Nissan Altima car dealership

Nissan Altima owners have secured reimbursements, an extended warranty, or a $1,000 voucher under a recent class action settlement.

Class Members include U.S. residents who leased or purchased a model year 2013 through 2016 Nissan Altima equipped with a continuously variable transmission. Class Members include both current and former owners and lessees.

According to the Nissan Altima CVT class action lawsuit, certain models of Nissan Altimas suffered from a defect that caused their transmissions to fail prematurely. The plaintiffs say the result was shuddering, unexpected power surges, hesitation, stalling, and noises.

The affected Nissan Altimas were equipped with continuous variable automatic transmissions, also known as CVT. The complaint alleged that, instead of offering a fix for the defective transmission, Nissan required Altima owners and lessees to pay thousands to repair the problem.

As a result, alleged the Nissan Altima CVT class action lawsuit, those who purchased or leased the defective vehicles did not get what they paid for.

The automaker refused to admit any wrongdoing, but agreed to settle the Nissan Altima CVT class action lawsuit to avoid the expense and risk of further litigation.

Under the terms of the settlement, Nissan agreed to extend the warranty on Altimas with the affected CVTs, by 24 months or 24,000 miles; however, Class Members with vehicles that are either more than 84 months old or that have more than 84,000 miles are not eligible for the extended warranty.

In addition, Class Members can claim reimbursement for transmission repairs they had to make out-of-pocket or a $1,000 voucher towards the purchase of a new Nissan or Infinity.

Claim Forms are not required for Class Members seeking the warranty extension. Class Members claiming reimbursement for repairs must complete a Claim Form. Class Members seeking a voucher must go to a Nissan or Infinity dealer and present their name and identification within nine months of the effective date of the Nissan Altima CVT class action settlement.

The deadline to file a claim in the Nissan Altima CVT class action settlement is Jan. 30, 2020. The deadline for Class Members to object to or opt-out of the settlement is Feb. 7, 2020.

Who’s Eligible

Class Members include “all current and former owners and lessees who purchased or leased Class Vehicles in the United States and its territories including Puerto Rico.”

Class Vehicles include “2013-2016 model year Nissan Altima vehicles equipped with a CVT.”

Potential Award

Varies.

  • Extension of the terms of the Nissan New Vehicle Limited Warranty for either 24 months or up to 24,000 miles, whichever occurs first.
  • Reimbursement for transmission assembly repairs related to the alleged defect.
  • Class Members who owned or leased vehicles that required two or more repairs or replacements can receive a $1,000 voucher toward the purchase of a Nissan or Infinity.
  • Class Members with vehicles that are more than 84 months old or with more than 84,000 miles are not eligible for the extended warranty but they can claim reimbursement for expenses related to transmission repairs.
Proof of Purchase

No proof of purchase required for the warranty extension.

Claims for reimbursement must include proof of repairs or replacements, including receipts, invoices, or billing statements.

Claims for the voucher must be made at an authorized Nissan or Infinity dealership and Class Members must present government issued identification.

    When will the settlement go into effect? I called Nissan about my 2016 Altima with 64,000 and they said nothing has been officially settled, essentially, stating the extend warranty settlement, is not yet in effect?

      It definitely has been settled, I would try and call someone higher up in Nissan and show them it was settled on March 10th and they have to extend it

        I have submitted my Altima for the trannsmision issue the manager of nissan internal affairs told me they will replace it 100% no charge but powertrain is denying my claim even tho the Nissan mechanics have put around 100 miles trying to show video an the hesitation my car has been there over 3 weeks an there’s no resolution in site

        No – 90 days from the “effective date” which is May 10. So, expect any payment by early August or a notice that you have been denied.

Ive been reading that may 10th is effective date for paymebts to start, bc the case was settled march 10th, may 10th is 60 days after effective date, i havent seen 90 days on any post, or page, nor that its after may 10th, can you inform us where you got this information?

          I was hoping you were wrong about the Effective date but you’re right. I found this on the website:
          When will Claims for Reimbursement be Paid?
          Within 90 days of the Effective Date, the Settlement Administrator will mail reimbursement checks for valid claims.

          It also note the settlement date was March 10, but the effective date, assuming no appeals are made by then is May 10, and they have 90 days from that date. But people will be able to go to the dealership as of May 10.

