NPAS Solutions LLC has agreed to pay $1.4 million to settle a class action lawsuit that alleges it used an automatic telephone dialing system to call consumers that were not the intended recipients of the phone calls in violation of the Telephone Consumer Protection Act (TCPA).
If you received one or more telephone calls from NPAS Solutions LLC between March 28, 2013 and Dec. 4, 2017 that were directed to a number that was different than the party that NPAS Solutions was attempting to reach, you may be entitled to a cash payment from the TCPA class action settlement.
Plaintiff Charles T. Johnson alleges NPAS Solutions placed several calls to his cell phone number in attempt to contact someone named “Stephanie” regarding a debt in default. According to the TCPA class action lawsuit, Johnson answered one of the calls and informed NPAS Solutions that it was calling the wrong person.
Johnson says he demanded the calls stop, but NPAS Solutions allegedly continued to call his cell phone number. These calls were made utilizing an artificial or prerecorded voice, and were placed using autodialing technology that is prohibited under the Telephone Consumer Protection Act, the NPAS Solutions class action lawsuit says.
“Upon information and good faith belief, Defendant had knowledge that it was using, and intended to use, an automatic telephone dialing system or an artificial or prerecorded voice to place the calls at issue to Plaintiff,” Johnson alleges in the TCPA class action lawsuit. “Plaintiff suffered harm as a result of Defendant’s telephone calls at issue in that he suffered an invasion of privacy, an intrusion into his life, and a private nuisance.”
“As well, Defendant’s telephone calls at issue depleted or consumed, directly or indirectly, Plaintiff’s cellular telephone minutes, for which he paid a third party,” the NPAS Solutions class action lawsuit continues. “Additionally, the unwanted calls at issue unnecessarily tied up Plaintiff’s telephone line.”
The NPAS Solutions class action settlement was preliminarily approved on Dec. 4, 2017.
Class Members who would like to opt out of or object to the TCPA settlement must do so no later than March 19, 2018.
Who’s Eligible
Class Members of the NPAS Solutions TCPA settlement include: “All persons in the United States who (a) received calls from NPAS Solutions LLC between March 28, 2013 and December 4, 2017 that (b) were directed to a phone number assigned to a cellular telephone service, (c) for which NPAS Solutions’ records contain a ‘WN’ designation, and (d) were placed using an automatic telephone dialing system.”
Approximately 179,642 phone numbers have been identified as falling within the Class definition.
Potential Award
Class Members who submit timely and valid Claim Forms are entitled to an equal share of the settlement fund that remains after the deduction of settlement administration costs, attorneys’ fees, costs, expenses, and incentive awards.

Wanted to know about the class action I applied online
May 7, 2018, the Court entered an Order granting Final Approval for the Settlement. However, class member Jenna Dickenson has filed an appeal from the Final Approval Order, which means distributions to Class Members cannot begin until that appeal is resolved. At this time there is no estimate as to how long the resolution of the appeal may take. We apologize for the delay and appreciate your patience with this process. I finally stumbled upon this new info. I was getting highly frustrated because the telephone number listed Is an automated recording that can’t answer why I haven’t received payment. I understand now why.
How do you find out if your number was called? It’s hard to recall exactly who I received telemarketer calls from 5 years ago.

Anyone know if you can verify if your number is one of the 170 thousand affected? I’ve gotten calls of this nature dozens of times, but I have no idea what firms were doing the calling and if I should apply for this suit or not. Other suits let you put your phone number in to check, but I don’t see that here. Anyone who can help?
If you file a claim and your number is not in their database, it won’t submit the claim and it’ll tell you that your phone number is invalid.
They called several times and I told them I wasn’t interested, but they still called back.
