Navient class action lawsuit

Navient Solutions Inc. (formerly known as Sallie Mae Inc.) has reportedly agreed to settle two class action lawsuits alleging it violated the Telephone Consumer Protection Act by continuing to contact phone numbers that were designated as a wrong number.

If you received text messages or phone calls from Navient on your cell phone between May 4, 2011 and Jan. 26, 2017 after Navient designated the cell phone number as a wrong number, you may be entitled to payment from the class action settlement.

Plaintiff Randy Johnson filed the initial class action lawsuit against Navient, claiming that Navient violated the Telephone Consumer Protection Act by using an automatic telephone dialing system to contact consumers’ cell phones, when the person subscribed to the phone number was different than the intended recipient.

Johnson asserts that, beginning in about September 2014, he began receiving calls from Navient on his cell phone. He says that each time he answered the call, he was greeted with an artificial or prerecorded voice. The calls were allegedly intended for a different recipient, and Johnson says that he informed Navient that he was not the intended recipient of the calls.

According to Johnson’s TCPA class action lawsuit, he has never been a customer of Navient and never consented to receive calls on his cell phone from Navient. He asserts that Navient violated the TCPA by contacting his cell phone using an automatic telephone dialing system without obtaining his prior express consent.

Shelly Toure and Tony Heard filed a similar TCPA class action lawsuit against Navient. This proposed settlement, if approved, will resolve both of these Navient class action lawsuits.

Navient has reportedly agreed to pay nearly $20 million to settle the TCPA class action lawsuit.

The Navient class action settlement was preliminarily approved on Jan. 26, 2017.

Who’s Eligible

Class Members of the Navient TCPA settlement include: “Each person and entity throughout the United States: (a) to whom Navient Solutions Inc. placed one or more telephone calls; (b) directed to a telephone number assigned to a cellular telephone service; (c) by using an automatic telephone dialing system; (d) after Navient Solutions Inc. designated the telephone number to which it placed the call(s) as a wrong number; (e) between May 4, 2011 and January 26, 2017.”

Potential Award

$200 – $350 (estimated).

Each Class Member who submits a timely and valid Claim Form will be entitled to a proportional share of the settlement fund. The actual amount each claimant will receive depends on the total number of approved claims. Class Counsel estimates that the cash award will be in the range of $200 to $350.

    Court documents say that distribution of checks worth $515 will occur within 30 days of the effective date of the settlement. That’s by September 13.

      According to their website, their effective date is august 21st and checks must be mailed within 30 days of that.

    I think many of you didn’t read the eligibility for this settlement. You had to have been called by Navient’s automated dialing system by mistake, a wrong number. If you have an account with Navient whether previous or still open then the calls made to you were not a wrong number. Only people who have never dealt with Navient before and were called are eligible and I believe those people were sent notices with a claim id in the mail, at least I did anyways.

        Read part (d). This settlement isn’t about Navients overzealous collections attempts it’s about them using automated dialing systems calling wrong numbers.

          Read part a, b, c, d & e! It includes ALL of the above lol…d is just PART of it….. Clearly some ppl who have accounts with ancient did receive notices. The point is they violated a law. And they are paying for it. Point blank

    I am just now learning of this class action lawsuit that I have definitely been a victim of. Is there exception for late filing? My family and I been harrassed for years.

    I never got a notice and they have been haunting me. I only took 3 classes online and they are charging me so much and put it on my credit report so many times . I don’t know who to go to.
    There must be more class actions against them this is so unorganized I wonder who is in charge of it.

    I have tried to submit a claim several times, but the system says they can’t find my number. Navient auto called me so many times a day (around 9 times) that I changed my phone number. The claims submission process in this class action needs to be looked into. I can see from reading other complaintants that I am not the only one who cannot submit a claim.

    How does this apply to those of us Americans who live abroad who Navient does not phone, because they are too cheap I assume, but rather emails.

    Since Navient took over from Sallie Mae or became the new Sallie Mae, I no longer can pay via direct debit. Under Sallie Mae, I could pay via direct debit. Now, I have to pay via international online payments with my bank who takes a fee for handling an international payment…then (I’m told) Bank of America takes a fee for ensuring the payment is legitimate and finally it lands at Navient’s bank, Wells Fargo who also charges a fee. Total fees, depending on the exchange rate from the GB Pound to US Dollars, can be up to an extra $50 each month.

    And most infuriatingly, since Navient came along despite making my payments regularly, I now owe MORE than when I began this “rehab” program.

    My father, who’s credit is squeaky clean and always has been, who threw an absolute fit when I was, unfortunately, unable to make my payments for a few months due to unemployment. He told me repeatedly I had “better pay them somehow” because they were phoning him as well as my step mother’s family members, people who I don’t even have phone numbers for! WELL, NOW my father has said “I wouldn’t give them a dime” because they’ve made it virtually impossible to make a payment without incurring extra in fees. I can only pay via online bank transfer OR by calling the USA, pay the long distance charges AND because my bank card is not registered at an American address, I have to speak to a human which costs me an additional $25.

    So my family, all of them, have said not to pay at all due to their endeavour to make my payments almost impossible to pay without extra measures and fees.

    I have received calls on my cell phone regarding my student loan who I have had with Navient for some time now. It keeps telling me that my number does not apply. Frustrating
