Nationstar Mortgage agreed to settle a class action lawsuit that accused the company of violating the Telephone Consumer Protection Act by robocalling consumers regarding a home loan.
Under the terms of the settlement, Nationstar will pay $12.1 million to Class Members as well as make some changes to company procedures which includes training employees how to properly code consumer requests to stop the calls.
Before this settlement, plaintiffs claim that the only way to way to stop the robocalls was to speak with a live operator and provide personally identifying information such as a social security number.
Nationstar denies that it violated any law and maintains that its calls regarding mortgage loans provided information that its customers agreed to receive. However, the company agreed to settle to avoid the expense of litigation.
UPDATE: On Aug. 29, 2016, the Court granted final approval of the Nationstar class action settlement.Â
UPDATE 2: On September 8, 2016, a notice of appeal was filed in the Nationstar TCPA settlement. Claims will not be paid until all appeals are resolved. Top Class Actions will continue to provide updates as we learn more. Â
UPDATE 3: As of October 25, 2016, the appeals to the Nationstar TCPA settlement have been dismissed.  Let Top Class Actions know when you receive a check in the comments section below or on our Facebook page.
UPDATE 4: On Jan. 9, 2017, Top Class Actions viewers who submitted timely and valid claims for the Nationstar Mortgage TCPA class action settlement began receiving checks worth as much as $76!
Who’s Eligible
Nationstar settlement Class Members include all U.S. residents who received a call from Nationstar on a cell phone between Oct. 14, 2015 to the present. Most Class Members will receive a postcard notice of the settlement in the mail.
If you did not receive notice through the mail but believe you qualify as a Class Member contact the Claims Administrator at 1-877-683-9363.

Varies.
Class Members will receive an equal portion of the $12.1 million Nationstar Mortgage Settlement Fund. The individual amount will depend on the total number of valid claims filed.

N/A
No proof of purchase is required but you must file a Claim Form no later than April 11, 2016 and include the cell phone number that was called by Nationstar.Â

Just received a check for $38.19 today.
I received a check today too…same amount
I haven’t heard anything either. It seems like the checks should be more than $30-$45.
Unfortunately it is only $45.00. There’s an article about it on Cook County Record.com.
Unfortunately it seems like A LOT of people were involved in the lawsuit and filed claims. That really drives that payout down :/

Unfortunately, nothing new to report. The settlement agreement states that payments will be made within 90 days of the Effective Date. The last appeal was dismissed at the end of October. That means that payments probably won’t arrive until end of January or a little later. You can always contact the settlement administrator or class counsel with your concerns. Someone called me about a week ago to let me know I had submitted a valid claim and my check would be between $30-$45.
