Olympic-rescue-it

A $6.5 million settlement has been proposed in a class action lawsuit alleging PPG Industries Inc. manufactured Rescue It! and Revitalize products with design flaws that cause them to crack, peel, bubble and damage the decking or substrate to which they are applied.

If you purchased a Rescue It! or Revitalize product between Jan. 1, 2013 and April 27, 2017, you may be entitled to benefits from the class action settlement.

The Olympic Rescue It! class action lawsuit was originally filed in Ohio federal court on May 8, 2015. Plaintiff Matthew Traxler alleges the Rescue It! products have a design flaw that causes them to fail to properly adhere to decking and other surfaces, causing the product to routinely bubble, crack, peel and cause damage to the surface upon which it was applied.

PPG denies all allegations of wrongdoing and liability and maintains its products are not defective. However, the company agreed to settle the Rescue It! class action lawsuit to avoid the burden and expense of ongoing litigation.

The products covered by this Olympic Rescue It! class action settlement include:

  • Olympic Rescue It! Wood & Concrete Resurfacer
  • Olympic Rescue It! Resurfacer + Sealant In One Moderate Restoration
  • Olympic Rescue It! Resurfacer + Sealant In One Light Restoration
  • Olympic Rescue It! MAX Resurfacer + Primer + Sealant
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Light Restoration
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Heavy To Moderate Restoration

Under the terms of the Rescue It! class action settlement, PPG has agreed to offer compensation to consumers who purchased Rescue It! and/or Revitalize products and experienced an adhesion-related problem (“Qualifying Problem”).

Who’s Eligible

Class Members of the Rescue It! settlement include anyone in the United States and its territories who purchased a Rescue It! product between Jan. 1, 2013 and April 27, 2017.

Potential Award

Class Members who experienced a Qualifying Problem may qualify for the following benefits:

  • Reimbursement of the purchase price for any Rescue It! or Revitalize product purchased during the Class Period; and
  • Reimbursement of the amount paid to remove the products (if applicable); or
  • Reimbursement of the amount paid to replace part or all of the deck or substrate as a result of a Qualifying Problem (if applicable).

Class Members who paid to remove the Rescue It! products are eligible to receive $2 multiplied by the square footage of the area to which the product was applied, multiplied by the percentage of the area that had a Qualifying Problem requiring removal of the product.

Class Members who paid to replace decking or other structures damaged by a Qualifying Problem are eligible to receive $6 multiplied by the square footage of the area to which the product was applied, multiplied by the percentage of the area that had a Qualifying Problem requiring replacement.

Proof of Purchase

When filing a Claim Form, Class Members are asked to select the type and quantity of Rescue It! product(s) purchased and indicate the type of relief they are seeking. Claimants must provide proof that they purchased the product and that they suffered a Qualifying Problem. Class Members seeking reimbursement for removal or replacement must provide additional documentation. Follow the instructions on the Claim Form carefully.

    Someone just said that checks have to be sent out by 2/15/2019 because the judge gave this final approval to distribute funds, now you say they told you in an email that the checks would be sent out in a couple of months? Wow, I wish they will just send out our payment and not have us wait so long and tell people different dates of when it will be sent out, it reached final approval in 2017 just pay us already we have waited long enough. TCA do you have any better updates about this case, please share if you do. SO FRUSTRATING.

      THE checks are ready to go out. They have to mail before 2/14/19. But I imagine they will be out any day.

    Does anyone have an update on this settlement? When will the settlement checks be mailed to eligible claimants? The settlement reached final approval in 2017 and someone said that they got an email saying distribution will take place in January 2019 which is now, but still nothing. TCA can you please shed some light on this case, and give us some updated information on this case? Thank You.

      They are done calculating, everyone getting paid what they put in for plus there is money left for second distribution. They will be sending checks out sometime this month.

      The payment amounts for approved claimants was sent to the court 1/15/19 and judge signed off on it 1/15/19. Checks can go out now and they have to have them out within 30 days. So should be coming anytime now. All claims that were approved for the amount of claim plus there was extra money which will either be added to our claims or In a second distribution.

        Where did you find this info? I have called several numbers, emailed wherever they said to email, and still nothing. Another spring to come and prices are rising to save our deck.

          I received the information the checks will be going out within 30 days of 1/15/2019. All claims have been approved for the amount of claim if it was approved. So we should be getting them any day. They have to send checks before 2/15/19 .

            Any Updates on this case February 15, 2019 is almost here and nothing has been updated on this case as of ye,t and there is also no updated information about this case on the website, on the telephone automated system, and you cannot get anyone to the phone about the update of this case like when the funds are going to pay out…….This Week?…..Next Month?…..This Year?……..Never? TCA can you please give us some updated information on this and thank you.

          Received this email.” Checks are currently in the process of being prepared, printed and mailed. This process takes time and we are not able to make it go any faster than it is currently going. We anticipate that the distribution will take place in approximately 14 days.

          They are just dragging this out to make interest . They are holding 150 k back from our money for a “reserve” . For claims that might have to correct some bs. claims are over and they want the 150 k to keep for themselves. They will say a second distribution. But 150k would not be enough for a 2nd distribution. So obviously they will pocket it . Its wrong and they do what they want no one watches them audits them . Once final approval is over the courts are out of it basically and do not oversee any of their acts.

      I have tried several times to see if you have received my claim sent it before deadline. Called and emailed. Please a short reply would be appreciated. 2 seasons and my deck is ruined. We r seniors and cannot do the work ourselves.

    Oh my gosh, I lost my butt on a customers deck in Canton Mi I used Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant Heavy To Moderate Restoration. I power washed the 10 x 15 ft sq deck, then applied the Pittsburgh Revitalizer Sealant heavy restoration and the product just sat on top of the decking boards and didn’t adhere to the 5 1/4 x 6 x 16 ft decking boards. I had to replace the decking boards I purchased at Mans Lumber and lost a great friend/customer over this product. I hope to restore our relationship with this recall now that I can prove it was the product and not my lack of prep work. This caused me serious mental stress and costed me a small fortune. Is there anything I can do about this still? Happened back in Aug. 2016. I have pictures of the nightmare. I should be able to retrieve the receipts from my account at Mans Lumber for the new wood and product from Lowes..
