UPDATE:
- An appeal to the Massage Envy fees settlement was filed March 26, 2020.
- On October 20, 2021, the 9th Circuit Court vacated the District Court’s approval of the settlement.
- Top Class Actions will let our viewers know as soon as a revised settlement agreement is submitted to court for approval.
- Massage Envy has agreed to pay $10 million to resolve class action claims that the spa unfairly increases monthly membership costs.
The settlement will benefit individuals who were a member of a Massage Envy Spa between Nov. 4, 2006, and June 7, 2019.
Several plaintiffs filed the Massage Envy fees class action lawsuit over allegations that the spa continuously increased the price of their membership fees without informing customers.
In June 2019, a California federal judge said that she would likely approve the $10 million settlement despite arguments that the vouchers provided by the settlement would be insufficient.
A plaintiff in another Massage Envy class action took issue with the proposed settlement, but U.S. District Judge Maxine Chesney decided to give preliminary approval to the settlement despite objections.
A website was established for the settlement a few weeks later. The website, which now hosts details and claim options for the settlement, acted as a placeholder until the full notice and voucher request forms were available.
Massage Envy has agreed to make changes to their membership fees. Additionally, Class Members can receive a voucher with a value between $10 and $50. In order to receive settlement benefits, Class Members need to submit a voucher request by Sept. 20, 2019.
The voucher amount depends on the amount Class Members paid in fee increases, as follows:
- $10 voucher: paid $75 or less in fee increases
- $20 voucher: paid $75.01 to $125 in fee increases
- $30 voucher: paid $125.01 to $175 in fee increases
- $40 voucher: paid $175.01 to $225 in fee increases
- $50 voucher: paid $225.01 or more in fee increases
The deadline for exclusion and objection is Sept. 20, 2019. The final approval hearing for the settlement is scheduled for Nov. 1, 2019.

This is a ridiculous class action suit. McKinney-Drobnis, et al. attains there information on fee increases from Massage Envy themselves, which is clearly a conflict of interest when the party you have a suit against is providing information about their members with no supporting documents. I have had over $720 in fee increases since the time I signed my contract and became a member. Massage Envy claims that I have only had $31.00 in fee increases which places me in the $10 voucher category. Of course, they are going to tell them that so they don’t have to honor anything more than $10 voucher.
It is obvious McKinney-Drobnis doesn’t care about the claimants in this case only what is lining their pockets by taking on this case! What a joke!
