Pella window screen defect

The Pella Corporation has agreed to pay nearly $26 million to resolve allegations that the Pella ProLine brand aluminum clad wood casement, awning and/or transom windows made by the company were defective and leaked.

If you are a current or former owner of structures containing Pella ProLine brand aluminum clad wood casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2009, you may be entitled to cash for actual expenses necessary to fix damages caused by the product.

In 2009, plaintiffs Kent Eubank, Jerry Davis, Ricky Falaschetti, and others, filed a class action lawsuit alleging Pella ProLine windows were defective. The plaintiffs said that defects in the products caused leaking, leading to additional damage, including wood rot in structures.

Pella Corporation initially agreed to a settlement in 2012, but that settlement was shot down because of inequality. The new settlement requires Pella to pay $25.75 million to resolve the class action allegations.

Under the terms of the settlement, Pella Corporation does not admit any liability and has maintained that wood rot can be caused by a number of factors, but Class Members will receive reimbursement for eligible damages as well as other costs related to ProLine products in their homes and other structures.

Eligible damages include water related damage, including the window or windows and/or to the sash because of water penetrating between the aluminum cladding of the window and the window sash, as well as the consequences of such water penetration and damage. The settlement amount provided to each Class Member varies depending on whether the Class Member has paid to repair the eligible damages or not.

Class Members who submit a Claim Form no later than June 20, 2018, can be awarded cash under the settlement agreement.

Customers who want to object to or exclude themselves from the terms of this settlement must do so in writing no later than June 20, 2018.

Who’s Eligible

The settlement Class includes all persons in the United States who are current or former owners of Structures containing Pella ProLine brand aluminum clad wood casement, awning and/or transom windows (including 250 and 450 Series) manufactured by Pella Corporation between 1991 and 2009.

Potential Award

Varies depending on the actual cash expenditures of each Class Member to address eligible damage.

Proof of Purchase

Class Members must submit a Claim Form along with supporting documentation, including the type of window or other Pella Product, the glass etch and product stamp ID or unit ID label, the date when eligible damage was discovered, whether the eligible damage has been repaired, and, if so, the date and type of repair.

    I filed a claim in the Eubank v Pella class action. I had two episodes of window/sash replacements with total costs exceeding $10,000. I had sash/window inspection documents from a Pella dealer and replaced all bad products with Pella and had the purchase support documents.

    Today I received a settlement check for about $250. Even if only the first episode, cost about $5,400, was considered eligible, that is a payment for less than 5% of the costs the claim form asked to be documented. Even with low expectations, this is a disappointing outcome.

      Exact same situation for me…Got a check today for $250 but spent over 10k and have many more to replace. What a joke.

    Add me to the unfortunate people who thought the were making a good purchase. I went to close a window and it fell apart This is very upsetting. Who can you trust anymore?

    I have Pella casement windows with rotting wood bottoms on the cladded casement windows installed on our home. No reply from anyone regarding the settlement…not even a reply or acknowledgment of receipt of the document. I will be replacing the sash units only myself, cheapest alternatives-ordering a sash unit, a window and take the sash out or just Bondo the bottom with fillers if possible. If I could not do this myself, I would get an estimate from established local window companies installing a quality vinyl window and Low E or argon-filled glass for replacement. We had Andersen & Pella in our homes and both have failed. Andersen hardware failed us on all windows costing us 198.00 per window to replace ourselves after 5 years in a new home. Get multiple quotes and make sure you let Anderson walk out, the last quote as they think they are leaving is the best, especially overpriced Renewal. Tell them your not interested if they come to your home for a presentation. If they feel they are not going to make the sale, they will drop your price down up to an additional 30% off your bid. They have nice windows, just highly overpriced for a replaced window.

    I just found that I have 2 windows that have rotten at the bottom of both of them, the screws that hold the bottom arm completely fell out whenever I opened the window to check after reading about the problems with Pella Proline casement windows. These windows ( I have 12 of them) only the two have rotten at present. Question are my windows included with the Class Action suit with Pella. The local Pella Rep said that just the window itself will cost between $400 -$800 not including the installation. What a rip off.

    Pella and the courts have settled ,however the actual payments have not been given because of delays due to the corona virus .as of this week judge is suppose to rule on July 10 ,2020 and have payments disbursed

    Our experience parallels a number of others in that we had concerns regarding Pella windows and sliding doors in our home

    We contacted Pella for assistance

    We were required to pay $92.00 upfront for a Pella technician to inspect the windows and doors

    He indicated there were no problems with any of the Pella products

    The technician did not acknowledge or reference the existence of the class action litigation or settlement raising significant ethical concerns from a customer relations perspective

    At this point we have no choice other than to seek remedial steps to address water intrusion and related damage on multiple windows

    Disappointed is an understatement

      I’m just now finding out about this issue also. Whole house is pella windows, even had a patio door installed because I like the look of the blinds between the glass. A couple of years ago. I noticed several people are just now finding out about this problem in 2020. Is there anything we can do?

        I’m in the same boat as you. Purchased this house full of Pella windows,
        patio door, casement windows, 13 ft bay window.
        Many are blackened and looks moldy.
        What recourse do I have?

    We bought our house in 2013 and I just noticed that my large picture window with three panes (outboard are casement windows with stationary center glass) are rotted. They are the pro-line aluminum clad exterior with wood interior. I got a price of $2,400 from Pella to replace just the two outer sashes. No mention from the Pella Team about the class action lawsuit… and the rotting issues. I had no choice and ordered the windows. A replacement window was over $6,000… a nice Pella bay was $16,000!!!! I will not install Pella windows in the next home we are planning to build.

    Just noticed this week (5/2020)when I opened a window and tried to close it all the screws pulled out—totally rotted at the bottom—found two others so far—missed the deadline of course–mine were installed by my builder in 2004.

    Just heard about the class action but to late to file claim. I have a 20 year old exterior sliding door that the wood is completely rotted away at the bottom of the door. i have to replace the door at a cost of $3,000.