    I am the 2nd owner of a 2015 nissan altima, when it hit 67,000 miles my cvt transmission went out, I am disabled and had to get my dad to get a bank loan to pay for a new transmission that costed $4500. Dealer knocked 300 off bc he felt bad for me, anyway that loan with interest was $5000 and im still paying it, its a 3 year loan, i know im getting back the 4200 cost of repair, but would i have been eligible for the interest on the loan as well? Not everyone can afford 4500 repairs on a vehicle that should never have happened in the first place, and i just saw the lawsuit for carbon monoxide poisoning on this vehicle as well, and I have been smelling a weird exhaust smell for a year, and when i getout of my car many times i have experienced ortho hypertension, a rush to my head and feel dizzy and stumble, my dr that checked me out for that over a year ago just said it happens to some when they get older, im not buying that im only 50, so if i taje my car to a dealer and they refuse or lie about the carbon monoxide reading, who do i take it to, to find out if its actually leaking, my grandkids ride in my car a lot and i want them to be safe, they fall asleep in my car a lot too, i hope to God its not from a leak, i dont smell it every day, the exhaust but i do often enough that i open my window to see if the smell is outside, and it never is, so i dont know what to do about this, i cant afford to pay for a reading at dealer, its expensive and i cant get another loan, im still paying on first one for tranny

      I can tell you this. You are NOT smelling the CO2 because that is odorless.

        Natalie did not mention CO2. She said she could smell a weird exhaust smell. Then she spoke of carbon monoxide (CO). CO is an odorless, tasteless, and colorless gas. It is highly poisonous. Natalie knows that when one smells engine exhaust, which is a mixture of unburned fuel molecules, oil molecules, steam, and CO, which are the byproducts of combustion, it is a dangerous thing.

          She mentioned this “saw the lawsuit for carbon monoxide poisoning on this vehicle as well, and I have been smelling a weird exhaust smell” so I mentioned that it wasn’t CO she was smelling. ?

      No they said on one of these comments that you can’t, but also it could take up to 60 days for payments and it hasn’t been a month yet

    I have a 2016 Nissan Altima and the transmission went out at 64000 miles. I parked it in the barn last month because I could not afford to fix it. Will I receive a notice in the mail to take it to the dealer to have the transmission fixed/replaced?

      No you had to have made a claim by January 30th if you got a card in the mail. The settlement is closed and payments are already on the way.

      That is not true, based on the settlement, they extended the powertrain warranty.
      Call the dealer, tow your car to the dealer and have them fix it for free.
      the claim payments are for those who already paid, since your car is still broken and under 84k miles you qualify to get it fixed for free based on the settlement.

      John is correct. You only had to file a claim if you were seeking reimbursement for repair that were already made. You’re covered under the extended warranty and Nissan is required to repair it at NO cost to you. So haul that sucker down to Nissan!! ;)

            Antonio, I have spoke with two dealerships in Oklahoma city and one does acknowledge the law suite. I am currently working with him to see what actions his dealership will take. So far he has only acknowledged the law site. I sent him an email just minutes ago so I will reply as soon as I hear something or not. Either way I will inform you of his reply. The other dealership would not acknowledge the law suit at all. I believe Nissan needs to send a message out to the dealerships regarding this warranty extension. Why are the dealerships not acknowledging this matter? What do we do if they do not honor this settlement? These questions and concerns need to be addressed by someone!

        Ok let me know when you hear of anyone actually getting it fixed at a Nissan dealership, everyone that has tried so far said they will not acknowledge the class action settlement even still after it’s been settled, so what do they do in these cases ??‍♀️

    I have a 2014 Nissan Altima and I think that my transmission is acting up as it hesitated when accelerating. I spoke with someone and was told that because I have over 84,000 miles I am not covered under the class act. How am I being held responsible for fixing the transmission when my car is only 6 years old and I was sold this vehicle with a faulty transmission. What options do I have as I don’t feel I should be responsible for replacing something that was sold to me messed up.

      The next contact you receive will likely be a check if your claim was deemed as such. The claims for this suit will also “likely” be processed relatively quickly for this particular class action compared to others (that is the good news here). This site will capture when the checks are being mailed out. If you do not receive a check at that time, your claim was rejected.

          They have 60 days, so you might not know anything until May. If you had your proof of repairs and submitted your claim on time and everything fell in the guidelines, I don’t see any reason why you wouldn’t get a check :)
