Nationstar Mortgage agreed to settle a class action lawsuit that accused the company of violating the Telephone Consumer Protection Act by robocalling consumers regarding a home loan.

Under the terms of the settlement, Nationstar will pay $12.1 million to Class Members as well as make some changes to company procedures which includes training employees how to properly code consumer requests to stop the calls.

Before this settlement, plaintiffs claim that the only way to way to stop the robocalls was to speak with a live operator and provide personally identifying information such as a social security number.

Nationstar denies that it violated any law and maintains that its calls regarding mortgage loans provided information that its customers agreed to receive. However, the company agreed to settle to avoid the expense of litigation.

UPDATE: On Aug. 29, 2016, the Court granted final approval of the Nationstar class action settlement. 

UPDATE 2: On September 8, 2016, a notice of appeal was filed in the Nationstar TCPA settlement.  Claims will not be paid until all appeals are resolved.  Top Class Actions will continue to provide updates as we learn more.  

UPDATE 3: As of October 25, 2016, the appeals to the Nationstar TCPA settlement have been dismissed.  Let Top Class Actions know when you receive a check in the comments section below or on our  Facebook page.

UPDATE 4: On Jan. 9, 2017, Top Class Actions viewers who submitted timely and valid claims for the Nationstar Mortgage TCPA class action settlement began receiving checks worth as much as $76!

Who’s Eligible

Nationstar settlement Class Members include all U.S. residents who received a call from Nationstar on a cell phone between Oct. 14, 2015 to the present. Most Class Members will receive a postcard notice of the settlement in the mail.

If you did not receive notice through the mail but believe you qualify as a Class Member contact the Claims Administrator at 1-877-683-9363.

Potential Award

Varies.

Class Members will receive an equal portion of the $12.1 million Nationstar Mortgage Settlement Fund. The individual amount will depend on the total number of valid claims filed.

N/A

No proof of purchase is required but you must file a Claim Form no later than April 11, 2016 and include the cell phone number that was called by Nationstar.

    Hey guys, no payment or communication received since the May 19 Final Fairness Hearing. What’ going on? I just left a message with the NationStar Call Settlement attorneys to find out what’s going on since there has been no update posted on the website 3 months later. Hopefully they will return my call soon. The phone number is 1-866-354-3015. If any of you get any updated information, please post it here. I will do the same :)

      Toni,
      I just called this number and a nice female rep told me the judge still has to make the final decision on the settlement, which he hasn’t yet.

      I did get through on my first time calling that number…….

      She (rep) did mentioned that they will post info on the website once the judge has made the final decision. The rep has no idea when that decision will be made.

      She also mentioned that whoever filled out the claim form had to make sure they filled it out correctly. Anything not filled out correctly you will be automatically disqualified.

      The rep who answered the phone had great customer service skills, so please be kind to her because she has to answer the same question to everyone that calls regarding this settlement.

    They continue to call me on mu cell phone, after I surrendered this property in a chapter 7 bk and they are still sending me statements. Has anyone received a settlement check yet?

    they took over by citimortgage. i made paments for seven months thinking it was going to the mortgage. come to find out no monies went into an account and house was foreclosed and sent to auction. unbelievable.

      Same here. . .they didn’t post our payments, then filed for foreclosure, then didn’t give us the loan modifications which were promised – twice. So they got a summary judgment against us and we moved before they sold the house. It was in a declining neighborhood anyway. At least over a period of six years, we only paid about 14 months – and lived there for free the rest of the time! They are genuine idiots.

    hi, we lost a lot of money because of nationstar non of our modification went through!!! they scam us!

      Same with me. I filled 2. My assigned person was never available. After denial of the first, I asked why. They said not enough income. I had one more apt. I could lease and asked if that amount would be enough to be approved on my second modification and they said yes. This was important since I was having someone sign an 18 month lease. They denied the second one and would not tell me why. Again, I never talked to my assigned person after 4-6 messages I left a day they never returned my calls. After the last denial I asked to speak to a manager. The manager told me to sell my house. That was their only suggestion and would do nothing to help me.

        Same thing happened to my wife and myself.We sent in all of the HARP paperwork twice.Just like you you could never get a hold of your case worker as to speak,Or even get any answers.The only verbal answer was that we did not send in some of the paperwork needed.This was pure BS.We sent it in twice Express Mail with proof of delivery.We sent the info in duplicate the second time to make sure.Same outcome.

    it will probably amount to $1.38 cents per customer. These bastards harassed me for almost 18 months callling sometimes twice a day. the amount i get had better be substantial!
