Young upset woman student talking on mobile phone while relaxing in cafe after lectures in University, concerned female have a bad conversation on cell telephone while sitting alone in coffee shop

A $28 million settlement has been reached in a class action lawsuit alleging Monitronics International Inc. violated the Telephone Consumer Protection Act by making automated telephone calls to phone numbers listed on the national Do Not Call Registry and to recipients who did not provide their consent.

If you received a telemarketing call from Monitronics or on behalf of a Monitronics authorized dealer since May 18, 2007, you may be entitled to payment from the TCPA class action settlement.

The first Monitronics TCPA class action lawsuit was filed in May 2011 by plaintiff Diana Mey. It was consolidated in December 2013 with more than 30 similar Monitronics TCPA lawsuits under the case name In re: Monitronics International Inc. Telephone Consumer Protection Act Litigation.

According to the Monitronics class action lawsuit, the home security company violated the TCPA by using an automatic telephone dialing system or an artificial or prerecorded voice to make telemarketing calls to cell phones. The plaintiffs also allege Monitronics violated the law by making telemarketing calls to phone numbers listed on the national Do Not Call Registry.

The Monitronics defendants deny any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who would like to opt out of or object to the Monitronics TCPA settlement must do so no later than Feb. 20, 2018.

Who’s Eligible

Class Members of the Monitronics class action lawsuit include anyone who, since May 18, 2007, received a telemarketing call from an authorized Monitronics dealer, or a Monitronics dealer’s lead generator or subdealer, on a residential or cell phone using an automated telephone dialing system or prerecorded voice, or two or more calls within a 12-month period to a residential number listed on the national Do Not Call Registry.

Potential Award

$15 – $25 per claim (estimated).

The actual amount each Class Member will receive depends on the total number of claims that are filed.

  2. Jovonna Dodson says:

I am on a no call list and still was getting calls

  3. Charles Anthony says:

I got a card in the mail with a claim number on it, we get so many calls from telemarketers, how do we know for sure that they called me, I am on the no call list

    1. Top Class Actions says:

If you received a notice in the mail, you should submit a claim. You can also contact the settlement administrator or class counsel with any questions.

  4. P. Bradley says:

This is all well and good. Companies should be fined for this. I am constantly called by all types of telemarketers and I have been on the (do not call) list from the start. It’s a great law it’s just not followed or in-forced. When I tell the them about the do not call list, they just say “so, what are you going to do about it”.
Anyway; To loose all rights to sue weather I file or not and the company stills does not admit to any wrong doing and is not held accountable, is proof that laws are written to protect lyres, cheats and thieves. A $28Mill. settlement sounds like a lot but the lawyers get most of it and it’s a small fraction of the profits made. Let’s see big prison time for the ceo’s and upper mgt. people, that will have a great impact on them. While were at it lets get the phone companies involved, they are making just as much money off this marketing scam.

  5. Clarence Hammonds says:
