Olympic-rescue-it

A $6.5 million settlement has been proposed in a class action lawsuit alleging PPG Industries Inc. manufactured Rescue It! and Revitalize products with design flaws that cause them to crack, peel, bubble and damage the decking or substrate to which they are applied.

If you purchased a Rescue It! or Revitalize product between Jan. 1, 2013 and April 27, 2017, you may be entitled to benefits from the class action settlement.

The Olympic Rescue It! class action lawsuit was originally filed in Ohio federal court on May 8, 2015. Plaintiff Matthew Traxler alleges the Rescue It! products have a design flaw that causes them to fail to properly adhere to decking and other surfaces, causing the product to routinely bubble, crack, peel and cause damage to the surface upon which it was applied.

PPG denies all allegations of wrongdoing and liability and maintains its products are not defective. However, the company agreed to settle the Rescue It! class action lawsuit to avoid the burden and expense of ongoing litigation.

The products covered by this Olympic Rescue It! class action settlement include:

  • Olympic Rescue It! Wood & Concrete Resurfacer
  • Olympic Rescue It! Resurfacer + Sealant In One Moderate Restoration
  • Olympic Rescue It! Resurfacer + Sealant In One Light Restoration
  • Olympic Rescue It! MAX Resurfacer + Primer + Sealant
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Light Restoration
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Heavy To Moderate Restoration

Under the terms of the Rescue It! class action settlement, PPG has agreed to offer compensation to consumers who purchased Rescue It! and/or Revitalize products and experienced an adhesion-related problem (“Qualifying Problem”).

Who’s Eligible

Class Members of the Rescue It! settlement include anyone in the United States and its territories who purchased a Rescue It! product between Jan. 1, 2013 and April 27, 2017.

Potential Award

Class Members who experienced a Qualifying Problem may qualify for the following benefits:

  • Reimbursement of the purchase price for any Rescue It! or Revitalize product purchased during the Class Period; and
  • Reimbursement of the amount paid to remove the products (if applicable); or
  • Reimbursement of the amount paid to replace part or all of the deck or substrate as a result of a Qualifying Problem (if applicable).

Class Members who paid to remove the Rescue It! products are eligible to receive $2 multiplied by the square footage of the area to which the product was applied, multiplied by the percentage of the area that had a Qualifying Problem requiring removal of the product.

Class Members who paid to replace decking or other structures damaged by a Qualifying Problem are eligible to receive $6 multiplied by the square footage of the area to which the product was applied, multiplied by the percentage of the area that had a Qualifying Problem requiring replacement.

Proof of Purchase

When filing a Claim Form, Class Members are asked to select the type and quantity of Rescue It! product(s) purchased and indicate the type of relief they are seeking. Claimants must provide proof that they purchased the product and that they suffered a Qualifying Problem. Class Members seeking reimbursement for removal or replacement must provide additional documentation. Follow the instructions on the Claim Form carefully.

    Bought a 3 gallon pail on July 28, 2017 and another 3 gallons on September 14, 2018. It started peeling in May of this year. I’ve been scraping the peeling paint all summer. Just missed the suit covered period (April 27, 2017) for a refund. I had no idea this product was defective or there was a class action suit going on, had I known I never would have purchased this product. Bought it at Lowes, now they no longer sell this product.

    I just recently (6 weeks ago june 2018) Used this product on a customers deck. Within two weeks the deck started peeling and now have the task of correcting the problem. Am I eligible for any type of claim with this product. It’s absolutely crap and now I’m sorry I ever used it.

      If you can jump through all of the hoops you have a short window of opportunity to make a claim. Many of us applied this junk a few years ago. Who still has an “opened” container to prove it. I am sitting here with one can and the receipt of purchase as an extra in case I needed it. I don’t have the 14 other cans and receipt to prove it even though I have photos of the work done then and now. However, follow this link and fill in all the blanks and you should still get in.     We built a deck w/ wheel chair ramp and in 2013 painted it w/ Olympic Recue it and in 3 years it began to blister n peal. This paint is crap! We began power washing it and a friend told us yesterday of this class action and others claiming the same problem. Power washing is no longer an option n we r replacing boards but my son is in wheelchair so needs to b able to have access to get out. This has created a big problem. I don’t have receipts from that long ago n anyway the print doesn’t show after a year or two. We bought it at Lowe’s . I’m so angry. Why was this paint not tested first?

      SAME HERE…USED ON MY MOM’S RAMP & IT RUINED IT…SHE HAD IT TAKEN DOWN, BUT HAS NO RECEIPTS BECAUSE IT WAS 3 YEARS AGO….

    I purchased it, used it, finished it, and forgot about it. And all my receipts are gone, I don’t keep anything for more than 1 year.

    This was purchased at Home Depot, but they won’t go back that far to do me a favor. DARN!

    Will need a lawyer to write me an Affidavit.

      Erica, you should be able to be reimbursed for the cost of the product as long as you have the receipt. It’s easy to file a claim.

    Final approval has already been granted back in august, does anyone know if they’re going to wait until the claims filing deadline which is almost 9 Mos from now to pay out claims or will they do it on a rolling basis until funds are exhausted? I’ve put this question to the settlement administrator via email about a month ago, no response back.

      It’s more than likely claims will not be paid until after the deadline. There is only so much settlement money to be distributed, therefore all claims must be reviewed prior to paying anything out. If you aren’t getting a response from the settlement administrator, you may want to contact class counsel. Counsel is listed in this article and on the settlement website, and can be Googled for contact information.

    I did all the requirement and submitted all to the law firm but never received any reply or yes we received it from them. Is this something shady by this law firm? I actual set the form and receipts and pictures twice. This seem a little of to me.

      I also have done the same. I mailed all info they required back through usps with signature required that they received it. I did not get a signature. I’m worried no one will be paid.

    who keeps receipts for a product for 3-4 years??? I’d like to be reimbursed for purchase price but no longer have it. This is really a shame.

    We purchased revitalize 2 years ago and our deck is already peeling. It’s a bummer, we don’t have the receipt anymore. A lot of people miss out because they don’t have their receipts.

      Same here I used it on my deck. Had to power wash the whole deck and use other product

      I am in the same boat. I am still looking for receipts though. I am going to try to see if Home Depot might have receipts on file.
