The Office of Personnel Management (OPM) and its contractor Peraton agreed to pay $63 million in relation to a settlement in a class action lawsuit. The lawsuit alleges that OPM and Peraton compromised personal information of then-current and former federal government employees and contractors, as well as certain applicants for federal employment. OPM and Peraton deny they have done anything wrong but have agreed to settle the lawsuit.

The settlement benefits consumers who suffered losses in connection to the Office of Personnel Management’s 2014 and 2015 cyber attacks or Peraton’s 2013 and 2014 cyber attacks.

OPM is a federal agency that serves as human resources for federal government employees. This agency is responsible for retirement benefits, insurance and other benefits for federal employees.

To be eligible to make a claim, the class member’s personal information must have been compromised in the data breaches, and they must also have suffered an out-of-pocket expense or lost compensable time:

  1. To purchase a credit monitoring product, credit or identity theft protection product, or other product or service designed to identify or remediate the data breaches
  2. To access, freeze or unfreeze a credit report with a credit reporting agency; or
  3. As a result of an identity theft incident or to mitigate an identity theft incident

Under the terms of the settlement, class members who submit a valid claim by Dec. 23, 2022, can collect a cash payment. Under the settlement, each claim will be valued at $700 or the actual amount of the claim — whichever is greater — up to a maximum of $10,000. In order to receive a payment from the settlement, class members must submit a valid claim form by Dec. 23, 2022. Visit www.OPMDataBreach.com to make a claim.

OPM (as authorized by Congress) has made free credit monitoring and identity theft protection services available to all individuals whose personal information was compromised in the data breaches. Those who have not signed up for these services but wish to do so may visit https://www.opm.gov/cybersecurity/ or call 1-800-750-3004 Monday through Saturday, between 9 a.m. and 9 p.m. Eastern Time.

The deadline for exclusion and objection is Sept. 9, 2022. Class members who exclude themselves do not benefit from the settlement but will keep their legal rights against the defendants. The final approval hearing for the settlement is scheduled for Oct. 14, 2022. Class members do not need to attend this hearing but may choose to do so.

Who’s Eligible

The settlement benefits those who suffered losses in connection to the Office of Personnel Management’s 2014 and 2015 cyber attacks or Peraton’s 2013 and 2014 cyber attacks and if, after May 7, 2014, you suffered an out-of-pocket expense or lost compensable time: (1) to purchase a credit monitoring product, credit or identity theft protection product, or other product or service designed to identify or remediate the data breaches; (2) to access, freeze or unfreeze a credit report with a credit reporting agency; or (3) as a result of an identity theft incident or to mitigate an identity theft incident. 

Potential Award

Up to $10,000

Proof of Purchase

Documentation of expenses related to the data breach, including receipts, invoices and other proof.

    Are you saying someone opened accounts in your name after you froze your accounts? Not saying that it is impossible but highly irregular. If so, I would contact the 3 in writing and complain.

    If it happened before, then make sure you aren’t giving your info away. E.g., is your birthday celebrated on Facebook or other social media? Any other PII, including maiden name on social media? Do a good scrub.

    Hello I also received two separate 1099-MISC tax forms. The first one state’s the dollar amount under royalties and the second 1099 show’s the dollar amount under other income and the corrected box at the bottom is checked. I however never received any fund’s. What do I do or who do I contact about this? It state’s that this is from December 23 Settlement Fund. Help!

    I have received TWO official tax forms for 2022 Tax filing saying I received “Royalties” of $742.07. I have not received ANY funds, must I file these forms before I see the money?

    I was part of the initial opm data breach several years ago and at the time only rec’d monitoring svc’s. Which on several occasions I’ve contacted them about my information in there reports being compromised on the black web. Things like my DL#, Soc. Sec#, DOB, Address, full name and telephone number and there is literally nothing they do about it. I’m constantly receiving reports that my full demographics are on the black web and there’s nothing they do to. I believe I should be added to this lastest class action suit. I’d appreciate a substantial monetary payout as well as on going monitoring svc’s as well as a resolution process. This is absurd!!

    I was part of this breach. I have the credit monitoring they offered. It’s not very useful to have. Not sure if I’m apart of this further breach but it’s a mighty coincidence that my identity was stolen. I’ve had to spend time making a police report, contacting the FCC (assuming other agencies). I’ve had to freeze my account with all credit bureaus. My credit score wasn’t great but it took a dive when whomever has my identity kept applying to open accounts. Each time my score dropped at least 3 points. I’ve had to email each place/bank to get letters that they will stop allowing someone to gain anything in my name. They changed my email password in efforts that when businesses send an email for verification purposes I wouldn’t receive it. That’s just a part of what I had to and am still going through. It’s very stressful. If anything goes wrong I have tried everything I can to not be liable by filing an identity theft with several agencies. I feel, if this is the case, they owe me and everyone alike more than what they’re willing to compensate. It’s awful. My hair started falling out from the stress. It’s soooooo time consuming as well. I’m by far not rich. I’m a middle class person trying to make it while also contributing to society. Why anyone would want what little I have (or don’t have) is beyond my understanding. My level of trust with federal or any agency is gone. It’s disappointing.
