Pella window screen defect

The Pella Corporation has agreed to pay nearly $26 million to resolve allegations that the Pella ProLine brand aluminum clad wood casement, awning and/or transom windows made by the company were defective and leaked.

If you are a current or former owner of structures containing Pella ProLine brand aluminum clad wood casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2009, you may be entitled to cash for actual expenses necessary to fix damages caused by the product.

In 2009, plaintiffs Kent Eubank, Jerry Davis, Ricky Falaschetti, and others, filed a class action lawsuit alleging Pella ProLine windows were defective. The plaintiffs said that defects in the products caused leaking, leading to additional damage, including wood rot in structures.

Pella Corporation initially agreed to a settlement in 2012, but that settlement was shot down because of inequality. The new settlement requires Pella to pay $25.75 million to resolve the class action allegations.

Under the terms of the settlement, Pella Corporation does not admit any liability and has maintained that wood rot can be caused by a number of factors, but Class Members will receive reimbursement for eligible damages as well as other costs related to ProLine products in their homes and other structures.

Eligible damages include water related damage, including the window or windows and/or to the sash because of water penetrating between the aluminum cladding of the window and the window sash, as well as the consequences of such water penetration and damage. The settlement amount provided to each Class Member varies depending on whether the Class Member has paid to repair the eligible damages or not.

Class Members who submit a Claim Form no later than June 20, 2018, can be awarded cash under the settlement agreement.

Customers who want to object to or exclude themselves from the terms of this settlement must do so in writing no later than June 20, 2018.

Who’s Eligible

The settlement Class includes all persons in the United States who are current or former owners of Structures containing Pella ProLine brand aluminum clad wood casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2009.

Potential Award

Varies depending on the actual cash expenditures of each Class Member to address eligible damage.

Proof of Purchase

Class Members must submit a Claim Form along with supporting documentation, including the type of window or other Pella Product, the glass etch and product stamp ID or unit ID label, the date when eligible damage was discovered, whether the eligible damage has been repaired, and, if so, the date and type of repair.

    We built our home in 1994. Installed all Proline Pella windows. Some casement, others double hung. We have had problems since day one. Numerous calls and visits from costly repairmen in the early years brought no satisfaction. Gradually we have been replacing windows, but they are not Pella!!. We have a Pella plant in our home town where many of our relatives and friends work. We wanted to support our local economy so we bought Pella and all it has done is cause agruments and grief among friends and family. Maybe Pella could reimburse me for all the towels and rags I used to stop the humidty and rain from ruining my drywall. No records from so many years back. Guess lawyers get to keep my money too.

    We had two large double windows replaced due to water leakage…i it rained, the water came in! Windows were properly installed when home was built, btw. We managed to have those two replaced by Pella at their cost – under protest, mind you. All our windows are Pella and I suspect the other four doubles would leak if not protected by porch roofs. When our windows started to leak within the first year of use!!! we discovered that Pella complaints were through the roof for the leaks. And they knew it. As did the dealer know when they sold us the windows — he had a deal for us!! So, bottom line for me is Pella should have been far more upfront and honorable. I won’t be buying their product again.

    My pro line casements from 2003 are rotten so far I found 6. I got a quote and part of the purchase is I waive my right to the class action suit. So for now I have to sit and wait for either a settlement or go ahead and replace all my windows on my dime of course with a different brand.
    Mine were installed properly and were finished and sealed on the bottom of the sash. Pella’s claim their claim that its not the product is a farce. Of course it is.
    Ironically the quote they gave me for unfinished sashes is ridiculously high, which I’m sure is on purpose to recoup the cost of the settlement.

    Trying to fill out the paperwork to submit a claim and it is nearly an impossible task. We paid $120 to have a Pella Inspector come to our home and he provided the necessary quote. No where on the form to ask for my $120 back so if this doesn’t work out we are just out that money. I want to note to others that when we got the quote, that Pella stated that we were getting “a highly reduced cost as a gesture of customer goodwill.” We can “simply sign one copy of the proposal, along with a down payment of 50%” and they will start the work. In this SAME paperwork there is an arbitration and class action waiver. If we followed instructions, we would “simply” sign this form for them to start work, pay full price, and “WAIVE all of our rights to proceed as a member or representative of a class action.” Nice try. I will spend hours trying to figure out how to fill out this paperwork and will not be signing away my rights, thank you very much. If there is anyone out there who is helping with these forms, I would love some assistance!

    I have 6 pella defective casement windows which are unusable for wood rot.I called pelka service center in which i am told. Pay 95.00 dollars to get service team to come out and give quote. Then on my dime i pay for replacement and turn in paperwork to corporate to veiw to pay. The work is done and it highly unlikely they would reimburse me. If this is the way they stand behind their product, i will never buy or recommend a pella product. The company might look around, they are not the only window company .

    First I heard of this class action. When our Pella aluminum clad windows and patio doors needed repair and/or replacement two years ago I tried to buy replacements from Pella, got the run around. They never transferred old records to their computer, didn’t make replacement, wouldn’t come to take measurements,etc, etc, etc. Hmmmmm!

    Now Explain To me Who keeps all these records that go back to 1991 I sure didn’t so I guess the Attorneys get my portion that I don’t have the records for! Now this is Wrong

      You and me both I have nothing anymore either. This is ridiculous. I don’t remember exactly how much it was for the windows or even how much it was to replace them. We did not have a standard 6 foot sliding door we had a 8 foot…So that was fun. When I called them I could not even get a return phone call. I have never purchased or had another good recommendation for any one since on their products!!

    I also agree with Dean Woodard. We also purchased a Pella Patio French door at the same time as our casement windows and it has also rotted and now we have to replace it at our expense. I will never purchase Pella products ever again and will inform and encourage friends and family to do the same.

    Limiting this Pella class action to casement windows when this defect runs across the whole line of Pella Proline windows is scandalous! Casement windows are easy to replace compared to double hung and sliding doors. This settlement was written to benefit Pella at the expense of thousands of Pella owners. Pella and Clifford Law were the winners! The owners of rotten Pella windows the losers!

      You are dead wrong .class action suits are bought many times by plaintiffs who persist. I spent over 100 hours in pursuing pella .finally I became a lead plaintiff . Spent numerous hours in depositions . I .myself will not be fully reimbursed . Yes ,I had sliding doors that were not included in the settlement .if you had damage all you had to do was be a persistent observer and lodged a complaint years ago . I am not sure if double hung windows were not included since they were not defective or at least proved to be so or alleged . If you believe it to be so it is never to late to file another class action lawsuit for yo
