A $28 million settlement has been reached in a class action lawsuit alleging Monitronics International Inc. violated the Telephone Consumer Protection Act by making automated telephone calls to phone numbers listed on the national Do Not Call Registry and to recipients who did not provide their consent.

If you received a telemarketing call from Monitronics or on behalf of a Monitronics authorized dealer since May 18, 2007, you may be entitled to payment from the TCPA class action settlement.

The first Monitronics TCPA class action lawsuit was filed in May 2011 by plaintiff Diana Mey. It was consolidated in December 2013 with more than 30 similar Monitronics TCPA lawsuits under the case name In re: Monitronics International Inc. Telephone Consumer Protection Act Litigation.

According to the Monitronics class action lawsuit, the home security company violated the TCPA by using an automatic telephone dialing system or an artificial or prerecorded voice to make telemarketing calls to cell phones. The plaintiffs also allege Monitronics violated the law by making telemarketing calls to phone numbers listed on the national Do Not Call Registry.

The Monitronics defendants deny any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who would like to opt out of or object to the Monitronics TCPA settlement must do so no later than Feb. 20, 2018.

Who’s Eligible

Class Members of the Monitronics class action lawsuit include anyone who, since May 18, 2007, received a telemarketing call from an authorized Monitronics dealer, or a Monitronics dealer’s lead generator or subdealer, on a residential or cell phone using an automated telephone dialing system or prerecorded voice, or two or more calls within a 12-month period to a residential number listed on the national Do Not Call Registry.

Potential Award

$15 – $25 per claim (estimated).

The actual amount each Class Member will receive depends on the total number of claims that are filed.

      According to my records, I received the $42.35 in October last year. Maybe there’s extra money left so they are doing a second distribution. For example, some people who received checks never cashed it.

      According to the settlement agreement: If any amounts remain in the Settlement Fund because any Settlement Class Member fails to cash his/her Benefit Check, or such Benefit Check expires or otherwise becomes null and void, the Settlement Administrator shall distribute the remaining Settlement Fund to Settlement Class Members who cashed their Benefit Check from the previous round of distribution on a pro rata basis, if doing so is administratively and economically feasible. Class Members each would receive a check for more than $5.00, after the Settlement Administrative Expenses). In the event such distribution is not administratively and economically feasible, any remaining Settlement Funds shall be distributed to the Cy-Pres Recipient.

      “As of the claims deadline, 344,508 claims were submitted. Plaintiffs estimate that if the court approves the attorneys’ fees and costs, and plaintiffs’ service awards as requested, each claimant will receive a payment of approximately $38, an amount that compares favorably with other TCPA settlements approved by courts across the country.”

      If the settlement is approved, about $13 million would be distributed to class members while plaintiffs Dianna Mey and Philip Charvat would each receive $50,000, Jason Bennett would receive $6,012 and Scott Dolemba and Janet and Michael Hodgin would each receive $3,500.

      Attorney fees in the settlement total more than $9.3 million, not including about $600,000 in class counsel “out-of-pocket costs.”
