Top Class Actions viewers report that they are starting to receive checks from both the Ann Taylor fake discount and the Monitronics TCPA class action settlements.

Ann Taylor Fake Discount Class Action Settlement

Top Class Action viewers are reporting that they have started receiving checks from the Ann Taylor fake discount class action settlement worth $6.84.

The Anne Taylor fake discount class action lawsuit alleged that the clothing retailer falsely advertised the quality and price of merchandise sold at their discount outlets, Ann Taylor Factory and the LOFT Outlet.

Plaintiffs accused ANN Inc. of tricking consumers into thinking they were getting a great deal at the stores by implying that clothing and other items sold at the discount locations had actually been offered for sale at their regular retail location at much higher prices.

However, the deals were only “phantom markdowns,” claimed the Ann Taylor class action lawsuit as the items had never been offered for sale at the retail locations at the price represented on the items’ tags.

In fact, the items in some cases had never even been offered for sale at a regular Ann Taylor retail location, according to the Ann Taylor fake sale class action.

Ann Taylor agreed to pay $6 million to settle the class action lawsuit in January 2018.

Although the retailer did not admit any wrongdoing, consumers who made purchases of discounted items from Ann Taylor Factory or LOFT Outlet stores between May 5, 2012 and May 4, 2016 could make a claim under the terms of the settlement.

The deadline to file a claim for the Ann Taylor fake sale class action settlement passed on May 19, 2018.

Monitronics TCPA Class Action Settlement

Top Class Actions viewers are also reporting that they have received checks for $42.35 for claims in a Monitronics TCPA class action settlement.

The Monitronics TCPA class action lawsuit alleged that the company used automatic dialing systems to contact consumers via phone without their consent. Additionally, plaintiffs accused Monitronics of contacting individuals registered on the Do Not Call list.

The Monitronics calls that allegedly violated the TCPA occurred starting in May 2007. The company eventually agreed to settle four class action lawsuits initiated over the calls in November 2017.

Class Members in the Monitronics TCPA class action settlement include those who received an unauthorized telemarketing call from the company or a Monitronic dealer’s lead generator or subgenerator.

The deadline to file a claim for the Monitronics class action settlement passed on Feb. 20, 2018.

What is the TCPA?

The Telephone Consumer Protection Act, or TCPA, is a federal law that protects consumers from telemarketing. In response to growing concern over harassment, Congress enacted the TCPA in the 1990s prohibiting companies from contacting consumers via phone without prior consent.

The TCPA also limits the use of prerecorded phone calls and automatic dialing systems, as well as use of fax machines for advertising. The Do Not Call registry was also set up under the law.

A prohibition on the use of unsolicited text messages was added to the TCPA to provide consumers additional protection when it comes to their cellular telephones and other devices.

    I also rec’d a check for $3.95 on 8-23-19. A statement on the bottom of the check indicates that this is a supplemental settlement award due to money from uncashed checks. I did not receive the $42. plus check, and would like to know why.

      I moved more than a year before the settlement. Is it possible the settlement check was sent to my old address. Since the USPS does not forward mail after a year, the check may have been returned to the trustee for the claimants. Do I have any remedy?
