Norcold Inc. has agreed to pay $36 million and offer an extended warranty to settle a class action lawsuit stemming over allegations that its refrigerators contain a safety-related defect.

Plaintiffs claim that Norcold gas absorption refrigerators, typically installed in RVs and boats, have a cooling unit issue which may cause the boiler tubes to corrode and leak flammable gas which could increase the risk of a fire.

Claims for personal injury or wrongful death are not covered under this class action settlement.

The Norcold class action lawsuit alleged the manufacturer is liable for breach of state consumer protection laws as well as breach of express and implied warranties.

Norcold denies all wrongdoings but agreed to the settlement to avoid the risk and cost of further litigation.

Refrigerators covered under the class action settlement include Norcold 1200 Series, N8 Series and N6 Series Gas Absorption Refrigerators, a full list can be found here.

Class Members who wish to object or be excluded from the Norcold class action settlement, must do so no later than Aug. 26, 2016.

Who’s Eligible

Norcold settlement Class Members include all U.S. residents who own (or formerly owned) a Norcold 1200 Series gas absorption refrigerator or cooling unit that was made between Jan. 1, 2002 and Oct. 1, 2012.

In addition, all individuals who currently own a Norcold N6 Series gas absorption refrigerator or cooling unit, or a Norcold N8 Series gas absorption refrigerator or cooling unit, that was manufactured between Jan. 1, 2009, and Dec. 31, 2013 are also eligible to file a claim.

The Norcold class action settlement includes two different benefits to Class Members. First, the defendants agreed to create a $36 million fund to resolve all claims for the 1200 Series, N8 Series and N6 Series gas absorption refrigerator Class Members.

Second, for those Class Members who currently own a N6 or N8 Series gas absorption refrigerators, Norcold will provide a three-year extended warranty covering replacement (parts and reasonable labor costs) of any cooling unit that fails due to a leak.

UPDATE 3: On July 6, 2017, according to the settlement website, the first settlement distribution checks were expected to be mailed mid-June, 2017. However, settlement administrators have to review thousands, sometimes hundreds of thousands, of Claim Forms and verify that each one is valid before processing payment. In a hugely popular settlement, this can take a while. Please be patient and continue checking Top Class Actions and the Settlement Administrator website for updates. We’ll let viewers know as soon as we learn that payments have gone out. We always update our articles with any major case developments or settlement news!

    we have not gotten our checks either. I have not been able to leave a message we did move and have a new address just don’t know how to update it so that we can get those checks re issued.

    I have tried calling and calling and I never get thru. I did not get my check since my move I had. :(

    My son baught a 2003 hitchhiker 5th wheel and it just burned to the ground fire and insurance investigators said was due to the fridge.. this happen 9/17/19.. how does he get help from this class action or does he need to hire attorney?

    For those that have not received their check for whatever reasons once you call (866-381-9100) and notify them, you can request a re-issued check. They put a stop on the July 1st dated check and advise not to cash if received, and that the new check, once processed, “will take 3-5 weeks.” Hope this helps. Originally people were advised to “wait it out” to see if it ultimately was delivered (sent from Kentucky), but 19 days for First Class Paid Postage seems excessive. If this applies to you please leave a reply to generate a count. If you requested a re-issued check reply with a timeline of actually receiving it to give others an idea.

      Thanks they told me they reissuing my check cause I never received mines but the next time they reissuing checks is August 8th 2019

        Sounds like they stalling to gather a group of members who havent received and then just processing all at once. Not sure if I agree with this.

    I recently purchased a 2003 See Ya Alfa 38FD motorhome, and I am having issues with my Norcold 1200LRIM. It is smelling like ammonia, and not cooling. Is there an ongoing class action lawsuit for new Norcold owners?

    If you didn’t receive your check. Here is the the class action firms number 1-866-381-9100. I called today and got my check to be reissued due to me moving.

      Did they tell you that you have to wait till August 8th cause that’s when they reissue checks cause they told me that

        I was advised 3-5 weeks to process a re-issued check from my July 19th call in. Maybe a tracking number paid postage system should be utilized.

    As of July 10th 2019 have not received the 3rd installment check. Address is a PO Box in Texas. Previous year payments were received within 7 days even with the holiday and weekend. Not sure if not sent, went missing, delivered to a wrong address or stolen. I feel the disbursement shouldve have included tracking numbers OR a direct deposit option. Seems this may be a way to not have to pay out full amounts over the extended period of time.
    I will update if receieved or what the lawsuit officials advise me.
