Eligible damages include water related damage, including the window or windows and/or to the sash because of water penetrating between the aluminum cladding of the window and the window sash, as well as the consequences of such water penetration and damage. The settlement amount provided to each Class Member varies depending on whether the Class Member has paid to repair the eligible damages or not.

Class Members who submit a Claim Form no later than June 20, 2018, can be awarded cash under the settlement agreement.

Customers who want to object to or exclude themselves from the terms of this settlement must do so in writing no later than June 20, 2018.

Who’s Eligible

The settlement Class includes all persons in the United States who are current or former owners of Structures containing Pella ProLine brand aluminum clad wood casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2009.

Potential Award

Varies depending on the actual cash expenditures of each Class Member to address eligible damage.

Proof of Purchase

Class Members must submit a Claim Form along with supporting documentation, including the type of window or other Pella Product, the glass etch and product stamp ID or unit ID label, the date when eligible damage was discovered, whether the eligible damage has been repaired, and, if so, the date and type of repair.

    So anyone know what we are to do if we knew nothing about the issue much less just purchased our home in aug 2020. This home built in 2005, all the windows have that rot! Called the 800 number listed on one of the doucments….ALWAYS BUSY. GAVE UP FINALLY. What happens to us homeowners who by no fault of our own, are now stuck with rotted window structures and what appears to be no recourse?? The expense alone for our home which has A LOT windows would be astronomical! Someone has to help us as I am sure there are countless others who are not aware of the issue.

    Just found out about the class action today and wasn’t contacted by Pella nor our builder when this class action occurred. I have a rotted sliding door (also leaky) and 2 casement windows on my house. I cannot obtain any replacement parts anymore, since Pella stopped manufacturing the Proline series. For a new and installed sliding door and windows directly from Pella, it will be an estimated $12,000 expense. Anyway we can lower the expense would be helpful. I realize the windows and door are 20 years old, but the issues started years ago. Thanks.

    I’m furious. I found I had window rot on my Pella windows that were installed on my new home in early 06. The windows were stamped 05. All casement and a patio slider. Patio slider I found out just recently from a carpenter and myself also that it had been rotting out for several years I called Pella local dealer and they said you won’t come out good with the company so just go with us locally and will give you new windows. Well they sent a guy out just several years ago and he said you have two bad windows and will give them to you and they sent them out without charge and then they said we’re going to charge you $95 to put them in. Well then my mother got sick and I was busy with that and a bad illness so I didn’t have time until later to check this out and a carpenter told me that all my windows are rotting out so what the hell does one do now that that damn lawsuit is closed but yet I’ve turned it in
    When it was still open. I’m so angry. Liars!

    Talk about corruption. I’ll never buy from these people again.

    We bought my parents house in 2010 which they built in 1991 with all Pella windows. The windows and the woodwork are absolutely beautiful, however many are blackened with rot and have been for some time. I remember right after the house was built my parents contacting someone, the builder? Pella? Because all of the windows would fog up with condensation. They didn’t get any help. Also, with the wood rotting the screws that hold the catch in place come loose so when I open them I can’t crank them shut so I have to either open the window next to it (if shuts ok) and reach my arm out to push the window shut or go outside the house to push it shut.

    In the winter we get a thick build up of frost/ice on the inside of our bay window which has the most rot by far, the wood is actually worn away with cracks and holes.

    I am just learning of this law suit today, March 23, 2022. Again, we absolutely love our Pella windows they are simply gorgeous, but they are also a sore spot of our house because of the rot.

    I just purchased our “ dream home” to get heathy in and there’s 32 Pella windows 1/4 of them are full of mold due to seal malfunction and the casement and aluminum are falling apart ! We are both disabled and need some help ! Moved in Nov. so nothing was growing until about a month later . What do I due? Still under warranty but I’m sure they will try to get out of it?

    7 Pella windows installed June 1992. Two windows replaced on 8/9/10. Cost of replacement was $599.69. Claim filed and received by Pella Settlement Administrator. PO Box 2876, Portland OR 97208-2876 on 4/22/13. All required documentation was enclosed, eg., receipts, photos,etc, Why have I not been reimbursed? Final approval of settlement was 3/15/19. If necessary I can send copies of all pages of original claim.

    Isn’t there anything we can do since we had no knowledge of the prior lawsuits?? And we are all owed new products. I Don’t have that kind of money again to replace all my windows .

    I purchased my bay window and double Hungs a little Over 10 years ago. I have been calling them for about 4 years about my very expensive windows having water damage and wood rot throughout the casement . They won’t respond to my calls other then telling me to call Service dept. and the service dept won’t return my calls. All I would Like is for them
    To fix Or replace the damaged windows. They took my money they should Honor their product.

    We bought our home in 2017, and the Pella window sashes were already rotting in most of the big windows. I called customer service, who informed me of the product line of the windows and that they have the purchase order still in their records for the house from 18 years prior. Next time we called to follow up on possibly ordering sashes, they suddenly had no record of our windows and we would have to pay a tech to assess our windows. I had no idea there was a class action lawsuit going on until much later, though it doesn’t sound like it would have even mattered.

    I am purchasing a property that has the defective windows and I am trying to find out if the current owner or previous owner or the builder received a settlement. Nobody can tell me. The address isn’t listed, but if the builder filed the claim from wherever that office is, that is where the claim would have been paid to
